'Dle Mayor declared the rmtioo carried. * * * * * * The Mayor recognized the following people from the list of "Special Citizen Progran Invitees": Mrs. Ray J. 'Dlanan, 3200 So. High St. Precinct No. 7. Mr. and Mrs. Ivan J. Glassner, 4030 So. Grant St. Precinct No. 9. Mr. and Mrs. Willis A. Hicks, 4565 So. Acoma St. Precinct No. 12. * * * * * * Dr. Rudy Deyle, representing the Arapahoe Mental Health Service, appeared before Council to discuss the Mental Health Center. Dr. Deyle gave Council a map of the area covered by the Arapahoe Mental Health Center. He stated that the patient populatioo in 1972 was 2,000 patients. The center has 58 professimals and 34 students, with a budget of $900 ,000. Their funding is currently split between 251.. federal, 441.. State, 17% local, l<J'lo patient fees, and 5% County. IUe to federal cutbacks, adjustments in the budget will have to be made. 'Dle Center serves an area of 200,000 people and provides in-patient care as well as out-patient care. The Center works with ministers, doctors, school district, as well as other instituticns in the areas, helping to solve problemJ of a mental health nature. The Arapahoe Mental Health Center currently has a space crisis due to the rapid expansioo of prograrm and staff over the last few years. Councilwanan Henning inquired whether a contract basis ~ld be the best way to go about this service. Dr. Dey le replied that he felt the contract was the best way in order to show the real cost of service. Council.man Brown stated that he felt this type of program was a fine exanple of ooe meeting the needs of the citizens of Englewood. City Manager Dial inquired whether it ~ld not be nore proper for the funding to come fran the County as the entity Ellk:a1p88Sing Englewood, rather than receiving from both the Colnty and the City of Englewood, resulting in double taxatioo for Englewood residents. Mr. Dey le stated that the Arapahoe Mental Health Center needed funding despa- rately. * * * * * * :1 I I I I I 'I I -2- Miss Jan Wintheiser and Mr. F. Douglas ~arland appeared before Council to request funds en behalf of the fund-raising conmittee for the Englewood High School-Colorado Ouoerd Bound Green River Raft course. Mr. ~arland stated that the school had an outward bound program which they were excited about. They had still $770-$800 wrth of benefits to raise, and they were asking for spcnsorships of $25 to $50 apiece from clubs and individuals in the area. Miss Wintheiser gave a descripticn of the trip and the benefits of it to the students involved. Councilman Brown inquired whether the student body was showing any enthusiasm for the trip. Miss Wintheiser stated that the entire student body was supporting the trip and showing as nuch concern as could be imagined. * * * * * * Mrs. Frances Howard, 645 East Yale Place, appeared before Council on behalf of the Arapahoe County League of Wem:n Voters to discuss the Greenbelt along the Platte River. She stated that the League endorsed the proposal of the River Developnent Coomi.ttee for a golf course along the Platte River. Councilman Schwab stated that there were 12 golf courses within 12 miles of Englewood and that he had to question wnether a golf course was necessary at this time in Englewood. Councilman Brown stated that the City needed a Greenbelt area, of which the golf course serves as a good beginning. * * * * * * Mr. Lewis Patten, 4435 So. Grant Street, appeared before Council to discuss the proposed golf course. He stated that the land will not be available indefinitely, and that the City needed to take acticn at this time. The City of Denver and the City of Littletcn lx>th have greenbelts, and Englewood being in between the tw should extend that between the tw existing greenbelts. * * * * * * Mr. Janes Shoemaker, 4647 So. Galapago Street, appeared before Council to dis- cuss the proposed golf course. He reminisced on Englewood's past recreation and park program;. He stated that of the 12 courses in the area, the private ones were very expenSive. The Mayor declared the public hearing opened. City Manager Dial gave a brief history of the establishnent of Paving District No. 21. He stated that the people had been advised of the cost to be asessed against proper- ties, and investigaticns have been made of conplaints aired at the previous public hearing. The citizens have been advised of the results of those investigaticns. Mayor Senti inquired whether anyone was present to object to the assessment. No cne appeared before Council. The Mayor declared the 11Dtion carried and the public hearing reopened. The cocrplete transcript of this public hearing is maintained on tape in the office of the City Clerk, City of Engla«>od. City Attorney Berardini stated that a resolution of intent was passed sane weeks ago for the annexatien of this 181 acres. A finding of the facts nust be made by c.ouncil after the hearing is closed. He described to Council the area proposed to be amexed. He stated that the City felt it had over ~-thirds contiguity. Director of Public Works Kells Waggoner stated that the map presented outlines the ordinances which affected the city limits in the area surrounding the proposed amexation. Councilwanan Henning inquired as to what the contiguity percentage was at this time. Director of Public Works Waggener stated that it was 69 .66%. Attorney William Myrick cross exanined Mr. Waggoner. Mr. Myrick requested a fifteen minute recess, and the recess was refused by the Mayor. A petitien was read by Mr. Myrick against the amexation of this property and entered into the records as an exhibit for the defense. Director of Public \tk>rks Waggoner produced a copy of the official plat of Bellisle Gardens for Mr. Myrick' s perusal. A detailed discussien of the ordinances for amexation and their hearing on the map, exhibit 7, ensued. Questions on the contiquity were pursued by Mr. Myrick. Mr. Jim Supinger, Director of C.ormunity Developnent, appeared and presented exhibit rn.Ei:>er 8 as evidence and gave testinx:ny concerning the amexation proceedings. Mr. Myrick cross exani.ned Mr. Supinger. City Attorney Berardini stated the Council did not intend to inpose additional restrictions en the property to the best of his koowledge. Mr. Jack Fitch, 50 East Highline Circle, Littleten, Colorado, appeared before Council. He stated that he was a registered land surveyor. He gave figures on the contiguity and total distances which he had deduced after thoroughly exanining the City's ordinances and of annexation. He noted what he felt were sane errors en the official City map. He felt the City had enly a 54.4121o centiguity, which was less than that necessary. City Attorney Berardini cross-exanined Mr. Fitch. >n exhibit calling for an election in the area, and a petition presented in 1970 were brought to the Council's attention. Inca, for a variance to permit the encroaclment of a hedge a distance of 9'3" from pro- perty line to sidewalk upcn City property. Mr. Roy Tollen, 4030 So. Inca Street., appeared before Council. He stated that the points concerning the matter have been covered and that he would like to have a de- cision on this matter. Mr. John Lippert, 4020 So. Inca Street, appeared before Council. He stated that he was in a position to the granting of a variance due to stakes and wire rurning along the hedge route. He felt this was dangerous to children in the area. Cculcilman Brown inquired as to how many children were in the area. Mr. Lippert replied that there were rrrmy children of a young age in the area. C<ulcilman Sclnackenberg stated that he had observed the situation and felt that the netal staked were a hazard. City Manager Dial stated that the dan functioned in the 3-inch rain storm of May 6, 1973, and that he felt it l«>Uld be nuch help in preventing future damage from stonm in the area. There was a problem deciding w00 l«>Uld bear the cost of repair to the dam. * * * * * * Coln:il~ Henning returned at 11:04 P.M. * * * * * * City Manager Dial suggested a comnitment by the City Council of 31.25%, whereas the Urban Drainage and Flood Control District had requested 50%. Their letter is their first proposal and this reply l«>Uld be a first conmitment from the City of Englewood. Hr. Rick Bell of DRO:X; appeared before Council in relaticn to the DRO:X; Regi.ooal Housing Allocation Plan. Mr. Bell stated the DRO:X; had a resolution passed to allo- cate housing across the Metro area. The City of F.ngl~ was included in that allocaticn for a certain nurber of housing units. It was an atterrpt to identify the regional housing needs of the area, while Englewood's particular needs may be smaller in reality. -9- City Manager Dial described the allocaticn program to Council. Mr. Bell stated that the resoluticn provided a recognition by each local body that they have a camdtment in the housing area. Councilman Sctnackenberg stated that Secticn 2 said that the Council will prepare and adopt the plan, and he questioned whether that was not the Housing Authority's respcnsibility. Mr. Bell stated that each nunicipality differed, but that DRm had attenpted to draw an all-inclusive resoluticn. Mayor Senti stated that the Housing Authority was definitely the vehicle within the City of Englewood for this respcnsibility. Councilwamn Henning stated that the City of Englewood was way dcM1 the road in ca:rpariscn to many other cities in the area, and that this resolution was only a confinna- tion of action already taken by the City. Councilman Schwab stated that he felt the project was strictly a school program and shJuld be considered as such.
