Izett, the City Engineer of the City of Englewood, Ara- pahoe County, Colorado, d i d on the 13th day of November, A. D. 1922, sub•lt to the City Council of said City the foregoing estimate of all of the wort done and m~teriala f u rnished wllch included all •xtra work, labor and mater•al.a of every nature whatsoever in t he construction and completion of the trunk sewer in Sanitary Sewer District No. I, Englewood, Colorado, by t ~e Gordon Conatraotion Company under and by virtue of that certain contract between the City. of Englewood and said The Gordon Construction Company dated the 7th day of April A. D. 1922, and, WHEREAS, said estimate is the final estimate of said City Engineer of the work done and materials furnished in the complete oonstruotion of all of the tru:ik aewer in Sanitary Sewer District No. I, Englewood, Colorado, and all ex- traa furnished by said contractor for said City in said improvement district under the terms and conditions of ea.id contract, and WHEREAS, said estimate is in the sum of $7,563.63 same being in the full and final amount due the 111.id contr ~ctor at tbe date hereof, and WHEREAS, aaid City Cou ncil has heretofore inspected said work inerery detail and it is now the opinion of th i s Council that said work should be finally accepted and approved as completed by this Council, subject, howeYer. to at1pu~• tiona, specifications and conditions of said contract and aoool'd.ing to t h e terms and price thereof and subject to the contractor'• bond thereto attached, and WH!Ff!AS, there has heretofore been paid to aaid contraotor the eum of 29.000.00 on account of the work done and materials furnished in said im- provement district in ~ccordanoe with said contract and the amount stated as the balance due said contrac~or in this final estimate is, in the"Opinion of th6a Council, the amount to be paid said contractor in full and final aettle- ment by virtue of said contract and u ~~on t he execution and delivery by ea.id contractor to the aaid City of Englewood a release of all claims whatsoever g rowing o t of said cont111.ct, and . , .. • .· WHEREAS, after a thoro investigation this Council is satisfied that all of the work done and materials furnished to the said contractor by any and all third parties has been fully paid for ' y said contraotor and said contractor doe•Lnot owe tor any suoh work done or materials furnished, and WHER£AS, said esti mate has been fully considered by this Council in -every detail. · HOW, THE REFORE, be it resolwed by t he City Council ot the City of Englewood, Colorado, a t a regular session oonvened this 13th day ot November, A. Izett, City Engineer, a.toresaid, be and the same is her e by approved as ooree•t and be it FURTHER RESOLVED that the Citv Tre&8Urer ot e&id City be and he is heregy authorized, directed and empowe•ed to deliTer unto t h e said Gordon Construction Company eight bonds of Sanitary Sewer Diatriot No. I, Inglewood, Colo r ado numbered from to , inclusive, of the Par value of 18,000.00 and the aocrued interest from the date ot the said bonds to t ha date of the delivery t h ereof in full payment and settlement of all and every c aim which said contractor. may have against said City on account of the c on tract aforesaid. Said bonds are to be delivered to said contractor upon his signing t final receipt and releasing the said City ot Englewood from all and every obligation whatsoever under the terms and conditions of said contra.ot, PROVIDED, that in oase the amount of said bonds and the accrued interest thereon so authorized t o be delivered, as aforesaid, total an amount greater than ie due said c ontractor as evi enoed by the Engine•r's estimate, aforesaid, then 0aaid Treasurer is he reby authorized to deliver said bonds as aforesaid upon receipt by him from said c ntraotora o f an amount in oash in order that the amount due and the b on ds delivered may balance.
