SPECIAL MEETING:
COUNCIL CHAMBERS
CITY OF ENGLEWOOD, COLORADO
APRIL 11, 1966
The City Council of the City of Englewood, County of Arapahoe, State of
Colorado, met in special session Monday, April 11, 1966, at 8:00 P.M. in the
Council Chambers, City Hall, Englewood, Colorado.
The following Notice of Call was read by the City Clerk:

NOTICE OF CALL BY THE MAYOR
FOR SPECIAL SESSION OF THE CITY COUNCIL
MONDAY, APRIL 11, 1966 -8:00 P.M.
for the purpose of a public hearing on Paving District No. 15 assessments •
Notice and call is hereby given of a Special Session of the City Council to be
held on Monday, April 11, 1966, at 8:00 P.M., for the express purpose as set
forth above.

ACKNOWLEDGEMENT OF RECEIPT OF NOTICE
The following persons, all Councilmen of the City of Englewood, Colorado do hereby
acknowledge the receipt of notice of the above special session.

The Mayor asked for roll call. Upon the call of the roll, the following
persons were present:
Councilmen: Rice, Parkinson, Ludwig, Kreiling, Fullerton, Allen.
Also Present: City Manager Dial,
City Attorney Criswell,
City Clerk Malone.
Absent: Councilman Hanson.
The Mayor declared a quorum present.
COUNCILMAN FULLERTON MOVED, COUNCILMAN RICE SECONDED, THAT THE PUBLIC HEARING
ON PAVING DISTRICT NO. 15 ASSESSMENTS BE OPENED. Upon the call of the roll, the
vote resulted as follows:
Ayes: Councilmen Rice, Parkinson, Ludwig, Kreiling, Fullerton, Allen.
Nays: None.
Absent: Councilman Hanson.
The Mavor declared the motion carried.
The City Manager presented information relative to the cost of improvements,
the determination of cost and how that cost is assessed to properties in the
improvement district. He mentioned the various items, such as engineering, title
checks. fiscal agent fees, etc. that are included as a part of assessable costs.
He referred to the Council's change of policy last year increasing the base course
in industrial areas from six inch to eight inches and surface course from two inches
to three inches, thereby increasing the cost of paving in these areas. The City
Manager explained the manner in which assessments may be paid in full, thereby,
receiving a five per cent discount or spread over a ten year period at six per
cent interest.
The City Engineer displayed a diagram of a typical block and explained the
manner in which assessments are pro-rated, side street assessments, the_portion,
such as intersections, paid by the City and the manner in which ar~eriallstreets
in residential areas are assessed.
The City Clerk read a written protest fIOm John F. and Joan Smith,5095 South
Huron Street, protesting the amount assessed against their property.

The written protest from Roy Buffington, 4788 South Acoma Street, protesting
the amount assessed against this property was read by the Clerk.
The Mayor called for protests and statements from the floor.
Mr. Duncan Wilkey, owner of 3649 and 3659 South Grant Street, Lots 4 and 5,
Block 3, A. w Hiner's Subdivision, objected to the amount of his assessment in
that they only had an eighteen foot frontage on the south end of this property.
Mr. Wilkey was referred to the City Engineer to determine the validity of the
assessment.
Mr. J. F. Smith, 5095 South Huron Street, 8~ feet of Lot 10, except South
10 feet, Whitaker Acres Subdivision, objected to the amount of his assessment
and inquired as to credits, if any, which might have been given for the original
paving. The City Engineer indicated that he had personally checked Mr. Smith's
assessment and that it was correct as recorded. He explained that credits for
original pavement had been discontinued approximately two years ago by the City
Council. He further explained that this street was an arterial street of 44 foot
width, however, property owners were assessed for the cost of a 36 foot width
only.
Mr. OWen L. Cotter, 2931 South Tejon, Lots 9 and 10, Block 4, Vista Heights,
Second Filing, protested the assessment for the north fifteen feet of his property
in that he had agreed to give this property to the City for purposes of opening
West Bates Avenue. The City Manager explained that while he had agreed to give
the City the north fifteen feet that the City had since made other arrangements
and would not be taking the north fifteen feet and, therefore, he had been assessed
for it.
Mr. James W. Chandler, 2910 South Tejon, Lots 1 and 2 Block 5, Vista Heights
Second Filing, protested the assessment against his property. He stated that his
assessment was considerably more than he had anticipated. The City Engineer
explained that in addition to an assessment for the paving on South Tejon Street
that he was also assessed for paving on West Bates Avenue. Mr. Chandler stated
that he was not aware that he would be involved in the Bates paving, that West
Bates Avenue was of no value to him and that it was primarily paved for purposes
of access to the Industrial Park.
Mr. Chandler was referred to the City Engineer for the detailed breakdown
of his assessment and it was noted for record that Mr. Chandler was unable to file
a written protest in that he had been out of the City for an extended period of
time, having just recently returned.
There being no other persons present to make protest or statements from the
floor,

HEARING BE CLOSED. Upon the call of the roll, the vote resulted as follows:
Ayes: Councilmen Rice, Parkinson, Ludwig, Kreiling, Fullerton, Allen.
Nays: None.
Absent: Councilman Hanson.
The Mayor declared the motion carried.
COUNCILMAN FULLERTON MOVED, COUNCILMAN RICE SECONDED, THAT THE MEBl'ING BE
ADJOURNED. Upon the call of the roll, the vote resulted as follows:
Ayes: Councilmen Rice, Parkinson, Ludwig, Kreiling, Fullerton, Allen.
Nays: None.
Absent: Councilman Hanson.
The Mayor declared the meeting adjourned at 8:50 P.M.
