CDI1>RAOO JULY 16, 1973 REClJLAR ~: 'nle City Council of the City of Englewood, Arapahoe C.ounty, Coloraoo, met in regular session on July 16, 1973 at 8 :01 P .M. Mayor Senti, presiding, called the meeting to order. The invocation was given by the Rev. Frederick Halm of the Imnanual llltheran Orurch. The Pledge of Allegiance was led by Girl Scout Troop No. 1356. present: 'nle Mayor asked for roll call. l.Jpal the call of the roll, the following were Cculcil Menbers Schwab, Schnackenberg, Henning, Illority, Brawn, Blessing, Senti. Absent: Nale. The Mayor declared a quorun present. Also present were : City Manager Dial City Attorney Berardini Assistant City Manager ~ Acmi.nistrative Assistant MendelSCX'l Director of Finance Nollenberger * * * * * * 'nle Mayor recognized the following perscns from the list of Special Citizen Progran Invitees: Mr. and Mrs. Al Johnsen, 4960 So. Elati Street. Mrs. Jolmscn stated that the block of 4900 So. Elati Street was in need of some special paving due to repair ~rk oot properly done in the area. Mr. John Kreiling, 3131 So. High Street. Mr. and Mrs. Albert Seifert, 3121 So. Race Street. Mr. Seifert questioned Co\mCil as to \¥hat the Planning and Zoning Comnission's respcnsibilities in the City were. City Manager Dial answered Mr. Seifert' s question. * * * * * * Mrs. Myrtle Jones, 5020 So. Washington Street, appeared before Council to dis- cuss a citizen conplaint. Mrs. Jones stated that she wanted a straight answer as to the trailer ordinances in the City of Englewood. She stated that a Mrs. Sue Schneider in the Code Enforcement Divi- sicn had told her that a 15 foot trailer had to be parked in the back of a yard. A 100torized vehicle could be parked on the street or in the driveway. She felt that this law should be applied uniformly across the City. She felt the original trailer law had been passed during the time of only trash haulers in the City and that the betterment of the City of Englewood demanded that Council take action at this time to amend the ordinance. City Manager Dial stated that Cot.mcil had referred questions concerning the trailer ordinance to the City Attorney previously. The City Manager had appointed a conmittee of the Police Olief, the Traffic Engineer, The City Planner, and the Building Inspector to look at the situation and to suggest any changes necessary. 'nle State law says that a trailer is a vehicle under 26 feet long, while anything over 26 feet is a tIDbile home. Many trailers in the City are not subject to the ordinance, while lTDbile homes are. 'nle ordinances oo not preclude parking in the driveway, in froot of the house, or in the yard. A 100torized hane can be parked on the street while a trailer could not be parked there, except for a short time. Mr. Maurice Jones stated that there should be a change in the trailer ordinance to prohibit some types of trailers. He stated that they were an unsightly mess to the City at this time. He felt that in lieu of a change in the ordinance, information on the present or- dinance shoold be transmitted to citizens for their inforrmtion, since there has been nuch arguing in neighborhoods concerning this. Councilwoman Henning stated that she ~uld like a list of the current ordinance sections pertaining to trailers and what effort or ~rk had been done in other cities in rela- tion to this. * * * * * * Colmcilman Brown stated that he had received calls of appreciation for the drainage ditch project now under construction in the City. He had some concern over the re- pairing of the streets in the areas that the drainage construction coopany had torn up. '!he City Manager had assured him that the areas indicated wul.d be repaired in the near future. I I I I I I I I -2- r.ouncilman Schwab stated that he had had a numer of calls substantiating his role in regard to the Clrrist is the Answer people in the City at the last Council meeting. Assistant City Attorney Lee stated that a suit had been filed in Littleton to put a te11>0rary injunction on the Cltrist is the Answer people to make them leave the area as far as living accaoodations. The request was made on Friday, the 13th, aid Judge Lee refused to present a tercporary restraining order until the other side had a chance to present their case. * * * * * * Q:>uncilman Sclmackenberg inquired as to what parking facilities were available for people wi'¥> want to use the Denver bus for transportation to the downta,,n Denver area. City Manager Dial stated that all the land just north of City Hall was available, but that all the other land in the area was controlled by merchants. * * * * * * Councilman Dhority stated he had concern that the City follow up oo the correct paving of the streets after the stonn drainage project. * * * * * * The minutes of the Library Board meeting of July 10, 1973 were received for the record. * * * * * * The minutes of the Parks and Recreatioo Comnissioo meeting of June 20, 1973 were received for the record. * * * * * * The minutes of the Board of Career Service Conmissioners meeting of June 19, 1973 were received for the record. * * * * * * The minutes of the Board of Adjustment and Appeals meeting of July 11, 1973 were received for the record. * * * * * * The minutes of the Housing and Urban Renewal Authorities meeting of May 22, 1973 were received for the record. * * * * * * The minutes of the Policemen's Pension Board meeting of July 9, 1973 were re- ceived for the record. * * * * * * The semi-armual financial report of the Policemen's Pensioo Fund was received for the record. * * * * * * The semi-annual financial report for the Firemen's Pension Fund was received for the record. * * * * * * A mesrorandlln from the Assistant City Manager relative to the timetable for additiooal programJ and appropriations for fiscal 1973 was received for the record. * * * * * * A letter to the Mayor from Mr. Lowell E. Counci1man Dhority stated that it was his understanding that the Council nust r e-appoint the Housing Authority due to a change in State law effective July 1, 1973. City Manager Dial stated that the Couocil had previously approved letter of understanding with the three enployee groups. He felt that the Couocil needed to consider the e.xeq>t persamel. The Mayor declared the rootion carried. * * * * * * Council received a menmandun from the Director of Finance discussing the possibility of a risk management program for the City of F.nglewood. City Manager Dial stated that the Director of Finance had attended a risk management conference in January. As a result of this, further study, and diScussion in the field, he had developed a growing awareness of the total risk that the City is involved in He felt that a risk management analysis at this time ~uld be extremely beneficial considering the large aromt of premiun paid annually by the City for insurance progral18. Counci1man Dhority stated that the direction of risk management was a proper one for the City to pursue. The City needed a greater kn:Jwledge in order to make rational decisions in this area. City Manager Dial suggested that possible a comnittee including Council and staff might serve as a good linkage. Councilman Dhority felt that the staff should pursue this matter. I I I I I I I I -3- The City received a reconmendaticn from the Board of Adjustment and Appeals that Council approve an encroachnent request by Ken Mausolf of Mausolf Interiors, 3435 So. Broadiiiay, of ten feet over City property for a canopy. Mr. Mausolt stated that he -would like to have an encroactrnent oo City propery. O>uncil\rUOBI\ Henning inquired as to what the timing ot an encroactrnent request was. Assistant City Attorney Lee stated that an encroactrnent can be granted either with a time limit or not. City Manager Dial stated that it was his understanding that a letter of en- croaclment allows it to be revoked after 30 days of notif icatioo. The Mayor declared the rmticn carried. * * * * * * Assistant City Attorney Lee began a discussicn of a Bill for an Ordinance authorizing an exceptioo to the requirements for COfll>etitive bidding to allow negotiatioos f or the purchase of a mini-bus. c.ouncilman Schnackenberg stated that the City needed a mini-bus as soon as possible, and that it was logical to provide a similar type to the t'WO currently en the street. The Mayor declared the rmticn carried. -5- City Manager Dial gave a report to Council as to the cost figures en the purchase of a new Flexible bus. **.,'*** Assistant City Attorney Lee began a discussion of a notice of intent and resoluti.oo of intent to armex an area of land totaling 183 acres, more or less, setting a time and place for a hearing thereoo. He stated that a conflict in time had developed so that the public hearing 1T11S t be set back to approximately Septeriber 10th and the publication dates changed. Council~ Henning stated that she felt the dates for publicatioo should be the 9th, 16th, 23rd, and 30th. Councilman Schwab stated that he felt they should be the 2nd, 9th, 16th, cmd 23rd, so that if a mi.stake was made en the first publicatioo, the second one and a correct ooe ~d still be within the 30-day time limit necessary in publication. Comcilman Dhority concurred, stating that he felt the publicatioo should be en 2nd, 9th, 16th, 23rd, and 30th, in order to insure against a problem in publicatioo. The Mayor decl ared the m:>tion carried. * * * * * * I I I I I I I I -6- City Manager Dial stated that in lieu of a report on the developnent of an additialal bus route, he ~ld send a map to the Council indicating the proposed route. * * * * * * City Manager Dial stated that a gentleman was to be in the audience this evening on the extension of the water line in the Scenic View area and requested him to step forward. No one appeared before Council. * * * * * * City Manager Dial presented the Council a letter from Mr. Daniel Healy ooncem- ing a deab-bolt latch lock ordinance. He stated that he wuld leave the letter with them for their consideration. * * * * * * Hr. Jim Lucero, 3150 So. Delaware, appeared before Council. He stated that the increase in passengers on the bus line was so heavy that there was very little room to stand at times. He requested c.ouncil to take action.
