Mayor Senti, presiding, called the meeting to order. The invocatioo was given by Dr. Rubin Wiemer of the Seventh Day Adventist Church, and the Pledge of Allegiance was led by the Englewoodettes 4-H Group. present: Mayor Senti asked for roll call. Pearl Street, Precinct No. 5 Mr. & Mrs. Burt J. Hall, 3039 East Cornell Circle, Precinct No. 6. Mrs. Leonard G. Newblom, 4451 So. Elati St., Precinct No. 14. * * * * * Mr. Dale E. Clawscn, 3990 So. Inca Street, President of the Police Benefit Association, appeared before Council representing the enployees association to discuss the Ordinance inl:>lementing the Charter Amenctnent regarding enployee relations. 555 556 -'/.- He stated that he felt that it 'WOUld be difficult for the Persamel Director to be unbiased if he is not under the Board of Career Service as requested by the E!!Tployees. Officer Leyden of the Englewood Police Department also appeared before Council in regard to this question. He stated that mmy of the people in the room tarl.ght were ~ ployees of the City. 1he people of F.nglewood, by passing the Charter Amencbent, have asked for a fair and inpartial Board of Career Service. 1he City Council of the City of Fnglewood has a staff tnelli>er to gather facts to bring to their attention; a simi.lar situation should exist between the Board of Career Service and the Persamel Director. hlycne controlled by one individual always has the fear over his head of being fired. Other cities in the metro area do not have an equivalent Board of Career Service as passed by the People last Novenber in F.nglewood, so their positicn of Persamel Director would not be conparable. Officer Leyden suggested that perhaps a referendun to the people could answer the question of where the Persamel Director should report. Councilman Brown stated that the Colmcil is trying to do what is right by the enployees, noting that the City soon would approve salary increases of fairly great DBgnitude and questicned why the E!!Tployees were still uri'lappy. Officer Leyden stated that the E!!Tployees feel that the main arm of the Board .is controlled by the City Manager and that was unfair. Cculcilman Brown inquired whether the E!!Tployees had faith in the Persamel Director as a position. Officer Leyden replied in the affirmative. Cculcilman Schlackenberg stated that he felt that the new Board set up was as neutral as could be possible. 'lbe Board can veto the City Manager without Council ap- proval. 1he City carllOt dictate its terrrlJ to the E!!Tployees in the event of an i.npasse. 'lbe Persoonel Director, while providing service to the Board, does not have control over the Board as to their decision-making power. He felt that the E!!Tployees should live with the Persamel Director reporting to the City Manager for a period of time of at least a year in order to try the system. Mayor Senti also stated his desire to see the system this way for at least a year, after which the Council would look at it again. Coulcilman Sclwab stated that he objected to Mr. Braun, current Cll8irrmn of the Board of Career Service, speaking before Council without being on the agenda. May 1Jr Senti recognized Mr. Braun to speak. Mr. Braun stated that the Persamel Director used to report to the Board of Career Service. 'lbe Board needed to have the confidence of the Persamel Director in order to act en persoonel UBtters. He felt that the system had worked extremely well previous to the change and that it would work again in that way. Ciol.ncilman Sclwab iJxluired as to who the Persamel Director reported to in the past, as far as supervision of his work went. Mr. Braun replied that he reported to the integrity of hinBelf. Councilman Sct.iab stated that it had not worked in the past and would not work row. City Manager Dial stated that he felt pride in the City of F.nglewood in the way in which the fuoctions are performed. He also felt that the progress in programs and benefits to the enployees of the City was extremely great over the last few years. 'lbe problem had been addressed by the City Manager and the Persamel Director separate from the Board of Career Service. 1he roles of the E!!Tployee organizations have grown greatly in the last three years, with the organizations DDre apt to hire attorneys to represent them. I I I I I I I I -3- Judge Haydn Swearingen of the Englewood Mlmi.cipal Court was present for the swearing in of the nerbers of the Housing Authority and of the Urban Renewal Authority. 'nte indivicbals involved took the oath of office from Judge Swearingen. * * * * * Mr. Ray Koemig, 7 Meadowbrook Circle, Littletoo, Colorado, was present representing the Comruni.ty Arts Syt11>hcny to request financial assistance from the City Council for the year 1973. He stated that the program operated on a $20 per season per fani.ly fee, al.mg with contributions from various entities in the area. The budget for 1972 was $15,000. He requested c.ouncil's support as they had in the past in order to preserve this fine arts tradition. * * * * * Mr. M. M. Sumlers, 3140 South Delaware Street, was present to discuss the need for a swinmi.ng pool in Dartmouth Park, and City acquisitioo of land outside the City limits. He presented a petition to r.omcil bearing 10 signatures supporting a swinmi.ng pool in Dartmouth Park. He felt that the City should not be purchasing land in Sheridan for golf courses when the need for recreation in the form of a swimning pool in Dartmouth Park was acute. Mrs. c.aufman, 3057 So. Delaware, also appeared before Council in relation to this natter, stating that the area needed sanething which everycne could benefit from while only 61. of the Englewood residents play golf, a swinmi.ng pool would appeal to may Dl)['e indi vicbals. Mr. Sumlers then introduced three boys who also requested a swimning pool fran the Colmcil. * * * * * Mr. George Allen, 2799 So. Downing Street, appeared before Council on be- half of the Engla.ood Cllarber of Conmerce regarding a proposed postal conplex. He stated that the Oumi:>er of Conmerce has launched a program of core area developnent and currently had a plan to get a new postal facility. He stated that the Cllanber needed $500 to get a site layout plan ready to subni.t to the Corps of Engineers, who are responsible for the construction of new postal facilities. He felt that the new postal facilities would strike a blow for the redevelopnent of the downtown area. He also stated that the Oumber of Counerce wanted sane inplt into the Core Area Study which was being considered by the City Coulcil. nie new postal facility, however, was needed now, and if it were to be included in the study and postpooed for that reasoo, it would be many years away. r.otmcilman Sclwab stated that a study needed to be flexible in order for the cmsultant to have a free hand in the plaming of the developnent of the City. * * * * * Mr. Ted Kalstan, architect on the Englewood Fire Station to be constructed near West Oxford and Federal, was present with plans to present to the City Council. He stated that the plans for the new station reflected the program as de- signed to him by City Manager Dial and Fire Orl.ef Hami.lt:cn. He stated that the location was adjacent to the City Hall of Sheri.d.m and the new site would provide sane parking for their current City Hall. Additionally, a camunity room would be included in the fire station for citizens' use. He gave a general rundown of the details of the new fire station for Colmcil' s infornation. r.otmcilman Brown fnluired as to how the cost conpared to the budgeted one. City Hanger Dial stated that the cost was currently right on the mark as per the 1972 estimate. Additionally, we nay receive enough m:ney from the sale of a strip of land to Sheridan to pay for finishing off the cormunity roan in the fire station. Colmcilman Blessing inquired as to W'hat the goal Wa3 for the eotll>letion tine of the project. The Fire Chief stated that they hoped to have it finished by Novarber. * * * * * Mr. Gary Copp and Mr. Steven Zi.nmerman, Attorney, were present before Council to request the transfer of a beer, wine, aid spirituous liquor license for Casual Lounge, 65 West Floyd Avenue. Mr. Zi.nmerman stated that Mr. Copp was going to own the building, but not the real estate upcn which it was situated. He has been in the liquor business through- out his whole life and ~ld be up t o the standards of the City of Englewood in his mmaganent of a liquor facility. 557 558 Hr. Schnackenberg i.nJuired as to what experience Mr. C.Opp had. Mr. C.Opp stated that he had never be.fore owned a bar, but that he had ~ked in a m.tti>er of them as an E!fll>loyee. City Attorney Berardini i.nJuired as to what lease was in effect at the establishnent. Hr. Broadway, F.nglewood. Mr. Malone stated that the establishnent had been operated by Mr. D. L. Hungate for 9 years. In Septeni>er, 1972, the establishnent was sold to Mr. Noman Veaanan, who was subsequently confined to the hospital and forced to abandon the business. Under a term of the sale, repossession of the business has occurred. Ulrrently, Mr. D. L. He stated that he had a desire to be a police officer in the City of Englewood in the Cadet Program, but was unable to do so due to the related person clause of the City's persamel management. He stated that, although the cost of recovering is a lot in COlll>Brisai to the total to be recovered, it has become a matter of principle in this case to recover the overpaid atnJnt. City Attorney Berardini stated that no recovery is possible short of action in court, and if the Council agreed, action ~d be started in County C.ourt. City Manager Dial stated that wells in sane areas are drying up of our surface flaw of water. Starting February 1st, well users along the Platte can punp mly four out of seven days. Some irrigators have begmt to form an associatim such as this one which are buying up sane surface flaw rights which will allow them to punp six out of seven days a week. '!here were no objectioos from the neighborhood, but the Couicil can hold a public hearing al the DBtter if they SO desire. Col.Ecilman Blessing inquired as to how large the developnent 'WOUld be. Mr Supinger replied that it was 4.35 acres. Mr. Mike Kepler, 311 Detroit Street, appeared before Council and described the developnent to them. Mr. Berardini pointed out that Sectioo 5-2-7 sets out the Persamel Director reporting to the City Manager. This sectioo as it is currently written is identical to the way the procedure is now set up. Councilman Brown stated that he was concemed that the enployees are unhappy with the way the ordinance i s written. He stated that there was a lot of turnover in per- samel directors in other cities and he felt that perhaps this was the problem. Councilman Schwab stated that the City Manager camot operate with a free hand if he has to get the Board's approval for items of this nature. Councilman Dhority stated that he felt the grievances were taken care of and that the Board is an extremely inl>artial one. ·56~l 564 -10- City Manager Dial stated that the Council could mdify it by altemate methods, one being making the Persoonel Director totally subordinate to the Board of career Service. He requested the r.ouncil not to make a half and half conpranise. 'lbe other alternative would be to make the Persamel Director a division head in the City, who would then have Board of Career Service safeguards for his position. He stated an individual had requested a railroad crossing spur which would cross Dart:rrnlth Avenue. After review by the staff over the next couple of weeks, the plan would be suhni.tted to Council. * * * * * 'lbe City Manager deferred the report of the current status of possible CATI service to the following ?-bnday night discussion meeting. * * * * * 'lbe City Manager presented a report regarding status of enployee wage surveys to the Cowcil. He stated that the cost was substantial, but not all had been conpleted yet. * * * * * '!he City Manager requested Council concurrence in the Manager's acceptance of an appointment to an ICMA Task Force on Hunan Resources Developnent.
