The City Council of the City of Engl~. Arapahoe County, Colorado, met in
regular session on Janaury 2, 1973 at 8 :02 P.M.
Mayor Senti, presiding, called the neeting to order.
The invocation was given by Rev. Richard Masai, of the Engl~ Wesleyan
Oturch, and the Pledge of Allegiance was led by the Engl~ettes 4-H Group.
The Mayor asked for roll call. Upon the call of the roll, the following were
present:
Council Merbers Brown, Blessing, Schwab, Henning, rhority, Senti.
Absent: Ncne.
The Mayor declared a quorun present.

The newly elected Councilman, Werner D. Sctmackenberg, was sworn in by the
Honorable Marvin W. Foote, Judge of the 18th Judicial District. Councilman Sctmackenberg
signed the Pledge of Office to fina lize the action.

Mr. Harold Rust, Ehgl~ District Manager for Public Service Conpany of
(;olorado, was present to present a f ranchise check for $40 ,500 for the 4th quarter of 1972
to the City . Mayor Senti thanked Mr. Rust.

Council received a letter from the recording secretary for the Board of Career
Service regarding the positiai of Battalion Olief in the Fire Department. City Manager Dial
described the duties of the position of Battalion Chief. He stated that there are currently
tour Captains in the department, of which ~ are staff and ~ are supervisory. The new
Battalion Chief position will replace the ~ supervisory positions, in addition to adding
one additi.cnal supervisory position to accomoodate the new three-shift setup in the Fire
Department.
Councilman Schwab inquired as to the difference in duties between the Battalion
thief and the current supervisory captains. City Manager Dial stated that they were essential-
lv the sane.

Council received a letter from the recording secretary for the Board of Career
!:>ervice c.onmissioners regarding the position of Associate Planner in the Department of
Coommity Developnent. City Manager Dial stated that the addition of this positon would give
the Director ot the department mre tUre to \IJOrk with the Steering Coumittee and the Plarming
and Zoning Comni.tt~~.
Councilman Schwab inquired whether the City currently has an Assistant Director
within the Department. City Manager Dial replied in the affinnative, stating that there TNere
three Assistant Directors there.

Council received a letter fran the Chairman of the Board of Career Service
(;amrlssicners to the Council regarding coopensaticn for the positicn of Deputy Fire Olief,
Assistant Police Chief, and City Engineer.
City Manager Dial stated that the letters of understanding regarding these
positions were reached last year. The Assistant Olief of Police and the Deputy Fire Chief
were apporticned no increases in that letter of understanding. The next ranking persamel
received little increase. The eftort was to make the difference in pay bebileen the directors
of the departments salary and their assistants a little wider spread. In the letter of
understanding with the Enployees Associaticn everybody under Grade 30 was given a raise.
The City Engineer was at level 31, and consa[Uently could not receive one. A change in
the level of pay for these positions at this time \lllOUld subvert the negotiaticn process
in his opinicn. A descripticn of the current pay plan utilized by the City was given to
Council.
Coulcilwoman Henning inquired whether a perscn in the future could represent
hiJmelf before the Board of Career Service under the new Cllarter Amencinent. City Manager
Dial stated that ooly if the lD1i.t was set up by career Service.

Council began discussioo oo a Bill for an Ordinance instituting a system of
charges for sewer inspectioos for main line constructioo and for taps, and a change in serwage
disposal charges for apartment dwellings.
City Attorney Berardini stated that the Water and Serwer Board had approved the
requested change and that it ~d result in an increase in rates for nulti-dwelling units.

until the next TIECting for clarificatioos.

City Attorney Berardini reported to the Council on actioo ccnceming the
exclusioo o f the area just sooth of Belleview and West of Broadway, including the K-Mart
area, t ran a fire protectia1 district, since it was already inside the City of Engl~.
He stated that as requested by Council, he had petitiooed the Court and the district had
been eliminated fran the fire protectioo district.

City Attorney Berardini reported to Council on the Weiss assessment case. He
stated that the judge just recently had held against the City and would void the assessment
of $1 ,900 cleared against Mrs. Weiss.
The City Attorney felt that the City should appeal the decision and -would write
a report to <.:ouncil in the near future. He also stated that he lr.IO\ll.d write a report to Council
or their perusal in February ccnccming all outstanding lawsuits and status of other City
Attorney matters.

Council began coosideration of a resolutioo expressing support for the newly
established Regional Suburban Police Associatioo. City Manager Dial stated that a voluntary
associatioo w:>uld be helpful to the suburban towns. Various departments within the area had
specialized in certain areas, of which they ~uld be able to help a neighboring department
in order to spread the benefits of their knowledge around.
Council~ Herming inquired whether this action lr.IO\ll.d preclude the police
:unctioo from being one of those included in a regional service authority. City Manager
Dial replied in the negative.
Council~ Herming inquired whether there lr.IO\ll.d be a financial side of this
associatioo in the future which ~uld request nrney from the cities. City Manager Dial stated
that that was possible as a specializatioo in this area is developed. Additionally, this
associaticn DBY try f or Federal aid, as opposed to Denver receiving all of it.
Councilwoman Henning inquired whether this was an effort to put pressure on
Denver to be IIDre cex>perative with the suburban towns. City Manager Dial stated that they
had been cex>perative in the past, and he did not see this as an out and out effort to do that.
Councilman Schnackenberg inquired as to the feelings of the Police Cllief on this
matter . City Manager Dial stated that he was very strongly in favor of it.

Council began consideration of a recoomendatial that the Director of Libraries
be pennitted to attend the amrual conference of the American Library Association in Washington
D.C. fran January 28th to the 31st. City Manager Dial stated that the trip was budgeted and
"WOUld cost approximately $450. Councilman Brown stated that the Director of Libraries was a
credit to the City and shculd be allowed to attend this seminar.

City Manager Dial stated that he ~d report to Council on the status of the
year-end finances and a report of the year's activities. He also stated that a new Assistant
City Manager had been selected, and his name was Andy McCown.
He reminded the Council of a study sessial al January 8th at 7:30 P.M.

1\uning to the storm drainage program, he stated that Director of Public Works
Kells Waggener had gotten a read back from the Federal Department of Housing and Urban
DeveloIJDeOt and that they were very negative al the future appropriatialS to the City of
Englerwood al storm drainage. He handed out to the Co~il a list of the alternative actions
which the Council could take for their calSidcration in the future.

Councilman Schwab inquired as to the current status of the sign code ordinance.
City Manager Dial stated that a comnittee had had a rooeting on it, but that he was not sure
o f the target schedlle at this tiroo.

Councilman Schwab inquired into the status of the annexation by the river.
City Attorne y Berardini replied that he w:>uld be w:>rking on it in the future. City Manager
Dial stated that he w:>uld be cooperating with the City Attorney in that effort.

Councilman Schwab inquired as to the action at the last Planning and Zoning
meeting. Councilwomm Henning stated that Larwill had stated that they would not change any
fu ture p lans f or the area.
Councilman Blessing stated his concerns for s~ sort of plan to help the elder-
ly in Eng l~. C'i.ty Manager Dial stated that the actninistration ~ld work up a report to
<.;ouncil on v arious methods to do so.

City Attorney Berardini stated that the level of activity in the City Attorney's
office was at a high point, and as a result he wuld need to hire sane special counsel over the
next several llDllths to accouplish the projects which he has in-house. He stated that he ~ld
r e port back to Council in a written narrative in the near future.
