HomeMy WebLinkAbout1976-08-23 (Special) Meeting MinutesSPECIAL MEETING: COUNCIL CHAMBERS CITY OP ENGLEWOD, COLORADO August 23, 1976 The City Council of the City of Englewood, Arapahoe County, Colorado, met in special session on Auguat 23, 1976 at 7:30 p.m. Mayor Taylor, preaiding, called the meeting to order. The invocation was given by Councilman Brown. The Pledge of Allegiance was led by Mayor Taylor. Mayor Taylor asked for roll call. Upon the call of the roll, the following were present: Council Meabera Willi&ll8, Sovern, Smith, Brown, Mann, Clayton, and Mayor Taylor. Absent: None. The Mayor declared a quorua present. Also present were: City Manager McCown Aast. City Manager Nollenberger Asst. City Attorney DeWitt Acting Director of Community Development Romans Deputy City Clerk Varner * * * * * * COUNCILMAN SOVERN K>VED TO OPEN A PUBLIC HEARING TO CONSIDER AN ORDINANCE ZONING A NEWLY ANNEXED PARCEL OF LAND TO '111E CITY OF ENGLEWOOD FROM AN UNZONED CLASSIFICATION TO I-1, LIGHT INDUSTRIAL DISTRICT. Councilman Williams seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Council Melllbers Williams, Sovern, Smith, Brown, Mann, Clayton, Taylor. Nays: None. The Mayor declared the motion carried. City Manager Mccown stated that the purpose of this public hearing is to consider the I-1, light induatrial district, for a newly annexed parcel of land to the City of Englewood. Acting Director of C01111Unity Development Romans stated that the area under consideration i• a 3.99 acre parcel of land on the southeast corner of West Stanford and South Windermere. She noted that the public hearing notice appeared in the Englewood Herald Sentinel on August 4, 1976; and that the property was posted from Auguat 6 to August 23, 1976. She presented a "Certification of Poating" to the Clerk for the record. August 23, 1976 Page 2 Ms. Romans atated that this property was zoned I-2 in the County, and she reviewed the uaea permitted in that zone district. She stated that the area to the north in the City is zoned 1-1, the unincorporated land to the south is zoned 1-2, the land to the east in the county is zoned R-3, and the railroad tracks are to the weat. She reviewed the permitted and restricted uses in the City's 1-1 zone diatrict. Ha. Romana stated that the Planning and Zoning Commission has reco ... nded that the property be zoned I-1, and she discussed the Findings of Fact on this case. She also noted that provisions have been made as part of the annexation agreement for the street right-of-ways for the south side of West Stanford and the east side of South Windermere. Mayor Taylor asked if there was anyone in the audience that wished to speak in favor of this zoning. Jacqueline Tucker, 6602 South Columbine, Arapahoe County, appeared to speak in favor of the proposed paper recycling facility for this property. Mayor Taylor explained that the purpose of this hearing is to consider the zoning of the property and not any specific use. Harvey Deutsch, Attorney representing the owners of the subject property, was present to speak in favor of the I-1 zone because it follows the City's Master Plan. He stated they are aware of the City's restrictions which they will comply with. Mayor Taylor asked if there was anyone in the audience that wished to speak against this zoning. Norman Ferland, 4590 South Lipan, was present to speak against the I-1 zone because of its possible effect on the people in the area. Glenn Helf er, 4501 South Lipan Court, was present to speak against the 1-1 zone because there are other possible zone districts which were not considered for this area. He requested that a further study be made of other possible alternatives to the I-1 zone. Hr. Helfer presented a petition of approximately thirty names expressing opposition to the proposed paper recycling facility plant to be built on this property. City Council did not accept the petition because it referred to a specific use and not the 1-1 zone. Norman Ferland, 4590 South Lipan, stated that the property was not posted in a conspicuous place; and that the people in the neighborhood were unaware of the proposed zoning until a few days prior to this meeting. COUNCILMAN SMITH K>VED 'l'O CLOSE THE PUBLIC HEARING. Councilman Hann seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton, Taylor. Nays: None. The Mayor declared the motion carried. August 23, 1976 Page 3 COUNCILMAN MANN IC>VED TO POSTPONE ACTION ON nus MATTER UNTIL THE CITY COUNCIL MEETING ON SEPTEMBER 7, 1976. Councilman Williams seconded the motion. Councilman Smith stated that the high-density residential district and the heavy industrial di•trict would both be detrimental to the neighbor- hood. He also noted that the proposed use of the property will have to be constructed according to the City's fire and building codes. Councilman Williama stated that the people should be given a chance to be heard further on this matter. Harvey Deutsch, Attorney, stated that when the property was annexed they were advised that the area would be zoned expeditiously because of co111Dittmenta they have made. He stated that the 1-1 zone for this area is in accordance with the City's Maater Plan. He also noted that the area was properly posted and that there were newspaper publications advising the citizens of this zoning. Glenn Helfer, 4501 South Lipan Court, stated that the citizens need additional time to inveatigate possible alternatives to the I-1 zone. Councilman Smith pointed out that the Planning and Zoning Conmission would have recomaended any feasible alternatives to City Council. Upon a call of the roll, the vote resulted as follows: Ayes: Council Mellbers Williams, Mann. Nays: Council Meabere Sovern, Smith, Brown, Clayton, Taylor. The Mayor declared the motion defeated. INTRODUCED AS A BILL BY COUNCILMAN MANN BY AUTHORITY ORDINANCE NO. 42 SERIES OF 1976 AN ORDINANCE ZONING A NEWLY ANNEXED PARCEL OF LAND TO THE CITY OF ENGLEWOOD, ARAPAHOE OOUNTY, STATE OF OOLORADO, FROM AN UNZONED CLASSIFICATION TO I-1, LIGHT INDUSTRIAL DISTRICT. COUNCILMAN MANN K>VED TO PASS ORDINANCE NO. 42, SERIES OF 1976, ON FINAL READING. Councilman Smith seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton, Taylor. August 23, 1976 Page 4 Nays: None.
