REGULAR MEETING:
The City Council of the City of Englewood, Arapahoe County, Colorado met in
regular session on March 19, 1973, at 8:00 p.m.
Mayor Senti, presiding, called the meeting to order.
The invocation was given by the Reverend Helen Walker of the Esoteric Truth
Center. Pledge of Allegiance was led by Englewoodettes 4-H Group.

COUNCILMAN SCHWAB MOVED AND COUNCILWOMAN HENNING SECONDED A MOTION TO OPEN A
PUBLIC HEARING TO CONSIDER A BILL FOR AN ORDINANCE REGARDING COMPENSATION OF PLANNING AND
ZONING COMMISSION AND BOARD OF ADJUSTMENT AND APPEALS MEMBERS. Upon the call of the roll,
the vote resulted as follows:

The Mayor declared the motion carried.
A City Clerk read the Bill for an Ordinance. Councilman Schwab stated that a
sub-committee of the Council decided to pay the Planning and Zoning Conmission and Board of
Adjustment and Appeals since they were of a legal nature and made final decisions similar to
the Board of Career Service Conmissioners. Currently, the Board of Career Service Commissio
ers receives a stipend of $25.00 a month and the sub-committee's recommendation to raise
the other tw:> boards up to the same level. C.Ouncilman Ihority stated that the $25 .()() a 1JD1th
was no 11Dre than paying expenses of the nerbers.
c.ouncilwoman Henning inquired whether the City should pay by the meetings in-

Council received a netDrandun from the City Manager discussing supplemental
appropriations of Revenue Sharing funds and requesting that the date of April 16 be set for a
public hearing.
City Manager Dial stated that the Council had many recomnendations since the
f irst discussicn of Revenue Sharing. He had outlined in netD from the expenditures which he
fel t the Council might want to consider that the Revenue Sharing funds be used for.
Councilman Dhority stated that he felt a public hearing should be held for
citizens' input in these proposals. City Manager Dial concurred.
Councilman Schwab stated that the proposals included a $20,000 study which
"WOuld be used for cormunity attitudes. Councilman Dhority stated that he was not sold on the
s tudy idea at all, aid Mayor Senti stated that the City needed to get a cross-survey of all
the people and their opinions in order for the City Council to do their job effectively.
Councilman Blessing stated that he also felt Council needed a better input mechanism from
c i tizens in order to do their job. City Manager Dial stated that often times policy-making
bodies react to negative rather than the positive. He had seen studies of this nature in
t'WO other cities and felt that it could aid the Council in guiding the City.

Council began a discussion of the ratification of the agreement with the City
o f Greerttr.a>d Village relative to the extension of Clarkscn Street. Councilman Dhority stated
that he still objected to the five-year provision in the agreement but that apparently the
Ci ty felt this is the best that could be obtained at this time.

Mayor Senti inquired whether Greenwood Village had taken action on the proposal
at this time. City Manager Dial stated that it was on their agenda the same evening and the
Mayor of Greenwood Village seemed to feel that the Council wul.d accept it. Councilman Schwab
stated that he was not at all happy with the method used to get this agreement by holding sewer
service over their head. C.Ouncilman Dhority stated that it was too bad that the City Council
has to resort to sanething like this but the alternative was slim, and that the City should
not encourage the State to get this project acconplished. Councilman Sclmackenberg stated
that it was extremely regrettable for the Council to have to go through this procedure but
that there was no way out of it.

and med>ers of the Council had dedicated to this agreement.

<Dtmcil then began consideration of a meroorandun from the Chrlrman of the
Action Forces' Steering Conmittee recomnending that an $80,000 revolving fund be set up.
c.ouncilmm Dhority inquired as to the i.nportance thereof should be held off until a public
hearing scheduled for April 16th and that the City Council should probably just receive the
recoomendation this evening.

Council began discussion of an ordinance on final reading amending Section 3(a)
(Over time) W)rk of Chapter 7, Title V, of the '69 Englewood Municipal Code. Assistant City
Attorney George Lee stated that City Attorney Berardini was in GlerMX>d Springs on a water
hearing, but had asked the Assistant City Attorney to convey his feelings on this ordinance.
City Attorney Berardini did not feel the ordinance was in proper form as yet and requested that
the w:>rd ''week" in the ordinance be substituted by the word "day''. City Manager Dial stated
that the City Attorney's point was well taken and that the City achrlnistration had agreed to
a w:>rk-day basis with the enployees association and the police but not with the fire. 'lllis
staff needs to take the ordinance back to restudy and cone up with a new wording. Other cities
in the metro area pay on a day basis which was the origination of this problem.

Assistant City Attorney began a discussicn of a resoluticn dedicating the third
Saturday in June to be ~ as Englewood Placer Can¥> Day, beginning in June of 1973. Council-
man lh>ri.ty questicned the need for resoluticn in this case rather than just a proclamaticn.
c.ouncilman Blessing stated the Lien's Club will do all the ~k relating to the Placer Can¥>
Day Celebraticn and that it will be good for the esprit de corps of the citizens of Englewood.
Councilman Schnackenberg stated that he felt that the City of Englewood needed at lea.st one
day a year unique to their own purposes.

City Manager Dial began a discussion of a need for a possible change in the
zoning ordinance relative to ITDbile hanes. He stated there were problellB in the zoning for
storage of recreational vehicles. The City currently has an ordinance which needs substant-
ial review and revision. M>bile hanes in the city are by definition also recreational ve-
hicles. The ordinance provides that they camot be parked in the street right-of-way. Addi-
tionally, no one can use the driveway of their bane for storage of their vehicle. He stated
that the City staff would study the ordinance in the near future with the City Attorney's
advice.

City Manager Dial began a report regarding the status of IRS approval of pay
raises for nunicipal enployees in the metro area. He stated that the IRS definitions of
their standards are extremely vague. The City of Aurora was recently informed they were not
held very strictly accountable under Phase 3. Additionally, the City and County of Denver's
roll-back for police and fire salaries were very slight affecting us very little. The City
of Engl~ being under 1,000 enployees is oot even required to maintain records.

City Manager Dial began a discussion of a possible Council attendance at the
National League of Cities Annual c.onference to be held Decenber 2-6 in San Juan, Puerto Rico.
He stated that the conference is coming up the end of this year and the City staff needed to
know now whether any reservations should be nede. Councilman Blessing stated that he felt
any meni>er should go if they felt like they could get sa11ething out of it.
Mr. Joseph SllDlski from the audience stated that the trip was a luxury
item and that any DDley spent should be spent locally rather than in San Juan, Puerto Rico.
Mr. Gibsm from the audience stated that conpanies in the area seldom send their wrole en-
gineering department to a conference and questioned that the City Council should send their
entire menbership to San Juan, Puerto Rico. Council deferred any further discussion at that
time.

man Dhority said that he felt the City Council should show regard for a business conmmity
by accepting a menbership in the Cluri>er of c.omnerce. Councilman Blessing stated that he felt
the Council was being chintzy with the RDney and should accept the full $10,000 metbership.

Councilman Sclmackenberg stated current C.Ore Area study under way should
benefit business interests materially and be considered part of the City's contribution.
Council\¥001a[l Henning stated that only $12,000 had been budgeted in the
participation area of the C.Ouncil's budget and she felt the $3,000 was quite equitable for
the Cllad:>er of Comnerce.

City Manager Dial began a discussion on the i.q:>lementation of the citizens'
tree-planting program. He stated that last year was the first year for the tree-planting
progran at which the City sold trees for $8.00 per tree. There is $7 ,000 in the budget
this year for the project. Additionally in the past, the City has picked up tree linbs
which had been placed in the street during the spring. 'Ihe cost was approximately $9 ,000
last year. The Director of Public \.k>rlcs has suggested that we split the cost of not only
tree-linb pickup but also trinming and tree rem:>val with owner rather than just picking up
the branches. A general discussion of this idea enused. C.Ouncilman Schwab stated that he
did not object to a branch pickup program but could not agree with the City's getting in-
volved in an actual cutting-down of trees. Councilman Brown stated that he felt the C.Ouncil
should encourage the citizens' tree planting program vociferously. Councilman Dhority and
Sclnackenberg concurred. General consensus of the C.Ouncil was for only a tree-linb pickup
progran rather than a tree-reooval program at this time.

City Manager Dial stated that as a follow-up on the C.Ore Area Study Citizens'
developnent, the staff had taken the liberty of assigning certain persoos to C.Ouncil in an
attenpt to encourage them to attend the coming up meeting. He hoped that they TNOUld respood
positively.

City Manager Dial stated that the Police Cadet Program would need an amenchent
to an ordinance passed previously this evening, setting up salary and wage schedules. 'llle
salary range "WOuld be from $400-$475 depending upoo Wich year the program they were in.
Councilll&l Brown stated that he had a reservation of this program and questioned whether it
should not be under the Career Service Conmission. City Manager Dial stated that this ordi-
nance "WOuld make it go through the Career Service.
Councilman Brown inquired whether the respcnsibilities given to the cadets
were clear and concise. City Manager Dial stated that the cadets would ~k an average of
40 hours a week and will not carry any weapoos. 'llle respcnsibilities will be tmdest but
increasing during their three-year cadetship. 'llle City will give them a limited power of
arrest.

City Manager Dial reported that the City anticipated a donation of four and a
half acres of land for Floyd Park and that the City had p.it in a park grant application as a
result. 'lhe appraisal made by the government of the park land was $185 ,000 which they general-
ly match in order to determine a grant annmt for developnent.

City Manager Dial stated that one owner in South Fnglewood Storm Drainage Basin
whose heme ~uld eventually have to be purchased was in the position to sell the residence at
this time. City Manager ~d like to recorrmend p.irchase of that heme at this time.

City Manager Dial stated that he was requested attendance at a meeting of the
Kansas-Missouri City Managers' Association al ~ril 4-6th. He is currently en the Alumi

Councilman Henning inquired whether the City was ready to take as option on the
Public Service c.onpany land at this time. City Manager Dial stated that the City Attomey was
~rking al a final language of the draft but that it ~uld be probably be ready to present to
Council in approximately three \ttleeks.

City Manager Dial stated that the Poroography Ordinance was currently in court
and argunents have been presented on both sides.

Qruncil~ Herming stated that she felt an ordinance should be prepared to
defer special assessments for elderly individuals until after the time of their death. She
requested that the City Attorney draw up such an ordinance.

Councilman Blessing inquired into the status of the tax statement study for
elderly individJals of the City. City Manager Dial stated that it was currently under way
and ~d be finished in the near future.

The City Clerk reminded the C.Ouncil that they had not passed the ordinance dis-
cussed earlier in the evening at a public hearing.
