The City Council of the City of Englewood, Arapahoe County, Colorado met in regular
sessicn en February 22, 1972, at 8:00 P.M.
Mayor Senti, presiding, called the meeting to order.
Council Metber Brawn left Council Oumbers at 8: 05 P .M.
The invocaticn was given by the Reverend G. Bruce Currier of the Han¢en Hills
American Baptist Orurch. The Pledge of Allegiance was led by Pack No. 58.
The Mayor asked for roll call. Upcn a call of the roll, the following were present:

c.ouncilman Brawn reentered Council Chalrbers at 8: 07 P .M. and took his seat with
Cooncil.

Special quests as shown were recognized.

Mr. M.M. Sl.EIOOrs, 3140 South Delaware Street, appeared to request that the City
COlncil pass an ordinance prohibiting showing of "X-rated roovies" within the City of Englewood.
He presented a petiticn signed by the ''Comnittee for the Oppositicn for Indecent Pictures" and
attached letters to the Council from both his wife and him, known as Exhibit "A". Mr. SUIIDers
stated that the City has an ordinance prohibiting all marmer of activity within the City there-
fore, it should be no problem to adopt an ordinance prohibiting the showing of these offensive
fillJI>.
Mrs. M.M. S\.IIIDers, 3140 South Delaware Street, also spoke in favor of his proposal.
Reverend G. Bruce Currier, Han¢en Hills American Baptist Church, stated his support
of such an ordinance and requested Council to go on record inmediately opposing the showing
of these film;.
Councilman Brawn echoed his remarks.

There was s~ discussion as to whether the City Attorney has been asked to do
this before, but it was concluded that he had merely been asked to study the matter previously

and had reported back to C<7Jilcil that such an ordinance ""10Uld probably rot be upheld if
appealed through the Courts.
It was agreed that the intent of this nr:>tioo was to require that an ordinance be
prepared and submitted for Council's deliberation.

City Manager Dial discussed with Council a reconmendation from the Parks and
Recreation Comni.ssion that an agrccrocnt be entered into with Phelps-Brauer and Associates,
Inc. , for professiooal services oo preliminary master plan of a golf course.

Counci1man Lay indicated that such a study would be premature and that an appraisal
of the property to be studied sh'"ld be conducted first.
City Manager Dial stated that both the land appraisal and the study were necessary
and that because they went hand in hand, it was difficult to say which should come first. Cost
of the study he stated lNOuld be $3,000.
Mr. Dial then distrihlted a copy of the proposed agreellelt dated January 31, 1972,
which Phelps-Brauer and Associates, Inc. , for Council's study. Mr. Dial enphasized that the
study would include analyzing a possible recreatioo conplex in additioo to a golf course
facility .
Council Schwab stated that we will soon have approxinlltely eight golf courses,
public and private, generally between Cllerry Creek Dam on the east, WadSlNOrth Avenue on the
West, County-Line Road on the SQ.1th, and Hanl>den Avenue on the North. These courses are
available to anyone providing they are willing to pay the cost; in sane cases such cost would
include oed>ership in a country club. Therefore, the argunent that ro golfing owortuni.ties
are available in the area is rot legitinllte --it is merely a mtter of being willing to pay
the price.
Mr. Jacques Stackhouse of the Parks and Recreation Conmi.ssioo and Chairmm of the
Golf Course Comni.ttee appeared to support the study.
Mr. Phelps of Phelps-Brauer and Associates, Inc., also appeared to answer questions.
Council.mm Brawn asked why it was inportant for the City to have a nuni.cipal course.
Hr. Phelps replied that (1) private courses preclude the public; (2) a history of Colorado
uuni.cipal courses has been one of profitability in this area (he roted in particular Kermedy
and Welshire courses); (3) a golf course was aesthetically pleasing for it provided open
space and was an excellent way to further conservation of the area.
Councilman Schwab asked if Mr. Phelps could guarantee that the course lNOuld make
t00ney and Hr. Phelps stated that he could not.
c.ouncilnan Dhority while not opposing the course asked Mr. Phelps why private
investors were not building mxe of the courses. Mr. Phelps stated that the era of the
country club was coming to an end and that the "frait end" mcney required to build a course
could often be put to better advantage by private investors.

reomneuding the purchase of the Jacobs Engine Brake for the 'Tele Squirt" punping apparatus
was received.
City Manager Dial reviewed the actim taken at the last regularly scheduled Council
meeting Calcerning the purchase of the Jacobs Engine Brake for the 'Tele Squirt" punping
apparatus. He noted that an award for the punper was authorized but that the brake was not
to be purchased until additional informatim had been givE!l to the Council and authorization
for the purchase was ma.de.
It was agreed by c.ouncil that the Jacobs Engine Brake could be purchased.
Council~ Henning left Council Chant>ers at 9: 08 P .M.
City Manager Dial disrussed the bids received for three fiberglass, 4700 galloo
capacity, liquid alun tanks. Original estimate of the tanks was $7 ,500 to $8,000 plus install-
ati.cn.
Councilwamn Henning reE!ltered Council ChBIIi>ers and took her seat with Council
at 9 : 10 P.M.
Mr. Dial reccmnes acted that the low bid of $5 , 000 be accepted, indicating that the
installatim would be performed at an additional cost by City crews.

City Manager Dial discussed a mem>randll'n from Mr. A. R. Bessettee, President of the
Colorado M.micipal League, urging the City to lend financial support to the League's partici-
patial in the Mountain Bell rate increase hearing. Mr. Dial indicated the cost to the City
~d be $842.32.
Councilwamn Henning felt that City participaticn was justified, especially since
the quality of service would also be a questim to be considered by the Comni.ssioo.

Councilman rlwrity questioned the distributioo of the Sales Tax between the General
Fund and the Ptt>lic Inprovenent fund and the City Manager agreed to report back to the Council
at the next meeting.
c.ouncil.wooan Henning questiooed why the revenues within the Recreatim Fund, parti-
cularly those of the indoor pool, sports and games, and cultural activities, were down for the
Dalth of January over the same IOOnth last year.
City Manager Dial said he "-IOUld report back to the Council at the following meeting.

c.ouncilman Brown asked about the status of the Animal Control Conmi.ttee recomnenda-
tions.
City Manager Dial stated that the City Attorney was studying a possible bill for an
ordinance to be presented to the Council at a later date.

Mr. Gil Egglestoo, 3911 South ShenI611, mmounced that he had a loose Spruce tree in
his yard which the City could have if it were willing to relOOVe it. The City Manager stated
that he would look into the natter.
