The invocation was given by Reverend Helen Walker, Esoteric Truth Center, 130 East Girard. The Pledge of Allegiance was led by Boy Scout Troop #154. Mayor Taylor asked for roll call. Upon the call of the roll, the following were present: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton, Taylor. Absent: None. Councilman Brown seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton, Taylor. Nays: None. Acting City Manager Waggoner stated that under this lease and agreement the City would lease 1,600 acre feet of water to the City of Thornton for $200,000 a year at a cost of $125 per acre foot. James D. Geissinger, Special Water Counsel to the City of Englewood, 730 Equitable Building, Denver, reviewed the contract and explained some of the details for the benefit of the audience. COUNCILMAN CLAYTON MOVED THAT THE BILL FOR AN ORDINANCE 'ro APPROVE THIS LEASE AND AGREEMENT WITH THE CITY OF 'IHORNTON BE MOVED UP ON THE AGENDA TO BE CONSIDERED AT THIS TIME. Councilman Mann seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton, Taylor. Nays: None. The Mayor declared the motion carried. INTRODUCED AS A BILL BY COUNCILMAN WILLIAM3 A BILL FOR AN ORDINANCE APPROVING AN AGREEMENT BETWEEN THE CITY OF ENGLEWOOD, COLORADO, AND THE CITY OF THORNTON, COU)RADO, CONCERNING THE LEASING AND STORAGE OF ENGLEWOOD RANCH CREEK WATER. COUNCILMAN WILLIAM3 MOVED 'ro PASS THIS BILL FOR AN ORDINANCE ON FIRST READING. Councilman Mann seconded the motion. COUNCILMAN SMITH K>VED TO AMEND PARAGRAPH 9, PAGE 4, OF THE LEASE AND AGRE!.MENT WITH THORNTON, AND PARAGRAPH 1, SECTION 1, PAGE 2, OF THE BILL FOR AN ORDINANCE 'ro INCLUDE "OR UNLESS ENGLEWOOD SHOULD NEED SAID WATER". Councilman Brown seconded the JOOtion. Upon a call of the roll, the vote resulted as follows: Ayes: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton, Taylor. Nays: None. The Mayor declared the motion carried. * * * * • * Acting City Manager Waggoner presented a recommendation from the Water and Sewer Board that City Council increase the water tap fee for a 3/4" residential tap inside the city to $1,000 with other size taps to be calculated from that as a base rate, and outside city taps to remain at 150% of comparable inside rates, this change to be made as soon as possible. COUNCILMAN CLAYTON MOVED TO RECEIVE THE RECOMMENDATION CONCERNING WATER TAP FEES FROM THE WATER AND SEWER BOARD AND THAT THE CITY ATTORNEY DRAW UP A RESOLUTION TO CARRY OUT THIS RECOMMENDATION APPLYING TO DOMESTIC SERVICES. Councilman Sovern seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Council Members Williams, Sovern, Smith, Brown, Mann,. Clayton, Taylor. Nays: None. The Mayor declared the motion carried. • • • * * • • Councilman Mann presented a recommendation from the Water and Sewer Board that City Council consider abolishing Section 15-3-48 of the Englewood Municipal Code concerning aperture devices. The present ordinance requires the use of a nozzle or nozzles for sprinkling of gardens or lawns and washing of sidewalks or other outside water use. Councilman Mann stated it is far more economical in a water-saving technique to not use a nozzle when soaking lawns, gardens, etc. . . July 5, 1977 Page 4 COUNCILMAN SMITH :r.DVED TO REQUEST THE CITY ATTORNEY TO DRAW UP AN ORDINANCE ABOLISHING SECTION 15-3-48 OF THE 1969 ENGLEWOOD MUNICIPAL CODE. Councilman Mann seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton, Taylor. Nays: None. The Mayor declared the motion carried. * * * * * * Acting City Manager Waggoner presented a recommendation from the Water and Sewer Board for approval of Supplement #6 to Valley ·sanitation District, which is for a Safeway Store at the southeast corner of Belleview and South Irving Street. COUNCILMAN MANN MOVED TO APPROVE SUPPLEMENT #6 TO VALLEY SANITATION DISTRICT. Councilman Clayton seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton, Taylor. Nays: None. The Mayor declared the motion carried. * * * * * * Acting City Manager Waggoner presented a recommendation from the Water and Sewer Board for approval of the amendment to the Distributors Contract #7 with Cherry Hills Rancho Water and Sanitation District to serve water to the Bill Matsch property at 3701 South Corona Street. COUNCILMAN CLAYTON MOVED TO APPROVE THIS AMENDMENT TO THE DISTRIBUTORS CONTRACT #7 WITH CHERRY HILLS RANCHO WATER AND SANITATION DISTRICT. Councilman Mann seconded the motion. The Mayor declared the motion carried. * * * * * * INTRODUCED AS A BILL BY COUNCILMAN WILLIAM3 A BILL roR AN ORDINANCE APPROVING A CONTRACT BEI'WEEN 'DIE CITY OF ENGLEWOOD AND THE STATE OF COLORADO, DEPAR'IMENT OF HIGHWAYS, CONCERNING MAINTENANCE OF TRAFFIC CONTROL DEVICES ON STATE HIGHWAYS WITHIN 'DIE CITY OF ENGLEWOOD. Acting City Manager Waggoner stated this Bill for an Ordinance is a procedure followed each year where the State pays the City according to the agreement for maintenance of traffic signals, signs, and striping of State-owned roads and intersections through the City of Englewood. Hayes from the Water and Sewer Board and Edward G. Smith from the Planning and Zoning Commission. The Mayor declared the tootion carried. • • • • • • Director of Finance James reviewed with City Council various matters concerning the management letter from Shepherd and Company, Inc. • • • • • • Mayor Taylor presented and read a letter from Bill Coffin, 3057 South Ge.lapago, and another letter from Norma Wells, 628 West Hampden Avenue, concern- ing the problem of dogs barking and running loose. • • • • • • Councilman Sovern noted that the City needs to keep pursuing the law suit filed against the State for funding of the Police and Fire Pension Funds. • • • • • • Councilman Smith noted that City Council has not received a response from the Career Service Board to a letter from the Mayor concerning vertical promotions. July 5, 1977 Page 7 Lieoma Koestner, President of the Englewood Employees Association, appeared and stated that the note to City Council from the Employees Association only reflects the feelings of the employees. Acting Personnel Director Brown stated that a response from the Career Service Board will be sent to City Council at the next regular meeting. * * * * * * Acting City Manager Waggoner stated that the I-470 transfer of monies has been approved for three projects and that approval for new projects needs to be pursued. The Mayor declared the motion carried. * * * * * * Acting City Manager Waggoner announced the appointment of Ji~ E. Curnes of Wheeling, West Virginia, as Assistant City Manager effective July 25, 1977. * * * * * * Councilman Brown noted that Councilman Smith and he flew to San Antonio, Texas, to tour the United States Air Force Base on June 23 & 24, 1977. He also noted that the Colorado Municipal League Conference was held in Colorado Springs on June 29 & 30 and July 1, 1977.
