a c o::;pl icate d fo ·ula that h a s to do vith the a.mount ot taxes the City receives and the
t a x base. In 1978 the City will rece ive in revenue sharing tu.nds slightly less than
$700,000. In compliance with the guidelines tor receiving these funds, the City must
hold two public hearings -th11 me eting being the first to receive input from the
public aa to how they would t!eslre to spend the money. The second public hearing
~ould be held later a1 part the' budget hearing when the City submits the proposed
budget to the Council with specific uses tor the revenue sharing funds outlined
in the proposed budget. At that time the public would be invited to comment on
these specific uses.

to speak to the Council on proposed uses tor revenue sharing tu.nds tor 1978.

could be spent by the Water Department. City Manager Mccown replied that the
~at e r Department could use part of the mo ney from the revenue sharing funds.
Mr . J o nes then asked t.hat s ome of the mo ney be used by the Water Department to facilitate
t he treatment and distribution ot water.
Mqor Taylor asked if there was anyone else wishing to address the Council
on the proposed use ot revenue ohar!ng funds. Ro one replied.

Mr. Tom Bu r n8 1 3600 s. Ba n 0 ck 1 appeared before the Council in the
c a pacity as Chainnan or the Engl ewo od Housing Authority and presented a memoran-
dum regarding the Housing Rehabilitation Program. Mr. Burns explained that the
rrousing Authority baa for some time de sired to implement changes in the Program
and that the Housing Authority bas been pursuing an arrangement tor sourcing with
local banks to expand the funding ot the progralli, In order to implement the
desired ch anges, Mr. Burns requested that the Council agree to accept the proposed
by-lava concerning the Rehabilitation Loan Commission membership as well as the
revised agreement.
Councilman Sovern inquired about the proposed by-laws in that under
1.0 entitled "Amendment"• the Authority mflT by a vote amend any of the by-laws
provided the Amendment i• submitted in writing. Councilman Sovern stated that
such a provision could posaib)7 give the Committee overriding power. He
suggested that a reviaion be made to include con•ultation vith the Council by the Com-
mittee tor Council input before &IJl1 monq i• spent on programs.
Councilman Cla.Yton suggested that the wording on page 2 under 5.0
"Meeting" be changed troa ".,. in a building owned by the City , •• " to "operated
b7 the City" or "otticial Cit7 building."

Cit7 ot Englewood vs. Motor Crane and Winslow Construction which grants to them a
ten foot eesement across a portion ot the golt course area in order to allow them
to c onne ct a sewer outlet from their propert7 to the 66" main that traverses part
ot that course.

Council would allow the refund or r e nt money for property that the Council purchased for
the Simon C ·nter. Cou nci lma n S .1th st ted that at a later time, the Council was
notified by the City Attorney that under state lav the act was perhaps unlawful and could
result in misappropriation of fl nds. Based on the City Attorney's opinion the Council
cou1d be liable to suit.

Council.;:;an Sovern pointed out that Councilman Smith's motion is a
rescinding ot two mot ions that were made at two different meeting of Council.
The first motion was made J a nual"1' 3, 1977 and the second February 7, 1977• Whereas,
on February a motion was made reque sting a meeting with the land owners because of
the legal question raised at that meeting, and the land owners failed to oblige.

Cit7 Manager preaente4 a report from the Fire Department and the Fire
Association concerning overtime requirements in order to maintain 3-man per piece
ot equipment in the Fire Dep art me nt this year. City Manager Mccown explained that
t he Fire Department projects deficit in t h e ir overtime allowance this year due to
sick leave pq, injury leave end pension A.ctions . The Fire De:pe.rtment projects that
the overtime allowance will be approxima te!¥ $10 1 000 over at the end ot the year.
City Manager McCown recomm ended the Council appropriate $10 1 000 to the Fire
Department to supplement the budget.
Cit7 Manager presented thre e memorandums from the Firefighters Association
stating that the Association will appoint a conmittee to monitor the use ot sick
leave and t17 to control the use by their own members; and also, apologizing for
erroneo us statement• that were made to a radio station and resulted in an erroneous
news release. The memor an dums assured the Council news releases will not be made
by BJ17 ot their members unless that person is cleared first by their executive board.

City Man ager McCovn pres ented a report recomm e nding the use of a surplus
pumper from the Fire De partment being a ssigned to Red Rocks Campus of the Community
College ot Denver for their use in the various programs that they have available.
Chiet Hamilton and Mr. Joe L ~Wand 1 Chief Instr uctor of Forest Sciences
at the college appeared before the Council and answered questions that the Council
had concerning this assignment. Mr. Le.W&nd eteted that in the agreement for this
assignment 1 a cl ause will be inserte d to the effect that it at any time 1 the pumper can
no longer be used in the program, the pum p e r will be returned to the City ot Englewood.
Mr. La.Wand thanked the Council for their g en erous a ction.

r e vi ew ed the r e sults of the survey. Dire ctor Waggoner point e d out that Alternate 112
wa s f a vored the highest e.m~ngst thre e alterna tives. Director Wa gBoncr further
pointed out that in view ot the survey results, meetings with the Flood Control
District and with the Englewood School Board tor a possible solution should
be con3idere4. He stated factors to be considered with deteiled explanation and
recom.rnended that the Council decide to pick an Alternate and present the choice
to the District as well as request w~s ot financing the project.
Councilman Sovern stated that the progrflJJI shotLld be •:researched in .
a ccordance to funding availability and scrutinized to see if the City would
be eligible for different funding opportunities. Council.man Sovern also stated
that the City should have sources of money from which to draw upon before an
alternative can oe chosen.
M~or Taylor requested that the Council should decide on an alternate .
to commence the project nov that the results ot the survey are in.
Councilman Sovern suggested that the Council conduct a study session
to decide on an alt e rnate and discus s the matter et lengt h. Councilman Sovern
requested that a date for sometime in October be set at the next regular Council
me eting, Septemb~r 19 1 1977.
William Anderson, 4981 s. Washington, appeared before the CoWlcil
and stated that the water must be stopped above Clarkson in order to prevent
aey flooding.
