REGULAR MEETING:
COUNCIL CHAMBERS
CITY OF ENGLEWOOD, COLORADO
AUGUST 2, 1966
The City Council of the City of Engle'AlOod, Arapahoe County, Colorado, met in
reqular session on Tuesday, August 2, 1966, in the Council Chambers, City Hall,
Englewood at the hour of 8:00 P.M.
Mayor Allen presiding called the meeting to order and the invocation was
given by the Reverend Herbert R. Hosanna of the Mayflower Congregational Church.
The Mayor asked for roll call. Upon the call of the roll, the following
persons were present:
Councilmen Fullerton, Hanson, Ludwig, Rice, Allen.
Also Present: City Manager Dial,
Assistant City Manager Malone,
City Attorney Criswell,
City Clerk Lyon.
Absent: Councilmen Kreiling, Parkinson.
The Mayor declared a quorum present.
COUNCILMAN HANSON MOVED, COUNCILMAN RICE SECONDED, THAT THE MINUTES OF THE
JULY 5, JULY 18, AND JULY 26, 1966 COUNCIL MEETINGS BE APPROVED AS WRITTEN. Upon
the call of the roll, the vote resulted as follows:
Ayes: Councilmen Fullerton, Hanson, Ludwig, Rice, Allen.
Nays: None.
Absent: Councilmen Kreiling, Parkinson.
The Mayor declared the motion carried.
(Councilman Parkinson entered at 8:10 P.M. and took his seat)
The Mayor recognized the following "Special Citizen Invitees" and welcomed
them to the Council meeting:
Mr. Walter A. Downing, Jr. 2055 west Wesley Avenue.
Mr. Donald L. Turk, Assistant Director of Environmental Services of the
Tri-County Health Department, appeared before Council. Mr. Turk called the
Council's attention to a recently adopted air pollution control ordinance.
Mr. Turk stated that this ordinance parallels State Law in all facets except for
two in which it is more stringent. The two facets which differ from State Law
are 1, the section concerning the amount of sulphur dioxide produced in manu-
facturing and 2, the section concerning back yard incineration. Mr. Turk stated
that back yard incinerators will be prohibited on January 1, 1968. The banning
of back yard incinerators was discussed by council. Mr. Turk stated that the
elimination of back yard incinerators would probably increase the solids which
'AlOUld have to be disposed of at sanitary land fills by approximately twenty five
per cent. Mr. Turk further stated that enactment of a supporting ordinance by
the City of Englewood will help in the enforcement of this ban in 1968 by making
both Arapahoe County and the City of Englewood enforcement agents. The Mayor
stated that he believed that air pollution is a metropolitan problem. If the
Oity of Englewood should ban back yard incinerators and take other measures to
reduce air pollution, these measures would be ineffectual if similar measures
were not taken by Denver and other conununities to the north. Councilman Rice
stated that air pollution control should be given a great deal of study and
consideration prior to the City council taking any action.
Mrs. D. A. Romans, Planning and Traffic Director, appeared before council in
regard to the one-way street pattern proposed by the Planning Commission on April 14,
1965 and approved by the City council on April 16, 1965. Mrs. Romans was assisted
by Mr. Howard Osborne of the Planning and Traffic Department. Mrs. Romans explained
the first phase of the pattern as follows:
1) A one-way couplet between Yale Avenue and Quincy Avenue with South
Sherman Street north bound and South Bannock Street south bound.
2) Reciprocal one-way streets between Yale Avenue and West Hampden
Avenue with South Lincoln Street south bound and South Acoma Street
north bound.

3) Hampden Avenue one-way west bound from the intersection of State Highway 70
and East Hampden Avenue at approximately South Lafayette to the intersec-
tion of West Hampden Avenue and State Highway 70 at South Bannock Street.
4) Girard Avenue one-way east bound from South Elati Street to South
Downing Street.
Mrs. Romans stated that the second phase of the traffic pattern is to split
Highway 70 into a one-way couplet east bound at its p~esent location and west
bound on Floyd, conunencing on the east at the KLZ site and tieing in at a point
west of South Santa Fe. Because of this, Floyd Avenue was shown from its inter-
section with Downing Street west as one-way west bound in the first phase of the
pattern that was reconunended to the City Council a year ago.
Mrs. Romans stated that the implementation of the first phase of the
proposed traffic pattern would cost approximately $116,600. Included within the
$116,600 are the following ite~s:
(a) the construction of a bridge at Sherman over Little Dry Creek,
(b) widening Hampden between Acoma and Bannock to the same width as
between Acoma and Broadway,
(c) straightening South Sherman Street at East Bates Avenue,
(d) straightening Fox at Mansfield,
(e) a monotrol signal system in the core area and new signal
installations in the peripheral area.
Mrs. Romans stated that the straightening of Floyd Avenue between Lincoln and
Bannock and a new bridge on Bannock at Little Dry Creek are not included within the
first phase but are very important to an improved traffic pattern.
Mrs. Romans' presentation was discussed by Council.
Mr. Tom Holland of the Englewood Industrial Park Subdivision, appeared before
Council in regard to the City Council allowing the construction of valley curbs
and gutters within the Industrial Park Subdivision. The matter was discussed by
Council with Mr. Holland.
The City Manager presented a memorandum to the Council concerning the construc-
tion of valley curb and gutter within the Industrial Park Subdivision. Mr. Dial
pointed out that allowing the construction of valley curbs and gutters in the
Industrial Park Subdivision would require changes in the City's ordinance.
COUNCILMAN LUDWIG MOVED, COUNCILMAN RICE SECONDED, THAT THE CITY COUNCIL
TABLE MR. HOLLAND'S REQUEST FOR THE CONSTRUCTION OF VALLEY CURB AND GUTTER IN
THE ENGLEWOOD INDUSTRIAL PARK SUBDIVISION. Upon the call of the roll, the vote
resulted as follows:
Ayes: Councilmen Fullerton, Hanson, Ludwig, Parkinson, Rice, Allen.
Nays: None.
Absent: Councilman Kreiling.
The Mayor declared the motion carried.
COUNCILMAN FULLERTON MOVED, COUNCILMAN HANSON SECONDED, THAT THE PUBLIC
HEARING ON THE APPLICATION OF MR. JAMES M. HANNAH dba JIM'S CAFE, 3061 SOUTH
SANTA FE DRIVE, FOR FERMENTED MALT BEVERAGE LICENSE BE OPENED. Upon the call
of the roll, the vote resulted as follows:
Ayes: Councilmen Fullerton, Hanson, Ludwig, Parkinson, Rice, Allen.
Nays: None.
Absent: Councilman Kreiling.
The Mayor declared the motion carried.
Mr. Hannah appeared before Council. Mr. Hannah stated that his attorney
had been unable to appear due to a prior conunitment. Mr. Hannah stated that his
attorney had instructed him to request the City council to postpone the public
hearing if the Council felt there was any reason to deny Mr. Hannah's application.
Mr. M. M. Sununers, 3140 South Delaware, appeared before council. Mr. Sununers
stated that he was opposed to the postponement of the public hearing as it had been
advertised for this date. Mr. Hannah stated his desire to continue the public
hearing to a later date.
COUNCILMAN RICE MOVED, COUNCILMAN FULLERTON SECONDED, THAT THE PUBLIC
HEARING ON THE APPLICATION OF MR. JAMES M. HANNAH FOR FERMENTED MALT BEVERAGE
LICERSE BE CONTINUED TO SEPTEMBER 6, 1966, AND THAT MR. HANNAH'S PROPERTY BE
POSTED PROPERLY TO REFLECT THE NEW DATE OF THE PUBLIC HEARING AND THAT THE

APPLICATION BE REINSTATED AT THE TIME OF THE SEPTEMBER 6, 1966, PUBLIC HEARING,
AND FURTHER THAT THE COST OF THE ADVERTISING OF THE PUBLIC HEARING BE BORNE BY
THE APPLICANT AND THAT THE PUBLIC HEARING BE CLOSED.
The City Attorney asked Mr. Hannah if he were agree.able to bearing the cost
of the advertisement of the new public hearing date. Mr. Hannah stated that he
would be willing to bear those costs.
Upon the call of the roll, the vote resulted as follows:
Ayes: Councilmen Fullerton, Hanson, Ludwig, Parkinson, Rice, Allen.
Nays: None.
Absent: Councilman Kreiling.
The Mayor declared the motion carried.

received for the record.
Minutes of the Housing Code Study Committee meeting of July 14, 1966 were
received for the record.

RESOLUTION APPROVING APPLICATICfi OF ROBERT L •. BLAKELY FOR A FERMENTED MALT
BEVERAGE LICENSE TO BE LOCA~ED AT 3281 SOUTH SANTA FE DRIVE.
WHEREAS, Robert L. Blakely has heretofore applied to this Council, as
the local licensing authority, under the provisions of Chapter 75, Article 1,
1963 Colorado Revised Statute, for the issuance of a retail license for the
sale of fermented malt beverages at 3281 South Santa Fe Drive; and
WHEREAS, after due notice thereof, Council has heretofore held a
public hearing upon said application
NOW, THEREFORE, Be It Resolved that this Council should, and does hereby,
adopt the following findings and conclusions, based upon the information sub-
mitted at said hearing:
1. The applicant herein is a citizen of the United States and a resident
of the State of Colorado, residing at 10813 West 6lst Avenue, Arvada, Colorado.
2. The applicant has never been convicted of a felony and possesses a
good character and reputation.
3. The applicant has had extensive experience in the operation of
restaurants of the nature for which the present application is made, as well
as extensive experience in the operation of such establishments which hold
either liquor or fermented malt beverage licenses. At the present time, he
holds a Hotel and Restaurant Liquor License in Denver, and Fermented Malt
Beverage Licenses for locations in Denver, Arvada, Boulder, Colorado Springs,
Lakewood and Fort Collins. The police report submitted to Council reveals
that there has never been any violation recorded against any of these licenses.
4. At the time of the hearing, the applicant presented petitions bearing
the signatures of three hundred sixty-three (363) persons residing within an
area ·bounded, roughly, by South Cherokee Street on the east, West Yale Avenue
on the north, Natches Court on the west and West Lehigh Avenue on the south.
Evidence was also presented that there were no fermented malt beverage outlets
in this area and that the only such outlets within the City's boundaries are
the following:
A. Big Top, Inc. -123 East Belleview Avenue
B. Belleview Bowl -4900 South Federal Bou~~vard ..
c. King Soopers -5050 South Federal Boulevard

In addition, three persons testified in favor of ·the application, stating
'that the needs of the neighborhood required its approval.
5. Two persons spoke in opposition to this application. One person,
an attorney, stated that he represented certain landowners in the inunediate
vicinity of the proposed outlet· and expressed the opinion that a license
of the nature applied for would be a disruptive influence in the neighbor-
hood and suggested that a Hotel and Restaurant Liquor License be issued in
lieu thereof. This party presented an opposition petition bearing forty-
seven (47) signatures. However, some of ' the signatures upon this petition
are of persons living a considerable distance from the proposed outlet and
the petition itself does not delineate the reason for the signers' opposition.
The other person appearing in opposition presented a petition bearing two
hundred five (205) signatures, of which it was claimed one hundred thirteen
(113) lived within a three-block area.
6. Based upon the petitions, remonstrances and the other evidence
submitted, including the lack of any such outlet in the area, Council
finds and concludes that the requirements of the neighborhood and the
desires of the inhabitants are such as to support the issuance of the
license applied for.
7. In addition to the above two factors, the following factors,
while not determinative, also support said 'application:
A. The extensive experience of applicant in operating such establish-
ments without violations.
B. The applicant's good moral character.
c. The provision which applicant has made for adequate facilities for
customers, including adequate off-street parkirtg.
D. The policy of applicant in limiting sales of fermented malt beverages
to those persons over the age of twenty-one (21) years.
8. At the time of the hearing, applicant presented evidence establishing
that, in the event of the approval of his application, he shall be entitled to
possession of the realty located at 3281 South Santa Fe Drive, upon which he
plans to erect a building of a nature described in the exhibits presented at
the hearing, but that no building presently exists thereon. council concludes
that, by reason of the provisions of 1963 C.R.S. 75-1-7 (5), while Council may
approve this application at this time, no license can issue until sucn time
as a building is in existence and that any approval of Council should be
contingent upon the construction of such a building.
Be It Further Resolved that, based upon the foregoing findings and
conclusions,· the said application should be, and is hereby, app~oved ·a·nd
a favorable opinion thereon shall be supplied to the State Licensing
Authority.
Be It Further Resolved that no license for which application has been
made shall be issued unless, and until, applicant has constructed a facility
in substantial conformity with the plans heretofore presented and a certifi-
cate of occupancy has issued therefor.
ADOPTED AND APPROVED this 2nd day of August, 1966.

The City Arroney reported on the A'Costa liquor iicense case. Mr. Criswell
stated that the issues involved in the case concern the procedures before the
City Council at the public hearing. He stated that the Judge had expressed
concern that the witnesses had not been sworn in and their testimony had not
been fully recorded. Mr. Criswell recommended that a committee be appointed
to look into the procedures presently being used at public hearings with the
purpose of reviewing and revising public hearing procedures.
Mayor Allen appointed Councilman Fullerton and Councilman Ludwig to this
committee.
The City Attorney reported on acquisition of the Skjerl property for
Miller Park and the appraisal of Dartmouth Park properties. Mr. Criswell
stated that the Dunbar property on the Dartmouth Park site has been offered
for sale to the City at the price of $17,500. Mr. Criswell stated that this
price coincided with the appraised value determined by Blaine Chase Appraisers.

ATTORNEY BE AUTHORIZED TO PURCHASE THE DUNBAR PROPERTY AT THE PRICE OF

The City Attorney reported on the Franzmann property located on the
Dartmouth Park site. Mr. Criswell stated that the property had been
offered at the price of $13,000 by Mr. Franzmann and that he had received
appraisals in the amount of $12,100 and $12,250. Mr. Criswell stated that
if the City Council accepted Mr. Franzmann's offer there would be a possi-
bility that the Department of Housing and Urban Development might not
approve the fifty per cent grant for the total purchase price as the
Council would exceed the highest appraisal price. ·Mr. Criswell stated that
if the City Council does not approve the Franzmann purchase in the amount
of $13,000 the appraisals will be sent to Fort Worth requesting that specific
prices for specified properties be approved by the Regional Office of the
Department of Housing and Urban Development.
COUNCILMAN LUDWIG MOVED, COUNCILMAN HANSON SECONDED, THAT THE CITY
ATTORNEY NOT EXCEED THE HIGHEST APPRAISAL PRICE IN PURCHASING ANY PROPERTIES

The City Attorney reported that a parcel of land owned by the Public
Service Company and presently utilized as a power sub -station, located next
to the Dartmouth Park site is presently being offered for sale. Mr. Criswell
stated that this property is not included within the application for Federal
Aid.

MANAGER BE INSTRUCTED TO NEGOTIATE WITH PUBLIC SERVICE COMPANY FOR THE
ACQUISITION OF ALL THEIR PROPERTY IN THE DARTMOUTH PARK AREA.
Mr. Criswell stated that the acquisition of the Public Service Company
property located on Dartmouth Park Site could be handled as two separate
transactions, one transaction for the power substation and another tran-
saction for the remaining Public Service Company property.

The city Attorney reported on the Wesley Mccann law suit. Mr. Criswell
stated that the Mccann property located at 2900 and 2902 South Delaware have
been zoned R-2. The property had been used as a three family dwelling. The
City Building Department issued a cease and desist order upon said usage and
Mr. Mccann appealed to the Board of Adjustment. The Board of Adjustment
denied Mr. McCann's appeal, upon denial Mr. Mccann filed a law suit against
the City of Englewood.
The City Manager inquired as to whether it was the Council's desire
that the City proceed with the drafting of the necessary ordinance changes
for granting the valley curb and gutter in the Englewood Industrial Park
Subdivision. The Mayor stated that it was his general impression that the
City Council wished for Mr. Dial to proceed with the drafting of the necessary
changes.
The City Manager presented a list of addresses of properties which have
gutter obstructions. Mr. Dial stated that the payement adjacent to said
obstructions would deteriorate due to water accumulating in front of the
obstructions. Mr. Dial stated that in the absence of a directory from the
Council to the contrary the City would proceed with the request for removal
of these obstructions as allowed under the statutes.
The City Manager reported on the deteriorated condition of the curb and
gutter located at 3419 South Lincoln. Mr. Dial stated that the property
owner had been notified twice over the last two years.

City Manager reported that the City's Group Life Insurance policy
changed fran the Equitable Assurance Company to the Safeco Insurance
Mr. Dial stated that this would result in a savings to the City's

The City Manager reported that four petitions for Paving District No. 17
had been taken out. Mr. Dial stated that there are two more months for
petitions to be circulated before the deadline of September 30, 1966.
The City Manager reported that Mrs. Dorothy Romans, Planning and Traffic
Director, had requested that she be authorized to attend the American Institute
of Planners meeting at Portland, Oregon. Mr. Dial stated that Mrs. Romans
estimate of expenses was $325.00.

The City Manager reported on recent trip to Washington, D. c. Mr. Dial
stated that he had discussed the City's open space application with Mr. Richard

Mr. Lelunan had informed him that applications for open space grants had
increased and at the same time available funds for these grants had been
reduced. Mr. Lehman had stated that the policy of the Department of
Housing and Urban Developnent in regard to this shortage of funds would
be to deny funds for land and facilities which are required for spectator
sports.
The City Manager reported that the City was proceeding with the
preparation of plans and specifications for the proposed Central Garage
facility. Mr. Dial stated that the Central .Garage would have approximately
9,800 square feet.

CITY .t&NAGER BE AUTHORIZED TO APPROACH THE CITY OF SHERIDAN ON THE APPROVAL
OF THE PLANS AND PLATING OF THE PROPOSED CENTRAL GARAGE FACILITY WHICH IS
AUTHORIZED AND WILL BE FINANCED BY THE CITY OF ENGLEWOOD. Councilman Ludwig
stated in light of the probable increased budget needs for 1967, it might
be best to delay construction of the Central Garage until 1968.

The City Manager stated that the State Board of Health had found that
the affluent produced by the Englewood Sewage Treatment Plant does not meet
their standards for control of water pollution. Mr. Dial stated the City
had received a letter from the State Engineer stating that the City should
construct a final chlorination chamber for treatment of the affluent.
Mr. Dial stated that the probable cost of this chamber would be approximately
$60,000. He further stated that $35,000 is available in the 1966 Sewer Fund
Budget plus approximately $26,000 in the Sewer Fund Reserve for Additions
and Improvements.
