Jlr. lfbeel.er indicated that bids woull be llOUCJbt on the basis of two sets of p1ans, one calling £ar an eight lane poo1 and one ca1ling for a six lane poo1. Be a1so indicated that tbere wou1d be six other alternates included, that bids wou1d be received on June 15, 1966, and that caap1e- tion date of the pool was set at January 15, 1966. The original estimate 0£ 8 Minutes of May 16, 1966 $260,000 was considered firm by Mr. Wheeler with the indication that the various al.ternates would perai.t the City to construct the pool within whatever money liai- tation they so desired. Mrs. D. A. Rcnans, Planning and Traffic Director, gave a brief background of the zoning in the area and the K-Mart situation. She indicated that public notice of the rezoninq had been accomplished and that the property had been properly posted. There were no persons present to speak for aqainst the rezoninq. Minutes of the Planning and Zoninq Commission meetinq of April 6, 1966, were received for the record. Minutes of the Planning and Zoning Commission meetinq of April 26, 1966, were received for the record. Minutes of the Parks and Recreation Commission meetinq of May 12, 1966, were received for the record and a recommendation contained therein concerning grading and leveling to be done at Belleview Park west of the creek to accomodate the Lions Club train and zoo was considered. I I I I Minutes of May 16, 1966 COUNCILMAN LUDWIG MOVED, COUNCILMAN HANSON SECONDED, THAT THE CITY MANAGER BE AUTHORIZED TO EMPLOY AN ENGINEER TO PREPARE ESTIMATES FOR THE EXCAVATION OF BELLEVIEW PARK WEST OF THE CREEK AND THE MOVING OF OTHER EARTH NECESSARY TO ACCOMODATE THE CONSTRUCTION OF THE LIORS TRAIN TRACKS AND PROCEED WITH ADVERTISING BIDS ON SAME. Upon the call of the roll, the vote resulted as follows: Ayes: Councilmen Rice, Parkinson, Ludwig, Kreiling, Hanson, Fullerton, Allen. Nays: None. Absent: None. The Mayor declared the motion carried. The City Attorney reviewed briefly the suit of Anthony A'Costa vs the City of Englewood. COUNCILMAN FULLERTON MOVED, COUNCILMAN HANSON SECONDED, THAT THE CITY ATTORNEY BB AtJ'l'HORIZED AND DIRECTED TO DEFEND THE CITY OF ENGLEWOOD IN THIS MATTER. Upon the call of the roll, the vote resulted as follows: Ayes: Councilmen Rice, Parkinson, Ludwig, Kreiling, Hanson, Fullerton, Allen. Nays: None. Absent: None. The Mayor declared the motion carried. The City Attorney discussed a proposed agreement between Englewood School District No. 1 and the City of Englewood relating to the construction of an indoor swimning pool at Englewood High School. A brief discussion followed and the City Attorney indicated that a final draft of the agreement would be presented to Council in the near future. The City Attorney called to Council's attention a recent request for lasing of ineral rights on the Atchison Ranch property owned by the City and leased to the Martin Company. The City Attorney related the complications involved in that the for:mer owner had retained a fifty per cent interest in mineral rights and that the present lease with the Martin Company prohibited entry upon the property without approval of the Martin Company. The Council concurred that the matter of leasing the property should continue to be explored on a low priority basis. The City Attorney announced that he had recently filed briefs on the case of Mountain States Telephone Company vs the City of Bngl!wood and that he anticipated oral arqument on same in October or November of this year. The City Attorney reported on a conference call between the City Manager, the Parks and Recreation Director, and himself with federal representatives in Dallas and indicated a very favorable report regarding Englewood's application for Federal Am•i*tance in the parks developnent. The City Attorney reported to Council on the matter of the parking lot inmed- iately across frOlll City Ball which had originally been City property and leased to the llorqren Company. Due to the fact that this lease had not been recorded and was not accepted at the time of conveying park properties to Von Frellick and Asaociates, the City Attorney indicated the the City has no leagl right to this property. e Mayor called a recess of the Council at 10:10 P.M.
