The City Council of the City of Englewood, County of Arapahoe, State of Colorado, met in special session Tuesday, July 26, 1966 at 7:15 P.M. in Conference Room A, City Hall, Englewood, Colorado. The following Notice of Call was read by the City Clerk:' July 25, 1966 NOTICE OF CALL BY THE MAYOR FOR SPECIAL SESSION OF THE CITY COUNCIL TUESDAY, JULY 26, 1966 -7:00 P.M. Notice and call is hereby given of a Special Session of the City Council to be held on Tuesday, July 26, 1966, at 7:00 P.M. in Conference Room A of the Englewood City Hall for the express purpose of considering the awarding of a contract for the construction of an indoor swimming pool and to take actions as deemed necessary. /s/ STANLEY H. Upon the call of the roll, the following persons were present: Councilmen Fullerton, Ludwig, Parkinson, Rice, Allen. Also Present: Acting City Manager Malone, City Attorney Criswell, City Clerk Lyon. Absent: Councilmen Hanson, Kreiling. The Mayor declared a quorwn present. The Mayor read a letter from W. E. Bishop, Superintendent Englewood Public Schools. Mr. George H. Allen, Mayor City of Englewood P. o. Box 178 Englewood, Colorado Dear Mr. Allen: "ENGLEWOOD PUBLIC SCHOOLS William E. Bishop, Superintendent 4101 South Bannock Englewood, Colorado 80110 July 26, 1966 At our Board Meeting on Monday, July 25, the Board of Education passed a motion that the offer of $45,000 toward the construction of the swimming pool be officially approved by the Board of Education. It was agreed that the pool be constructed as recanmended by the Parks and Recreation Commission as stated in your letter of July 19, 1966, and as presented to the Board of Education by the Parks and Recreation Commission on July 11, 1966. This assures a fine facility for the use of the community through the mutual participation of the City and schools to this end. This will constitute official notification of the action of the Board and will provide the City the opportunity to award the negotiated contract in the amount of $313,189 as stipulated in the above mentioned letter. We are pleased again to be able to cooperate with the City in this worthwhile venture. Sincerely, /s/ W. E. Bishop, Superintendent I I I I I I I I July 26, 1966 The City Attorney read an amendment to the Joint Recreation Agreement. He stated that the $45,000 is not available until 1967, .. (probably February, 1967.) AMENDMENT TO JOINT RECREATION AGREEMENT THIS AGREEMENT made and executed this 12th day of September , 1966, by and between the City of Englewood, a municipal corporation organizwd and existing pursuant to the provisions of Article XX of the Const•tion of the State of Colorado, hereinafter called "City", and School District No. l, Arapahoe County, a quasi- municipal corporation, hereinafter called "District", W I T N E S S E T .H: ---------- WHEREAS, the parties hereto, in contemplation of, and pursuant to the authority granted by, the provisions of the Charter of the City and the provisions of Chapter 114, Article 1, Colorado Revised Statutes, 1963, have heretofor entered into a "Joint Recreation Agreement", dated June 27, 1966, a copy of which is attached hereto, wherein and whereby the parties set forth their intent to have constructed upon cer- tain realty presently owned by the District an indoor swimming pool and related facilities, in accordance with the conditions and stipulations countained in said Joint Recreation Agreement: and WHEREAS, in contemplation of said Joint Recreation Agreement, and of the pur- poses and intent thereof, the City has heretofore requested bids upon the construc- tion of said indoor swimming pool and related facilities in accordance with the plans and specifications referred to in paragraph one of said Joint Recreation Agreement with the result that the lowest of said bids for the construction of an eight-lane indoor swimming pool, together with other facilities recommended by the Parks and Recreation Conwnission of the City, far exceed the amount set aside and budgeted by the City for the construction of same, so that it is economically impossible for the City to construct said pool and facilities with the City's own funds: and WHEREAS, the District, by proper resolution of its Board of Education has, heretofore offered to pay the sum of $45,000.00, in addition to the amounts agreed to be paid by the District under the provisions of the said Joint Recreation Agree- ment, providing that the said pool and related facilities will be constructed in the manner recommended by the said Parks and Recreation Canmission of the City, NOW, THEREFORE, in consideration of the mutual covenants and considerations herein contained, it is mutually agreed as follows: 1. The parties hereto, and erch of them do hereby ratify and affirm each and every one of the provisions, condicions and covenants contained in the "Joint Recreation Agreement", a copy of which is attached hereto, except to the extent that this Amendatory ld}reement amend, modifies, abrogates or adds thereto. 2. The parties hereto, and each of them, acknowledges that they have reviewed the recommendations of the Parks and Recreation Commission of the City and the proposed construction contract and bid of Metro Construction Company, a Colorado corporation, and understand and acknowledge that the said Metro Construction Company has offered to construct the said indoor swimming pool and related facilities, in the aanner recommended by the Parks and Recreation Canmission of the City, for the total sum of $313,189.00. 3. The District ll!reby expressly agrees that , if the City accepts the said proposal of Metro Construction Company and enters into an agreement with that company for the construction of the pool and related facilities, as described in paragraph t\lllO hereof, for the sum of $313,189.00, the District will pay to the City after February 1, 1967, the sum of $45,000.00 to apply on the payment of the final $100,000.00 that may be owed to said Metro Construction Company, its assignee or successor. It is further expressly agreed by District that the said payment of $45,000.00 herein agreed to be made by it shall be in addition to all other payments aqreed to be made by the District and contained within the said Joint Recreation Agreement. Introduced by Councilman Fullerton A BILL FOR AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK-TREASURER TO BXECU'1'B A CONTRACT WITH METRO CONSTRUCTION COMPANY IN THE TOTAL AMOUNT OF $313,189.00 FOR THE CONSTRUCTION OF AN INDOOR SWIMMING POOL AND RELATED FACILITIES AND DECLARING AR BMERG*illiiCY. WHEREAS, the City Council of the City of Englewood, Colorado has heretofore called for bids for the construction of a certain indoor swinuning pool and related facilities to be located upon certain realty owned by School District No. 1 Arapahoe County: and WHEREAS, upon receipt of those bids, Council determined that the amount of all bids received were greatly in excess of the anticipated expenditures for the same, and by reason thereof, Council rejected all bids received and instructed the Director of Parks and Recreation and the City architect to negotiate with Metro Construction Canpany, the person submitting the lowest of said bids, to determine the possibility of having said work performed at a price lower than that stated in the bids received: and WHEREAS, the said Director of Parks and Recreation and the City architect have entered into such discussions and negotiations with the result that the said Metro Construction Canpany is now ready and willing to construct the aforesaid indoor swim- ming pool and related facilities for the total sum of $313.,189.00 in accordance with the following additions and deductions fran the plans and specifications originally reviewed by it: Base Bid Alternate No. 7 Alternate No. 8 Alternate No. 9 Alternate No.10 Less -Structural Glaaed Tile Winscot -SCR Acoustile -Ceramic Tile Decks Ceramic Tile in Pool Sub-total $301,770. 2,582. 5,636. 5,200. 5,500. $320,688. WHEREAS, there exists an inanediate necessity for the conanencement of said construction work and Council has determined that it is in the best interests of the City to accept the offer of said Metro Construction Canpany made as a result of negotiation between it, the Director of Parks and Recreation and the City architect: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Section 1. Pursuant to the provisions of Section 116 B of the Charter of the City of Englewood, the Mayor and City Clerk-Treasurer are hereby authorized and directed to execute an Agreement with Metro Construction Company for the con- struction of an indoor swinaning pool and related facilities for the total price of $313,189.00 and which Agreement shall° contain such additional terms as may be recomnended by the Director of Parks and Recreation, the City architect and the City Attorney. Section 2. For the reasons set forth hereinabove, Council hereby declared that an emergency exists and that the passage of this Ordinance is necessary for the i.mnediate preservation of the public property, health, peace and safety, and that this Ordinance, pursuant to the provisions of Section 41 of the Charter of the City of Englewood, shall take effeac inunediately upon its passage. The Mayor declared the motion carried. COUNCILMAN RICE MOVED, COUNCILMAN FULLERTON SECONDED, THAT THE MEETING BE ADJOURNED. Upon the call of the roll, the vote resulted as follows: Ayes: Councilmen Fullerton, Hanson, Ludwig, Parkinson, Rice, Allen. Nays: None. Absent: Bonacilman Kreiling.
