Mayor Senti, presiding, called the meeting to order. The invocation was given by Rev. J. Stanley Fixter of the Engl0NOO<l United Methodist Oturch, and the Pledge of Allegiance was led by Junior Girl Scout Troop No. 590. present: The Mayor asked for roll call. The Mayor declared the nntion carried. * * * * * * The Mayor recognized the following people from the list of Special Citizen Progran Invitees: Mr. and Mrs. Keith Dryden, 3853 So. Sherman Street, Precinct No. 3. Mr. Dryden stated that he appreciated the invitation by the C.Otmcil, and felt the c.ouncil had done a good job of representing the City's interests in the past. Mr. and Mrs. Forrest L. Thorpe, 4598 So. Logan Street, Precinct No. 16. Mr. Eddie Tanguna, 1020 West Tufts Ave., Precinct No. 12. * * * * * * Mr. M. M. S\.111Tlers, 3140 So. Delaware Street, was present to discuss several iterM of concern. Mr. S\.111Tlers stated that he was concerned that the City of Engl~ does not <Ml a single building which was all paid for, for general nunicipal uses. He felt that the City needed an auditorillll within its confines. Additiooally, ootels will be needed in order to neke the City a nnre useful one for convention purposes. 'Ihe City needs a Library building separate from City Hall in order to facili- tate yolilger children being able to utilize the library. '!he City of Engl~ currently has 40 saloons within the City limits and only 39 drurches. He felt that it was time to limit the nlJTlber of saloons in the City. Additicnal- ly, the City has over 5 ,000 dogs which he felt nust be a record for the metropolitan area. Mr. SU11T1ers indicated his concern that the City was building a fire station in Sheridan, and also a golf course there. Mr. SU11T1ers stated that he was not happy with the idea of rooving 23 residents fran the City of Engl~ in order to establish a storm drainage plan. Additionally, he voiced concern over the $155,000 Core Area Study which the Council had conmissioned, indicating that he felt that the firm nust keep their feet on the ground. * * * * * Mrs. Beverly David appeared before Council stating that she had serious qualms about the encroaclment of aparanent living in the City of Engl~. She felt the apartment living was bringing transient people to a previously stable environment. Mayor Senti thanked both Mr. S\Dlllers and Mrs. David for their discussion. * * * * * Mr. Virgil Thcmis, 550 East Harrpden Avenue, and others, were present regarding drainage problem; in the 3500 block of South Pennsylvania. Mr. Thcmis stated that the group had been here a year ago to discuss the drain- age problem with the Council. He introduced the adjoining property owners in the 3500 block of So. Pennsylvania. He stated that the nonnal spring rains flooded the alley last year, and they expect it to flood them again this year. He questioned Council as to what priority level this particular problem stood at in the total storm drainage problem. City Manager Dial stated that it wuld cost about $UO ,000 to correct this problem and that it was one of the priorities considered, along with the South Basin. The City Council gave the go-ahead for the South Basin recently. Mr. Jerry Sterika, 934 East Princeton Circle, an owner in the 3500 block of So. Pennsylvania Street, stated that the apartments currently had adequate off-street parking but unfortunately travel on the alleys during wet time is extremely dangerous, which does not allow the apartJnent dwellers to park off street. Councilman Dhority inquired as to what the property owners ~uld have the Cowcil do at this time. Mr. Sterika replied that they often have 18 inches of water in the alley, and that Council needed to ifTl>rove the wlx>le drainage district. Mayor Senti inquired whether there ~re any tenporary solutions to the problem. Director of Public Works Waggoner stated that all the pipes in the area were too small to pro- vide for any teq:>orary solutions. Councilman Schwab stated that it was never easy to make a priority list for major problem;. He questioned whether paving of the alley 'NOUld be of any help. Mr. Sterika replied that he was sure it ~uld help and questioned exactly where on the priority list this project currently stood. Director of Public Works Waggoner stated that it was about 3rd on the priority list. Lack of federal funds did not allow the City to go further than just the South Basin. Councilwoman Herming informed Mr. Sterika that the Council wanted to get those projects finished and under way which involved purchase of hanes and that the project he was concerned about was 1 and 1/2 to 2 years SMB.Y. Director of Public Works Waggoner stated that it could be financed out of next year's budget. City Manager Dial stated that he felt con- fident that this kind of l'!D'ley ~uld be available in next year's budget. * * * * * City Attorney Berardini stated that a Bill for an Ordinance had to be introduced before a public hearing could be held on a planning and zoning conmission request. The Mayor declared the public hearing opened. Mr. James Supinger, Director of Comn.mity Develoi:ment, appeared before C.Ouncil. He stated that the property was south of Lehow Street, adjacent to Big Dry Creek. The re- mainder of the property owned by Mr. Brinkhoff is already zooed R-3-B. 'Ihe City of Littleton is concerned about the flood plain along Big Dry Creek at this time. Mr. Supinger felt that the developnent portion of this property TNOuld not be affected by the flood plain. Councilman Blessing stated that he is not ready to allow any building on this property which TNOuld cause drainage probleTS in the future. Cotncilman Schnackenberg also stated he felt if there was any doubt al all, we should hold off to prevent flood plain probleTS in the future, and he TNOuld like this matter cleared up first. Mr. Ronald Brinkhof f, 16 Ithaca Lane, appeared before C.Ounci 1. He stated that the building TNOuld be well above the 100 year flood plain area. Currently, the river divides his property in half. The developnent planned 'NC>Uld be 50% greenbelt, with 238 cars of under- ground parking. Cbuncilman Schwab noted that Finding No. 29 forced this developnent to adhere to the flood plain ordinance. Mr. Supinger stated that the developnent rrust conply with the 100 year flood plain ordinance of the City of Englewood. C.Ouncilman Dhority stated that the questions should be divided into the question of zoning, and then a question of whether a building permit should be issued based on flooding proble1TE . Mr. Brinkhoff stated that the green space in the project TNOuld be on a lower portioo of the property which TNOuld be in the 100 year flood plain area. Director of Public W:>rks Waggoner stated that, according to the C.Orps of F.ngineers report, the creek ~ld not go over the banks on that side. City Manager Dial stated that the staff TNOuld give a supplenE!lltal report to C.Ouncil before final action on the ordinance. City Attorney Berardini stated the City C.Ouncil should continue the public hearing at next ireeting in order to hear additional testim:ny en the questioo. Mayor Senti inquired whether any other persons prer.;ent wished to speak. 'llle Mayor declared the notion carried. * * * * * * Council received a reconmendation from the Water and Sewer Board that the Water Uses Contract between the City of Englewood and Walt Flanagan and Conpany (known as Flanagan Water Users Association) be approved. Mr. Dial stated that no written conm.mication had been received from the Board as of this time. Councilman Schnackenberg stated that there was sane urgency to the problem and he felt the Comcil should go ahead and consider these issues. City Manager Dial stated that Flanagan is a pre-mix concrete conpany, of which the City of Englewood was precluded from serving with water service due to the contract with the City of Denver. Councilman Dhority stated that it was his feeling that the Chairman of the Comn:ission ought to have the ~r to penalize those individuals. Mrs. Herming stated that very few cities pay conmission merrbers and questioned whether the City of Englewood should. Other comnittees in the City go places at their own expense . r.ouncilman Schwab stated that it was the feeling of the C.Ouncil sub-comnittee that these comnittees are quasi-judicial in nature with rmre respmsibility. 'llle Mayor declared the nvtion carried. * * * * ** City Attorney Berardini stated, relative to a proposed Bill for an Ordinance for special assessment deferral program for elderly and low-income perscns, that he had talked re- cently to Bill Lann, the City's bonding attorney for special assessment districts. Mr. Lamt felt that the Ordinance setting up the District in 1972 precluded the City's establishing alternative payment plans at this time. Mr. Lanm exhibited a possible breach of the original ordinances. 'nle City Attorney felt that the C.Ouncil may want to talk with Mr. Lamn concen1· ing this issue since he was an expert in the area. Since no action was required on the Di•· trict, it could be nede at a later time for future Districts. Col.ncilwoman Henning stated that she \<Dlld like to talk to Mr. Lanm, but that we could take our time since it was not applicable to this Paving District. City Manager Dial gave to C.Ouncil a copy of a rnem>randun from the Director of Public Works concerning Paving District No. 21. He stated that all the protests had been con- sidered in this mem:>randun, and that perhaps C.Ouncil ~d like to go through them in order to have a Bill for an Ordinance at the next C.Ouncil meeting. * * * * ** I I I I I I I I -7- Council began a discussion of an Urban Drainage District proposal for flood control on Little Dry Creek, including the Englewood Dam. City Manager Dial stated that there \o.10\lld be a ITEeting on Wednesday en the Little Dry Creek. The area nust bring the drainage system up to par in order to prevent any disastrous flood. At this time there was no way of krxJwing of any federal aid and/or of other city's help. The City of Greenwood Village liked the first plan option prepared by the engin- eers, Wich included five reservoir facilities. Plan E looked best to the staff of the City of Englewood, Wich included the Englewood Dam plus five other reservoir facilities. Nobody is ready at this time to say who will pay for this project. Possible methods are through fed- eral, state, city, special assessment, or drainage district funding. Councilwoman Henning stated that it was hard to assess the i.rq:>lications without figuring out how the funding -would be made. City Manager Dial stated he was inclined to agree and felt that the Urban Drain- age District should go to the entities with a funding overall plan. kl Englewood Dam will save the City of Englewood the difference between $11 million and 7 and 1/2 million during a 100 year flood. * * * * * * Council began discussion of a sidewalk district along So. Federal Boulevard within the City of Englewood .• City Manager Dial stated that the State Highway Department would construct sane asphalt sidewalks along Federal, but that that was inconflict with our current City ordinance requiring cement sidewalks. The City policy in the past has been to install side-ATalks which -would be paid off on a special assessment basis. C.Ouncilman Schnackenberg inquired as to how long an asphalt sidewalk would last. Director of Public \tbrks Kells Waggoner stated that it depends upm the IIDisture and the soil in the area, but should last at least three to five years. CoUlcilrnan Schnackenberg inquired whether the City was leaving itself open for other exceptions, and inquired whether the State lNOuld give the City the funds that they have set aside for this construction in order to allay sane of the costs of the construction. City Manager Dial stated that the State probably plarmed on doing it with their <Ml crews and trucks, which lNOUld, in effect, cost very little out-of-pocket cost to them. Councilman Dhority stated that he felt it was bad to make an exception on this basis, but that the people were probably willing to form a sidewalk district. Co\ncilwoman Henning inquired as to the time schedule if a sidewalk district undertaken. City Manager Dial stated that we have created sidewalk districts in the spring for cons true tion that surmer. Mayor Senti stated that the Council should consider what the citizens in that area have done already for them;elves. If the City of Englewood does only their sidewalks, it does not answer the problem in the area since there are three cities involved. The State al- ternatively will pave the whole area. C.Ouncilwoman Henning stated that perhaps C.Ouncil ought to approve the asphalt sidewalk en the basis that there will be a sidewalk district after three years. Councilman Schnackenberg agreed, stating that we should allow the sidewalk en the basis that there will be concrete sidewalks later on. Mayor Senti surmarized the C.Ouncil's feeling by agreeing to take no action at this time and allow the State to put in their sidewalks. * * * * * * Council began a discussion of a possible aQle!lctnent to the City's CATV franchise ordinance. The City Manager stated that his hangup with the current ordinance was that if another city got a better percentage deal and service from the CATV system, then the whole area should be allowed to have that sane higher percentage. * * * * * * CouncilTNOman Henning left the room at 10:50 P.M. * * * * * * 'lhe new proposal by M>untain States Video wuld guarantee that the City would get the benefit of any better advantage given in the area. He said that the action at this time lNOU.ld be to instruct the City Attorney to establish an ordinance on this matter, if the Council so instructed. * * * * * * • -8- Council began consideratien of a policy regarding land acquisition for South Drainage Basin inl>rovement. * * * * * * Councilwoman Henning returned at 10:54 P.M. * * * * * * City Manager Dial stated that the Council had given previous approval for the purchase of ene parcel of land in the South Basin Drainage District, and that the City was currently in the planning stage of appraisals for the rest of the properties. He stated that he wuld like to expedite special appraisals if an approach is made to the City to purchase sane property. He requested approval fran Council to get inmediate appraisals whenever this circuns tance arose. Mayor Senti cormelted that he felt it should only be done for hardship cases. C.Ouncilwoman Henning stated that, in effect, the City was forcing the indivi- duals out of their hanes, if not now, at least by the time the storm drainage project would be undergone. He stated that the report had been prepared by the Department of Finance this year in contrast to previous years when the auditing firm actually prepared it. The auditing firm had made cocmelts in the report en its contents. * * * * * * City Manager Dial stated that former City Manager Rudd had succuIDed in the previous week and that services wuld be held in California. * * * * * * City Manager Dial stated that the parking lot around Cinderella City was deeded back to the City fran previous years en the basis that a 3-hour parking limitation would be ilq>osed. The City was currently in the process of making certain areas of the parking lot in- to a 3-hour lirnitatien. * * * * * * Mr. Forrest Thorpe, ene of the Special Citizen Invitees , stated that he felt it was a real crime the nuli>er of people who attended Council meetings. He questioned the Qxmcil whether pull>S could be used on the storm drainage problEllE discussed previously in the meeting. Mayor Senti replied that the City used JU!l>S in many areas during flooding times. * * * * * * C.Ouncilwoman Henning stated that she felt the cost of dedication of the new Police-Fire Connunications Center are quite excessive. She wuld like the City to retrench on sane of the costs. I I I I I I I I -9- Councilman Scl"Mab stated that he felt that the building was a real accoO¥>lish- ment and it was hard for any grand opening to be too elaborate. City Manager Dial stated that the staff could ioodify sane elements without hurting this overall plan. The overall cost would be $6 ,000. The Englavood Herald is planning on putting out a special supplement on the opening. The City can have a special supplement with color and have it become a historical docunent with a little bit of additional cost and effort. Councilman Dhority stated that he could not see $6,000 to open the Police-Fire Center, and that the citizens should have a desire to see the Center without plarmi.ng too elaborate a celebration. He felt the building "WOuld show itself off quite adequately. * * * * * * C.Ouncilman Schnackenberg inquired as to the status of the noise pollution ordinance.
