HomeMy WebLinkAbout1976-11-08 (Special) Meeting MinutesSPECIAL MEETING: COUNCIL CHAMBERS CITY OF ENGLEWOOD, COLORADO November 8, 1976 The City Council of the City of Englewood, Arapahoe County, Colorado, met in special session on November 8, 1976 at 7:00 p.m. Mayor Protem Clayton, presiding, called the meeting to order. The invocation was given by Councilman Smith. The Pledge of Allegiance was led by Councilman Brown. Mayor Protem Clayton asked for roll call. Upon the call of the roll, the following were present: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton. Absent: Mayor Taylor. The Mayor Protem declared a quorum present. Also present were: City Manager McCown Asst. City Manager Nollenberger City Attorney Berardini Dir. of Finance/City Clerk James Deputy City Clerk Varner • • • • • • COUNCILMAN WILLIAMS MOVED TO OPEN A PUBLIC HEARING TO CONSIDER AN APPLICATION FOR A SPECIAL EVENTS LIQUOR LICENSE FOR SAINT LOUIS CATHOLIC CHURCH/P.T.A. AT 3301 SOUTH SHERMAN AND 3310 SOUTH LINCOLN, ON NOVEMBER 14, 1976 FROM 12:00 NOON TO 8:00 P.M. Councilman Brown seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Colmcil Members Williams, Sovern, Smith, Brown, Mann, Clayton. Nays: None. Absent: Mayor Taylor. The Mayor Protem declared the motion carried. City Clerk James noted that his office has received no written protests to this special events license. Carole Maschka, 4152 West Greenwood Place, Denver, Chairman of the Saint Louis Parisb/P.T.A. 27th Annual Jamboree, was present. She explained that beer will be served during the football game in a room set aside for the adults, and wine will be served with the spaghetti dinners. She also stated that this jamboree is the only fund-raising event sponsored by the Parish and is the only source of income for the P.T.A. November 8, 1976 Page 2 Ms. Maschka presented to City Council a picture showing the posting of the public hearing notice on the premises, as well as a copy of the bylaws. Chalmerse Parker, 3996 South Grant, stated he is in favor of this license because it is for a fund raising event that is held only once a yea:r. In response to M~or Protem Clayton, three additional persons stood to express their support of the issuance of this license. M. M. Summers, 3140 South Delaware, stated he is oppos·ed to this license because there are enough liquor establishments in this neighborhood to supply the needs, and because there has been no evidence presented by the applicants to show the needs or desires of the inhabitants. Ms. Maschka noted that question #7 on the application should be corrected to read "yes" because the Saint Louis Catholic Church/P.T.A. is a religious or philanthropic institution. Tom Fitzpatrick, 3155 South Acoma, explained that the Saint Louis Church/P.T.A. works in conjunction with the state P.T.A. but is not affiliated with the national P.T.A. He also stated that liquor will not be served at the Jamboree, but that wine will be served with the spaghetti dinners and beer will be served during the football game only. AT 3301 SOUTH SHERMAN AND 3310 SOUTH LINCOLN ON NOVEMBER 14, 1976 FROM 12:00 NOON 'ro 8:00 P.M. Councilman Mann seconded the motion. Councilman Smith stated that Article 12-48-102 of the state Liquor Code requires that they must be an incorporated organization to be granted this license. City Attorney Berardini responded that, in his opinion, this section of the code does not require them to be incorporated because of other provisions also included in this section. The Mayor Protem declared the motion carried. • • • • • • COUNCILMAN MANN M>VED 'ro OPEN A PUBLIC HEARING 'ro CONSIDER AN APPL I CATI ON FOR A SPECIAL EVENTS 3.2 BEER LICENSE FOR ENGLEWOOD LIONS CLUB TO BE HELD AT THE ENGLEWOOD SHRINE CLUB, 3299 SOUTH LOGAN, ON NOVEMBER 19, 1976 FROM NOON 'ro MIDNIGHT. Councilman Williams seconded the DX>tion. Upon a call of the roll, the vote resulted as follows: Ayes: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton. Nays: None. Absent: Mayor Taylor. The Mayor Protem declared the motion carried. City Clerk James noted that his office has received no written protests t o this special events license. Roy Lininger, 5 Sunset Lane, Littleton, Chairman of the Ways and Means Committee of the Englewood Lions Club, was present. He stated that the Lions Club plans to hold a raffle and "Las Vegas Night" where they wish to serve 3.2 beer. Mr. Lininger noted that this application has been approved by the club members and the Lions Club Board. M. M. Summers, 3140 South Delaware, stated he is opposed to this l icense because the applicants have not provided evidence showing the needs of the neighborhood or the desires of the inhabitants. He also stated that there are enough liquor establishments in this neighborhood to supply the needs. Councilman Smith stated that one of the grounds for issuing a special events license is that no other suitable place that already has a license could be found. Mr. Lininger responded that this was invest.igated by the committee and that they decided there was no other appropriate place available to hold this event. Virgil Thomas, 3810 South Lincoln, Secretary of the Englewood Lions Cl ub Board, stated that the Board passed a motion instructing the Ways and Means Committee to proceed with the raffle and "Las Vegas Night" as a fund raising event, including the application for the special events 3.2 beer license. Discussion followed regarding statute requirements for issuing special events liquor licenses. COUNCILMAN WILLIAM:> MOVED 'ro CLOSE THE PUBLIC HEARING. Councilman Mann seconded the motion. The Mayor Protem declared a quorum present. • • • • • • A public hearing was opened to consider an application for a 3.2 beer license, consumption on the premises, for Encore, Incorporated, d/b/a The South Door, 5470 South Broadway. Attorney Martin Miller appeared representing the applicant. Attorney Richard Landrum appeared representing The John, 90 West Belleview Avenue, formerly Leaning Tower of Pizza, in opposition to the issuance of this license. Testinx>ny and evidence was received both for and against this application. The public hearing was closed, and City Attorney Berardini noted that City Council has thirty days in which to make their decision. A complete transcript of this public hearing is being prepared and will be on file in the City Clerk's office. • • • • • • November 8, 1976 Page 5 COUNCILMAN MANN K>VED THAT CITY COUNCIL MAKE ITS OFFICIAL STAND CONCERNING I-470 ACCORDING 'ro THE LETTER DATED NOVEMBER 5, 1976 'ro THE AD HOC COloHISSION AND SIGRED BY MAYOR TAYLOR UNTIL COUNCIL DERIVES AN OPINION ON THE VARIOUS ALTERNATIVES. Councilman Williams seconded the motion. This letter requests that the Ad Hoc Commission delay making their decision on I-470 for one month in order that City Council may continue its collective evaluation of the alternatives which have been presented. A copy of this letter is on file and available in the City Clerk's office. Upon a call of the roll, the vote resulted as follows: Ayes: Council Members Williams, Sovern, Smith, Brown, Mann, Clayton.
