Lay Mayor Senti, presiding, called the m:!eting to order. The Mayor asked for roll call. Upcn the call of the roll, the following were present: c.ouncil Menbers Schwab, Henning, Brawn, Blessing, Senti. Absent: c.ouncil Meni>er Lay. The Mayor declared a quorun present. Also present were: City Manager Dial Assistant City Manager r-tnivitt City Attorney Berardini Director of Finance Nollenberger * * * * * City Manager Dial described the situation involving the i.nprovement of South Zuni Street frail West Evans Avenue to approximately West Yale Avenue. He stated that the City of Denver has an Urban Renewal Project in Scenic View. They originally had the nrney for i.nr provements on Zuni Street but recently had re-analyzed their situation and decided not to spend the m:xiey en Zuni Street. Kells Waggoner, Director of Public Works, and Mr. Dial had met with tlllD Denver officials and an Urban Renewal Official in an attelll>t to prevent the deletien of Zuni Street fran the renewal project. The Urban Renewal Authority seemed to be sytq>athetic. They have the Daley to i.nprove their half of Zuni Street in order to allow the Urban Renewal Authority to do the whole project. Under the Urban Renewal Authority, the 1/3 cost would be equivalent to Denver's share. The 2/3 cost would be paid by _ the Federal Goverruoont. The 1/3 cost is r~ly equivalent to the cost the city would have to bear if the inprovement of Zuni Street was done under a special assessment program. There currently is anple right-of-way for street and gutter. The city will seek donation for sidewalk right-of-way construction and expects a good tumwt fran the property owners. The 1/3 cost of the project is equal to ~16,000. The Urban Renewal Authority approved unani.llnlsly the proposal if we pay the $16,000 to thE!ll. Councilwam.n Henning asked if there was any legal problem involved since the Denver Urban Renewal Authority does not have the jurisdiction over our half of the street. City Manager Dial replied in the negative. Councilman Dhority asked if there was any illplication involved that we nay not assess other property amers in the future. City Manager Dial replied that a not"ll81 assessment progran would be assessed and that this would be the exception since the Daley would be paid out of Federal funds. 429 430 -2- Mayor Senti stated that he felt it was a good opportunity for the City of Englewood to take advantage of it. City manager Dial stated that if Zuni Street were in next year's special assessment program, the cost to the proterty owner shoold be $49,000 Councilman Dlority stated that he felt that property owners should be willing to put in a sidewalk and donate the right-of-way in light of this cost to them. City manager Dial stated that the city needs right-of-way only for the sidEWalk and should try to negotiate before the property owners are aware of this cost savings to them, but the Denver Urban Renewal Authority wants to proceed with the con- tract letting as soon as possible. Councilwcman Henning asked if it was legal to take any action on this matter in executive session. City Attorney Berardini replied that he felt it was legal and that there was precedent for it.
