CITY OF ENGLEWOOD, COLORADO
March 22, 1976
SPECIAL MEETING:
The City Council of the City of Englewood, Arapahoe
County, Colorado, met in special session on March 22, 1976
at 7:00 p.m.
Mayor Taylor, presiding, called the meeting to order.
The invocation was given by Councilman Smith. The
Pledge of Allegiance was led by Mayor Taylor.
Mayor Taylor asked for roll call. Upon the call of
the roll, the following were present:
Council Members Williams, Sovern, Smith, Brown, Mann,
Clayton, and Mayor Taylor.
Absent: None.
The Mayor declared a quorum present.

COUNCILMAN MANN MOVED AND COUNCILMAN SMITH SECONDED A
MOTION TO OPEN A PUBLIC HEARING TO CONSIDER AN ORDINANCE REZONING
A PARCEL OF LAND FROM R-2-A, TWO-FAMILY RESIDENCE DISTRICT, TO
R-2-C, MEDIUM DENSITY RESIDENCE DISTRICT. Upon a call of the
roll, the vote resulted as follows:
Ayes: Council Members Williams, Sovern, Smith, Brown,
Mann, Clayton, Taylor.
Nays: None.
The Mayor declared the motion carried.
Steve House, Department of Community Development,
explained that the area involved is bounded on the east by
the Grant/Sherman alley on the west by the Lincoln/Broadway
alley, on the south by East Oxford Avenue, and on the north
by East Kenyon Avenue. This area was previously zoned R-2-A,

two-family residence district; but at the present time the area
is technically unzoned. He submitted copies of the following
for the record: legal notice of public hearing, staff report
on Case #7-76, minutes of the Planning and Zoning Commission
meeting of February 18, 1976 and the findings of fact from the
Planning and Zoning Conunission. Mr. House explained the new
R-2-C zone district.
No one appeared to speak for or against this ordinance.
COUNCILMAN SOVERN MOVED AND COUNCILMAN MANN SECONDED
A MOTION TO CLOSE THE PUBLIC HEARING. Upon a call of the roll,
the vote resulted as follows:
Ayes: Council Members Williams, Sovern, Smith, Brown,
Mann, Clayton, Taylor.
Nays: None.
The Mayor declared the motion carried.
INTRODUCED AS A BILL BY COUNCILMAN SMITH
BY AUTHORITY
ORDINANCE NO. 15
SERIES OF 1976
AN ORDINANCE REZONING A CERTAIN PARCEL OF LAND WITHIN THE CITY
OF ENGLEWOOD, ARAPAHOE COUNTY, STATE OF COLORADO, FROM R-2-A,
TWO-FAMILY RESIDENCE DISTRICT, TO R-2-C, MEDIUM DENSITY RESIDENCE
DISTRICT, AND AMENDING THE OFFICIAL ZONING MAP ACCORDINGLY.
COUNCILMAN SMITH MOVED AND COUNCILMAN SOVERN SECONDED
A MOTION TO PASS ORDINANCE NO. 15 ON FINAL READING AND TO INCLUDE
ADOPTION OF THE PLANNING AND ZONING COMMISSION FINDINGS OF FACT.
Upon a call of the roll, the vote resulted as follows:
Ayes: Council Members Williams, Sovern, Smith, Brown,
Mann, Clayton, Taylor.
Nays: None.
The Mayor declared the motion carried.

A MOTION TO OPEN A PUBLIC HEARING TO CONSIDER AN ORDINANCE FOR
PAVING DISTRICT NO. 22. Upon a call of the roll, the vote
resulted as follows:
Ayes: Council Me mbers Williams, Sovern, Smith, Brown,
Mann, Clayton, Taylor.
Nays: None.
The Mayor declared the motion carried.
Director of Public Works Waggoner presented information
on Paving District No. 22, which was created by Ordinance No. 7,
Series of 1975, after a public hearing was held on January 27,
1975. The district involved eighteen blocks of new construction
and three blocks of overlay, with a total cost of $498,139.36.
The list of assessments was published in the Englewood Herald
Sentinel on February 25, 1976; and individual notices were mailed
on February 27, 1976. Mr. Waggoner explained how payment of the
assessments could be made and outlined the final costs. He
reviewed how the assessments were made for each type of paving
and sidewalk construction. There were two types of assessments
applied for the district, front street assessments and side
street assessments, depending on how the lots were laid out.
City Clerk James reported that two letters of protest
were received for the area 000 through 300 West Lebow Avenue:
(1) Attorney Robert s. Treece representing Al J. Schechter; and
(2) Burtkin Associates signed by Harry L. Arkin, which they
have requested be removed from the record.
Attorney Robert s. Treece, 1340 Denver Club Building,
Denver, was present representing Al J. Schechter in protest of
P.O. 22. He protested the charge of $2,007.35 made against
Mr. Schechter for damages caused by persons unknown during
the time of construction. He requested that this charge be
removed. Mr. Treece also stated that improper public notice
was given because publication in the Englewood Herald Sentinel
does not reach persons outside the immediate area.
Irving Mock, 2285 West Iliff Avenue, asked if the
assessments take in the survey or just the paving. Director
of Public Works Waggoner explained that it is for the con-
struction of the paving district.
City Clerk James reported that two letters of protest
were received for the area 2000 through 2300 West Vassar Avenue:
(1) Lillie Morris, 2179 West Vassar; and (2) Mr. and Mrs. Edward
L. Gates, 2079 West Vassar.
Edward Gates, 2079 West Vassar, was present to protest
the charge for his driveway, which was torn up and put back in.

Lilly Morris, 2179 West Vassar, was present to protest
the charge for her driveway. She stated that her driveway was
torn up and now she is being charged to have it put back in.
Paul Barcelona, 2159 West Vassar, was present to
protest the charge for his driveway, which was taken out and
replaced.
Roy Richards, 2189 West Vassar, was present to protest
his driveway assessment.
Director of Public Works Waggoner explained that the
majority of these driveways had to be taken out because they
could not get the street high enough to match the driveways.
City Clerk James reported that one letter of protest
was received for the area 1600 to 1700 West Harvard Avenue:
Rita and Warren Reeves, 1741 West Harvard Avenue.
Warren Reeves, 4460 West Lakeridge Road, was present
and stated that he is not in disagreement with the improvements
but rather with the discount for pay off. He stated that a five
percent discount for making a cash payment is not enough to
inspire someone to make a pay off.
City Clerk James reported that one letter of protest
was received for the area 2200 South Raritan Street: John C.
Underhill, 1801 West Iliff.

Mr. Underhill stated that he is not making a protest against
the paving district. He reported that the new laid curb and
gutter at the 2200 block on South Raritan has cracks near the
expansion joints, and he requested that an engineer check on
it.
George Gorham, 1770 West Baltic Place, was present
to protest the assessment for his property in the 2200 block
of South Raritan. He stated that this area has been excluded
in the past for repair, maintenance and upgrading. Mr. Gorham
stated this is a convenience that he cannot afford.
City Clerk James reported that two letters of protest
were received for the area 4600 South Bannock Street: (1) Mrs.
L. R. Wolfe on behalf of Mrs. Joe Bobbitt, 4691 South Bannock;
(2) Werner D. Schnackenberg, 4601 South Bannock.
Lloyd Wolfe, 6795 South Logan, Littleton, was present
on behalf of Mrs. Joe Bobbitt, 4691 South Bannock. He stated
that Mrs. Bobbitt is 84 years of age and has no means of support
other than social security and that this is something she cannot
afford.

Werner D. Schnackenberg, 4601 South Bannock, was
present and expressed his appreciation for the sidewalks and
the good workmanship. He stated his protest to the assess-
ments regarding wider than normal residential streets. He
stated that the normal residential street is 32 feet wide,
and that the City should pay for the extra width of paving
over 32 feet.
City Clerk James reported that one letter of protest
was received for the area 4600 South Pearl Street: Roy
Rosenberger, 1101 Avenue G, Scottsbluff, Nebraska.
Irving Mock, 2285 West Iliff Avenue, stated that
his street was to be raised eight inches but was actually
raised one foot from what it was. Director of Public Works
Waggoner stated this would be checked out.
Roger M. Tapia, 1121 South Perry, was present to
protest the assessment for 1785 West Iliff. He stated that
this is a side street assessment, and he feels some of the
assessments are out of balance.

the vote resulted as follows:
Ayes: Council Members Williams, Sovern, Smith, Brown,
Mann, Clayton, Taylor.
Nays: None.
The Mayor declared the motion carried.
Assistant City Manager Nollenberger stated that each
of the protests have been recorded and a report will be received
at the April 5 City Council meeting regarding each protest.
Council will act on each of the protests at that time, and if
there are any amendments the Bill for an Ordinance will be
amended with revised dollar amounts. Final passage will be
at the City Council meeting on April 19 with the effective
date of May 21.

the roll, the vote resulted as follows:

The Mayor declared the motion carried, and the City
Council meeting was adjourned at 8:35 p.m.
