REGULAR MEm'ING:
The City Council of the City ot Englewood, Arapahoe County, Colc•rado
met in regular session on October 17, 1977 at 7:30 P.M.
Mayor Taylor, presiding, called the meeting to order.
The invocation was given by Councilman Brown. The Pledge of
Allegiance was led by Mayor Taylor.
Mayor Taylor asked for roll call. Upon the call of the roll, the
following were present:
Council Members Sovern, Smith, Mann, Brown, Clayton, Taylor.
Absent: Council Member Williams.
The Mayor declared a quorum present.
Also present were: City Manager Mccown

Council Member Williams.
The Mayor declared the motion carried.
Mayor Taylor presented the Proclamation to Mr. Marten E. Lathrop,
3259 S. Clarkson Street, which designates October 22, 1977 at United Nations
Day and appoints Mr. Lathrop as the Englewood Chairman for United Nations
Day.
Mr. Marten Lathrop thanked the Council for the honor and privilege
this Proclamation declares and stated that the group he represents appreciates
the Council's recognition.

Pre-scheduled visitor Larry Nowacki, business address 701 w. Hampden
Ave., appeared before the Council on behalf of CONSENSUS. Mr. Nowacki presented
a letter from the Flood Control Committee concerning Little Dry Creek Flood
Control, and the School Board's unfavorable response to Alternate 12. Mr.
Nowacki stated the Committee feels that the use of a detention pond would
reduce the costs of flood control on Little Dry Creek and requested the
Council to consider hiring Wheeler & Lewis or some independent consultant
acceptable to the School Board to make an impact study of the detention pond
and its effect on the school district's property.
Councilman Smith pointed out that the School Board has submitted a
position paper on Alternate #2 stating that they accept the drainage pond • .
Mayor Taylor stated that a concentrated comprehensive study on
Little Dr,y Creek will be conducted November 14 1 1977; and hopefully the City
Council will be able to determine which alternate or combination of alternates
are acceptable. Mayor Taylor also stated that the Council and School Board
wi ll mee t in the near future if necessary to determine whether a further
impact study needs to be made and which firm will be contacted to ~e this
study.

Mayor Taylor asked if there were any visitors wishing to speak to
the Council.
Sheila Robinson, 3931 s. Pearl, appeared before the Council on
behalf ot the neighborhood behind the Englewood High School. Ms •. Robinson
stated that the students from Englewood High School are causing problems
in this neighborhood, by littering, loitering, racing cars up and down
the streets creating hazardous traffic conditions. Ms. Robinson stated
that she contacted the Englewood Police Department for help but was informed
that the police department did not have the manpower to patrol the neighbor-
hood and that is why she ~as here tonight to plead with the City Council
for help.
'nle 'members of the Council acknowledged this problem and assured
Ms. Robinson that they would look into the situation by gettirig a report from
Captain Hall of the Englewood Police Department and by contacting the School
Board to notity them of the situation. The members of the Council felt that
alerting the School Board of the problem would result in an enforcement of
certain rules prohibiting students from leaving the school grounds during
school hours.

Carl Olson, 2958 s. Lincoln Street, appeared before the Council
and expressed concern over the widening of Dartmouth Street and the harardous
traffic conditions that will be created. Mr. Olson inquired if the widening
could be stopped and another street widened instead.
Councilman Smith explained to Mr. Olson that the plans for widening
Dartmouth have been discussed for the past ten years and that the street has
been designated as an arterial. Councilman Smith further explained the Council
approved the plans after no one objected during the public hearings held on
this subject. Councilman Smith stated that be appreciated Mr. Olson's concern
but there was nothing that could be changed.

Mrs. Harold Voit, 3930 s. Pearl, appeared before the Council and
discussed a grocery store in her neighborhood that is being used as a I
luncheonette by teenagers. Mrs . Voit stated that this Juncheonette was
part of the problem in the neighb orhood Ms. Robinson referred to earlier. The

p os sible to block the future sale of theluncheonette to other people if

Councilman Mann stated that the answer would depend on the zoning

Carlene Austin, 3905 s. Pearl, appeared before the Council to report
that herproperty has been burglarized several times by these students who
race thllr cars up and down the neighborhood behind the Englewood High School.
Ms. Aus ... also reported the luncheonette stays open only during the hours
that &rRconvenient tor the students and not for the rest ot the neighborhood.
Mayor Taylor thanked the people who came forth to report these
proble• in their neighborhood and stated that the Council would notify the
necess~authorities to look into possible solutions in order to curb any
further trouble.

Councilman Clayton requested that the association be more prompt
next year in requesting the public hearing and avoiding a rush ~t the last
minute for approval.
Mayor Taylor asked if there was anyone in the audience opposed to
granting the special events permit. No one replied.

Councilman Sovern stated that he did not agree with the motion because
the work program is B comprehensive plan and if the program is to work to the

COUNCILMAN BROWN 'MOVED TO DEFER ORDINANCE NO. 26 SERIES OF 1977
UNTIL IOVDIBER 21, 1977 GIVING THE CITY ATTORNEY AND CITY COUNCIL TIME TO
STUDY THE ORDINANCE. Councilman Smith seconded the motion.
Councilman Brown stated that when he had proposed the ordinance
be vae coocerned about the problems in his district forgetting that there
were other areas in Englewood vi th enough land to keep large animals. Council-
man Brown stated that he wanted to be fair to all people in Englewood and
maybe the ordinance should be redrafted to take into consideration other
areas that can accommodate large animals.

Marshall Payson, 2133 W. Wesley Ave., appeared before the Council and

No. 26 as it is curren tly writte n. Ar. Payson requested the City Co uncil to

City Attorney Berardini added that anyone else interested in receiving
a copy of the redra~ to also leave their names and addresses with the Clerk.
Councilman Sovern expressed concern on the incompatibility between
the animals and the zoning plans for that neighborhood. Councilman Sovern I
stated that the area is designated to be R-2 and animals in this type of
zoning would not be compatible and in effect reduce the development pace of
Scenic View.
Councilman Smith couunented that the petition was circulated negatively.
Councilman Smith acknowledged that Scenic View was an area different from other
areas in Englewood in attitude and styles ot living. Councilman Smith doubted
that animals have hurt or would hurt this neighborhood and that the animals
would probably disappear by natural attrition.
David Burnett. 2130 W. Ilitt • appeared before the Council and agreed
with Councilman Smith. Mr. Burnett stated that most ot the people are 35 years
old or over and want to fight for their rights; namely. the right to keep animals.
Mr. Burnett further stated that the people are for improvements; but there have
been no complaints about the animals and the animals are well taken care of.
Mayor Taylor asked if there was anyone else in the audience wishing
to spe ak to the Council on this matter. No one replied.

City Manager McCown presented a memorandum from himself concerning
the Six-Quarter Budget for the period of October. 1977 to March. 1979. The
City Manager noted some changes in the cover memo; namely. 1977 Budget Changes
should be 1978 Budget Changes; 1978 Budget should be 1979 Budget and the first
line under 1978 Budget should read "... of 1979 we ••• ".

COUNCILMAN SMITH MOVED TO DIRECT THE CITY MANAGER TO PROCEED WITH
THE Pim FOR THE OFFICE SPACE AND APPROPRIATE FURNITURE BE OBTAINED AND NOT
TO EXO&D THE PLANNED $2,500 IN COOTS. Councilman Sovern seconded the motion.
Councilman Smith stated that other city councils within the United
States lave an office within thei r respective city halls to meet with constituents;
and ~..a happy that this Counc i l took action to set aside a place for this
Coun dl to do the same.

avai l able for Council and she hoped the $2,500 included a typewriter.

City Manager McCown informed the Council of a postponed agenda
item which was a request from Mr. John Littlehorn, 4530 South Broadw&¥, for
a public hearing to consider rezoning of the property in the vicinity of
South Lipan and West Quincy. City Manager Mccown stated that the Council
decided to take action at this Council meeting.
COUNCILMAN SMITH MOVED THAT BASED ON THE RECOMMENDATION OF THE
PLANN I NG AND ZONING COMMISSION THAT THE COUNCIL ACCEPT THE RECOMMENDATION AS
GIVEN AS OF SEPTEMBER 20, 1977, AND THE RE'lONING REQUEST BE DENIED AND NO
FURTHER HEARING BE GRANTED AT THIS TIME. Councilman Sovern seconded the
motion.
Mayor Taylor suspended the rules and recognized Mr. John Littlehorn
inviting him to come before the Council on this matter.
Mr. John Littlehorn, 4530 South Broadway, appeared before the Council
and stated that he believed the Planning and Zoning Commission and the Variance
Cormni ss ion should study his rezoning request further. Mr. Littlehorn stated
t h at he t hought he had an unique piece of property and he was disappointed
i n th e Council's decision. Mr. Littlehorn further stated that he has followed
t h e rec omm endation of the Comprehensive Zoning ordinances and did not know which
way to go now.
Councilman Smith explained that the Comprehensive Plan is only a zoning
f o recast for a period of y.ears; and does not dictate the outcome of the final
zoning or rezoning.

in terms a nd conditions. City !·~a nager further stated that the changes were
unclear a nd at the time the City did not have anyone in the Utilities Department
to negotiate the changes with Adolph Coors Company. City Manager McCown stated
t hat t he City now has a Util i ties Director and he is reconunending that the
Council approve the renewal of the lease for one year during which he will work
with t he Adolph Coors Co mpal'\Y in trying to reach changes that can be recommended
to t he Water and Sewer Board and the City Council.

Councilman Smith inquired about the report from the Public Service
Comparv on gas taps in Scenic View. City Manager Mccown stated that no report
has been received.

Councilman Smith sugg ested that the City Manager write a letter to
CML, DRCOG and the Drought Council concerning the referendum just received,
the tardiness of the receipt and limited amount of time in which to give a
reply. Councilman Smith requested that the City Manager include in the letter
that this is not the first time these organizations have been tardy in sending
out information and demanding a reply instantaneously and that the City hope
future practice of this type will cease. Councilman Smith also requested that
the City of Englewood's County, State and Federal representatives be sent copies
of the letters. ·

Councilman Clayton stated that he has received several complaints
concerning the traffic conditions at s. Bannock and where it would meet West
Belleview if the street went through. The area refuses left hand turns and the
only WtJ¥ to get around the area is to go five blocks out of the way. Councilman
Cl ayton stated that he has asked Mr. Kells Waggoner, Director of Public Works,
to conduct studies of this area and try to alleviate west bound traffic problems.

Co uncilman Brown pre s e nt e d a news release stating why he has decided
not to run for Council in the ne xt Muni cipal Election. Councilman Brown added
that he did not support any candidate in District #2 and that he wanted the
people to study the respective p l atforms of each candidate and let the people
make up their own minds.
