WHEREAS , the Ci ty Co un cil of the City of Eng lewood auth orized "Th e Co ll ective Barga ining Agreement" with th e Engle woo d Employees Association for January I, 2004 through December 31, 2005 , by th e passage of Re so lution 68 , Sen es 2003; and WHEREAS , "Th e Collective Bargai ning Agreement " wh ich was authorized by Resoluti on 68 1 Seri es of 2003 in clud ed a provi sio n for negotiation of 2005 salaries in 2004 ; and WHEREAS , th e City of Englewood and the Engl ewood Employe es Ass ociation en tered into wage negotiations in May , 2004 in acco rdan ce with the EnglewOJd City Home Rul e Charter and the co ntract provision s; and WHEREAS, the wage negotiations for 2005 sa lari es resulted in impasse and an arbitrator was appo inted by the Engl ewood City Cou ncil 10 de ci de the matter; and WHERAS , after arbitration , the arbitrator decision adopted the final offer of the City ; and WHEREAS, the passage of thi s Resolution will auth ori ze the pro visions of the "Collective Barg aining Agreement" uetwee, the Englewood Employees Association and the City of Engle wo od for the year 2005 ; and WHEREAS , the only change to the contra ct is under Arti cle 8, page 9 (F); Em ; !oyee s c overed by th e Contrac t will rec eive one point twelve pcrccnt(l.1 2%) increase over th !!~-Jn4 base wage rat e effective January I, 2005 throu gh Dece mb<r 31 , 2005 ; NOW , THEREFORE , BE IT RESOLVED BY THE CITY COUNC IL OF THE CITY OF ENGLEWOOD , CO LORADO , AS FOLLOWS : Section I. The City Counci l of the City of Eng lewoo d, Co lorado hereby approves th e salary prov isio ns for the year 2005 of the Coll ective Bargaining Agreement, A11iclc 8 -Compensatio n, attached heret o as Exhibit A, betwee n th e Englewood Emplo yees Assoc iation and th e City of Eng lewood fo r the period of January I . 2005 through Dec emb er 31, 2005 . • Section 2. The Mayor and the Ci ty Clerk are hereby auth ori ze d to sig n and attest the wage provision of th e Co ll ective Bargaining Agreement between the Englewood Em pl oyees Associati on and the City o f Eng lewood, Colorado, for the period of January I , 2005 throu gh December 31, 2005 . COMPENSATION A A. Each employee in the classified service shall be pai d ,. ithin the range set forth in the • City of Engl ewood 2004 Compensation and Classification Plan for the position in which the y are employed. (See Plan document for details .) B. At least the minimum rate of pay for a position shall be paid to an employee who is starting his employment with the City. C. When a regular full -time position not under the classified service is brought into the classified service, the rate of pay of the incumbent may be set by the City at an amount closest to his/her current rate in the grade established for the position . In such cases there will be no reduction in pay. D. A change in anniversary date will result when : · (\) The employee is on leave without pay. (See Article 26. Leave of Absence (Without Pay) (2) The employee terminates his employment and later is reemployed . The new anniversary date shall be determined by his new employment dat,:. E. All performance pay awarded to the emp lo yee will be considered upon the anniversary date and shall not be considered automatic, but rather, based upon performance , as ev :denced by the performance evaluation. • Fundamental changes to A-E (above) will be made only with prior consultation and review with association representatives. F. The agreeme nt includes a provision (Article 8, Section F) for the negotiation of 2005 salari es, in 2004. RECOMMENDED ACTION Sta ff requests Counci l approva l, by resolution, of th e sa lary provisio ns of the Coll ec tive Bargai ning Agreement between the Englewood Emp loyees' Association and the City of E••glewood for 2005. The co ntract covers approxima tely 198 employee s . BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The City of Englewoo d and the Englewood Employee s' Association entered into wa ge negotiati ons in May of 2004 in acco rdan ce with the City of Engl ewood Cha rter. Th e negotiations res ulted in impasse and the arbitrator, dul y appointed by City Council to decide the ,,.alter, adopted th e fina l offer of the City of Englewood. The only change to the contract is under Articl e 8, pag e 9 (F). Employees covered by th e contrac t w ill receive a one and twelve one hundredths percent (1.12%) increase on the 2004 base wage rate effective January 1, 2005. FINANCI AL IMPACT Th e impact of th e 1.12% wage increas e for 2005 is approximately $95,3 18.00. O th er significant increases based on the wage ad justm ent are for p ensi on and socia l sec urity/M edi ca re ben efi ts · equaling $27,086 for a t otal fin ancia l impact of $1 22,404 . Employees of the City of Englewood represented by the Englewoo d Emp 10yees Association and co vered by this Contract shall receive a one and twel ve one hun w~dth s perc ent ( I .12%) increase on the 2004 base wage rate effective January I , 2005 . • • • • In accord with the findings and conclusi ons herein and pursuant to the authori ty vested in me by the Home Rule Charter of the Ci ty of En glewood Colorado, sp t:c ificall y Section 13 7 :6 thereof, I adopt the final offer of the City of Englewood fo r resolution of the 2004 collective bargaining impasse between the Eng lewood Emplo yees' Association and the City ofEnglewood relative to the final outstanding issue in dispute between the parties as follows : All members of the bargaining unit of the Englewood Employees' Association shall rece iv e a 1.12 percent increase over their 2004 base wage, effective January 1, 2005 .
