COUNCIL CHAMBERS
CITY OF ENGLEWOOD, COLORADO
JANUARY 16, 1967
The City Council of the City of Englewood, Arapahoe County, Colorado, met
in regular session on Monday, January 16, 1967, in the Council Chanbers, City
Hall, Englewood, at the hour of 8:00 P.M.
Mayor Allen presiding called the meeting to order and the invocation was
given by Claude D. Malone Jr., Assistant City Manager.
The Mayor asked for roll call. Upon the call of the roll, the following
persons were present:
Councilmen Rice, Ludwig, Kreiling, Hanson, Fullerton, Allen.
Also Present: City Manager Dial,
Assistant City Manager Malone,
Assistant City Attorney Murphy,
City Clerk Lyon.
Absent: Councilman Parkinson.
The Mayor declared a quorum present.
The Mayor recognized the following "Special Citizen Invitees" and welcomed
them to the Council meeting:
Mr. and Mrs. G. E. Sykes, 4898 South Galapago Street.
Mr. Ernest Herbertson of the Englewood-Littleton-Ft. Logan Bus Lines
appeared before the City Council. City Manager Dial presented and discussed
a memorandum fran Mr. Carl Broberg, City Manager of the City of Littleton, to
the Littleton City Council discussing the financial position of the Englewood-
Littleton-Ft. Logan Bus Line. Discussion ensued.
COUNCILMAN FULLERTON MOVED, COUNCILMAN HANSON SECONDED, THAT THE CITY ATTORNEY
BE INSTRUCTED TO DRAW UP A CONTRACT WITH THE ENGLEWOOD-LITTLETON-FT. LOGAN BUS LINE,
AND THE CITY OF LITTLETON FOR THE PURPOSE OF PROVIDING A SUBSIDY TO SAID BUS LINE
AS OUTLINED IN THE COPY OF THE MEMORANDUM FROM MR. CARL BROBERG, CITY MANAGER, CITY
OF LITTLETON, DIRECTED TO THE LITTLETON CITY COUNCIL FOR THEIR MEETING OF JANUARY
17, 1967: THE AMOUNT OF SAID SUBSIDY TO APPROXIMATE $1,800.00 PER YEAR: THIS
INSTRUCTION TO BE CONTINGENT UPON THE APPROVAL OF THE PROPOSAL AS OUTLINED IN THE
PREVIOUSLY MENTIONED MEMORANDUM BY THE LITTLETON, COLORADO, CITY COUNCIL. Upon
the call of the roll, the vote resulted as follows:
Ayes: Councilmen Rice, Ludwig, Kreiling, Hanson, Fullerton, Allen.
Nays: None.
Absent: Councilman Parkinson.
The Mayor declared the motion carried.
City Manager Dial discussed the Model Traffic Code Ordinance with the City
Council. Police Chief Jack L. Clasby and Fire Chief R. George Woods appeared
before the City Council and discussed the provisions of the Model Traffic Code
and the City of Englewood's policies in regard to speed restrictions on emergency
vehicles. Councilman Ludwig stated that his main concern about speeding of
emergency vehicles was with private ambulances not under the direct jurisdiction
of the Police and Fire Departments. He further stated that he was aware of many
hospital officials expressing the viewpoint that the speeds of ambulances should
be restricted due to the fact that in many cases these vehicles were involved
in accidents on the way to the hospitals. Discussion ensued.
Mayor Allen summarized the discussion by stating that it was the consensus
of Council that recommendations of medical people witDmn the area should be
obtained in regard to regulating the speed limits of private ambulances and that
the Council should obtain copies of the State Legislation which was being pre-
sented for the Spring, 1967, Session of the Legislature pertaining to the regu-
lation of private ambulance companies.
Mrs. D. A. Romans, Planning and Traffic Director, appeared before the City
Council and discussed a memorandum pertaining to the regulation of speeds on City
streets as called for under the Model Traffic Code.

SUBJECT: Schedules for the Proposed Traffic Ordinance
Section 25.3-11 of the proposed Traffic Ordinance requires that records be
kept of all the streets or parts of streets within the City where traffic regu-
lations have been adopted and which have been properly sign posted. These records
include schedules showing those streets and parts of streets which have been
designated as through streets and established as one-way streets: and those
streets or parts of streets upon which the basic speed limit has been altered:
trucks or other commercial vehicles have been excluded: stopping, standing or
parking has been prohibited or restricted, and weight limitations have been
imposed.
In working with Chief Clasby, Lt. Morgan, and Mr. Criswell, it has been
determined that few changes will be made in parking restrictions and prohibitions
throughout the City when the new Ordinance becomes final.
Some changes are being proposed, however, in the speed limits as they now
exist. Under the proposed Traffic Ordinance the maximum speed in a business
district shall be 25 miles per hour: the speed limit is now 20 miles an hour.
We are recommending that we conform with the maximum speed limit of 25 miles per
hour as set forth in the Ordinance.
The following changes in speed limits are being proposed by the Planning
and Traffic Regulation Department in cooperation with the Police Department:
On Broadway from Yale to Dartmouth increased from 30 miles per hour to 35 to
conform with that on Broadway north of Yale in Denver.
On Broadway from Dartmouth to Highway 70 bridg~ increased £rom 20 miles
per hour to 25 miles per hour to conform with the state maximum: on Broadway
from the Highway 70 bridge to Quincy, 35 miles per hour, increased from 30
miles per hour: on Broadway from Quincy to the south City limits, it will
remain at 35 miles per hour. On Belleview, we propose 35 miles per hour to
the west City limits at approximately Big Dry Creek. This reduces the speed
limit from 40 miles per hour to 35 miles per hour between Broadway and Bannock
because of the K-Mart traffic. On Highway 70, we propose to extend the 35 miles
per hour speed limit from Bannock east to Logan so that it will be 40 miles per
hour from the east City limit to Logan, and 35 miles per hour from Logan to the
west City limit at Santa Fe. It is now 40 miles per hour between Bannock and
Logan.
Those portions of Federal Boulevard within the City would be 35 miles per
hour and that portion of University Boulevard which is in the City would remain
at 35 miles per hour.
Floyd Avenue would be increased from the 15 miles per hour that was imposed
when it was adjacent to the park to 25 miles per hour.
The other streets will generally conform with the 30 mile per hour speed
limit set forth in the Ordinance.
The present Ordinance provides for 15 mile per hour speed limit in school
areas when posted: Chief Clasby and I propose a speed limit of 25 miles per hour
in school areas unless a specific problem exists, then the speed limit would be
determined upon the basis of a traffic study.
No change is proposed in streets designated as truck routes.
These are the major changes that are being proposed. A preliminary copy of
the schedule is available for your review and final copies will be ready for the
approval of the Highway Department by the latter part of this week.

The denial of left turns at Bannock and State Highway 70 which was to take
place on January 24, 1967, was discussed with City council. It was stated by Mrs.
Romans that East bound Highway 70 traffic will have two ways to enter the down-
town business district after the denial of left turns at Bannock and Highway 70:
(1) turn left at Cherokee Street, go north two blocks to
Floyd Avenue, then turn east on Floyd to Broadway,
(2) turn right on the ramp east of Bannock and Highway 70,
go to Kenyon Street, turn left on Kenyon and proceed
to the Kenyon Street and Broadway intersection at which
a new traffic light has now been installed.

City Manager Dial stated that the 30 foot "No Parking" restriction back from
signal lights and stop signs placed on the side of the street was also in effect
prior to the adoption of the Model Traffic Code Ordinance. He stated that it would
be unfeasible to paint a "No Parking" zone at every ... stree~ corner to which this
restriction applied. Rather, he stated, this could best be handled by placing
warning tickets on vehicles which were not continuously parked within the unmarked
30 foot area.
Minutes of the Planning and Zoning Commission meeting of November 30, 1966
were received.

.Minutes of the Water and Sewer Board meeting of January 10, 1967, were received.
City Manager Dial called the City council's attention to the memorandum
attached to the Minutes of the Water and Sewer Board meeting of January 10, 1967.
Mr. Dial stated that this memorandum contained a recommendation that a Resolution
be adopted revising the existing rate schedules for water service by the City of
Englewood, Colorado, effective April 1, 1967.
Mr. William Dobratz, Utilities Director, discussed the recommendation with
the council.
Mrs. J. E. Sykes, 4898 South Galapago Street, appeared before the Council.
Mrs. Sykes inquired about the reasons for the rate increase.
Mr. Dobratz replied that the City of Englewood Water Department was losing
approximately $250 ,000.00 annually. He further stated that this loss was largely
due to the fact that the City of Englewood no longer serves the Southeast Engle-
wood Water District which consisted of 4,700 customers.
Mr. and Mrs. c. J. Eisenberg, 4955 South Galapago Street, appeared before the
City Council. Mrs. Eisenberg stated that the water pressure in their area had been
low for a number of years.
Mayor Allen stated that there are a number of areas within the City in which
this situation exists. It is the hope of the City of Englewood to correct these
situations as money will permit.
Minutes of the Board of Adjustment and Appeals meeting of January 11, 1967,
were received by City Council with a memorandum recommending the approval of an
encroachment for the placement of a storm drainage line in South Elati Street at
West Yale Avenue adjacent to the General Iron Works attached. City Manager Dial
discussed recommendation contained within the memorandum.
COUNCILMAN LUDWIG MOVED, COUNCILMAN FULLERTON SECONDED, THAT THE RECOMMENDATIONS
CONTAINED IN THE MEMORANDUM FOR THE BOARD OF ADJUSTMENT AND APPEALS BE APPROVED.
Discussion ensued.
COUNCILMAN LUDWIG STATED THAT HE WISHED TO AMEND HIS MOTION TO READ "AND THAT
THE CITY CLERK BE INSTRUCTED TO PLACE AN INSTRUMENT RECORDING THE ENCROACHMENT OF
THE STORM DRAINAGE LINE ON RECORD WITH THE COUNTY CLERK."
COUNCILMAN FULLERTON STATED THAT HE WOULD ACCEPT THIS AMENDMENT. Upon the
call of the roll, the vote resulted as follows:
Ayes: Councilman Rice, Ludwig, Kreiling, Hanson, Fullerton, Allen.
Nays: None.
Absent: Counci).man Parkinson.

OF ADJUSTMENT AND APPEALS MEETING OF JANUARY 11, 1967, AND THE MINUTES OF THE PARKS
AND RECREATION COMMISSION MEETING OF JANUARY 5, 1967, BE APPROVED AND RECEIVED FOR
THE RECORD BY THE CITY COUNCIL. Upon the call of the roll, the vote resulted as
follows:

Assistant City Attorney Murphy reported to the City Council that City Attorney
Criswell was ill. Mr. Murphy passed out a report on Cable T. v. prepared by the

MEMO
TO: MAYOR, COUNCILMEN AND CITY MANAGER
FROM: CITY ATTORNEY
SUBJECT: CABLE TELEVISION
Subsequent to Council's receipt of Daniels Enterprises' letter of December 27,
1966, I have made a very summary review of the problems which could be presented
by the operation of such a system in the City of Englewood. In doing so, I have
contacted Chuck Howe, counsel for the Colorado Municipal League, and have spoken
with a private attorney who engages in practice before the Federal Conununications
Commission. From these sources, I have learned the following:
Cable television is a system whereby television programs are "piped" into
the private television set by cables and is in rather extensive use in those
locations where "regular" television service is unavailable or where signals are
weak. This method of transmission can be, and is, used for radio transmission as
well, particularly for "piped" music for restaurants, department stores, etc.
Presently there are approximately twenty cities in Colorado where such
facil"ties are available, principally on the western slope. Recently, Manitou
Springs had the system installed and Colorado Springs is now considering it. We
are also informed that Denver may be facing a request for the same.
Until recently, this activity was largely unregulated --the public utilities
commission of only one state, Connecticut, has set up a system of licensing. A
short time ago, however, the Federal Conununications Conunission adopted the policy
that this type of broadcasting falls within its "bailiwick" and it is now issuing
licenses for such broadcasts of a type similar to that required for other television
and radio stations. As noted in the Daniels Enterprises' letter, the FCC requires
the approval of the local municipality before it will issue its license.
As a matter of state law, therefore, the city has almost plenary power over
this type of activity and, in the course of negotiating a franchise agreement for
the use of the city's streets, alleys and other public places, may establish rates
to be charged to the customers and other ancillary matters. Of course, any such
franchise agreement would have to be approved by a vote of the tax paying electors
in accordance with the procedures therefor set forth in Article XX of the Consti-
tution and the City's Charter. The expense of such an election, however, would be
borne by the applicant for the franchise.
Based upon the experiences of other cities, the cable television business is
a successful venture from the standpoint of private capital and, for this reason,
it can be expected that there may be several different firms who might desire to
obtain a franchise from the City. It is the type of operation which can be
successfully operated only by one company within a single geographical area, how-
ever, and it may be anticipated that the FCC will only license one firm. In
view of this, if Council believes that it might desire to franchise such an
operation, it might give consideration to advertising for bids from various firms.
My review of this matter has been of the most summary type and I am presently
in the process of gathering several materials concerning the ~ource. Should my
review of these materials bring to light some further or additional aspects of
the matter, I shall make a further report to Council at that time.
At this point, however, it would be my suggestion that Council designate
representatives to meet with Daniels Enterprises for the purpose of exploring
exactly what the nature of their operation would be and to report to Council
thereupon.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO:
Section 1. Section 6.7-lS(b) of the Municipal Code of the City of Englewood,
Colorado, is hereby amended to read as follows: .
"(b) Periods of Service. The times of war for which points are added include:
The periods of the Spanish-American War: the period of the Phillipine Insurrection:
the period from April 6, 1917 to November 11, 1918 both inclusive: the period from
December 7, 1941 to December 31, 1946 both inclusive: the period from June 27, 1950
to January 31 , 1955, both inclusive: the period from January 1, 1965: and the period
of any armed conflict in which the United States may hereafter engage. The Armed
Forces above referred to are the United States Army, the United States Navy, the
United States Air Force, and the United States Marine Corps: and shall include those
who served in time of war in the United States Coast Guard since December 7, 1941."
Introduced, read in full and passed on first reading by the City council of the
City of Eng~ewood, Colorado, at its regular meeting on the 16th day of January, 1967,
and ordered published in full in the Englewood Herald and Enterprise.

Mr. Murphy reported that the hearing on the Mccann litigation involving a
nonconforming use at 2900 and 2902 South Delaware and 370 West Bates had been set
for February 10, 1967. Mr. Murphy also stated that the inuninent domain proceedings
for the Bevier property at Dartmouth Park had been set for trial on Wednesday,
January 18, 1967.
City Manager Dial passed out a report on 1966 General Fund Revenues and
Expenditures and 1966 Public Improvement Fund Revenues and Expenditures. These
items were discussed by the City Council.
Mr. Dial stated that preliminary information had been obtained regarding
Federal Storm Sewer Aid. He stated that it appeared that the City of Englewood
fell within the requirements of the Federal Government for this aid. It was the
consensus of council that the City Manager make inquiry with the Department of Housing
and Urban Development about the possibility of obtaining Federal Aid for storm sewer
construction.
City Manager Dial presented a memorandum concerning the proposed Central Garage.
This memorandum was discussed by the City Council.

National Bank Christmas Tree and for the ambulance donated by the Englewood
Junior Chamber of Conanerce.

The minimum monthly charge for any size meter serving any one consumer
on one premise shall entitle that consumer to the use of water at the regular
rate schedule in an amount sufficient to absorb the minimum charge. For all
water used in excess of that amount in any one month or multiple thereof the
charge shall be computed at the regular quantitative rate schedule applicable
for such service.
PAYMENT: The above rates for metered water service are net. All bills
are due and payable upon receipt of same and become delinquent 30 days after
date of bill.
All requirements relative to meters shall be in accordance with the Rules
and Regulations of the Water Department. No bill will be rendered for water
while service is shut off at the curb box.

said she was very pleased to be invited to attend the City Council Meeting and
was sorry her husband had been unable to attend.

WCX>DS, 770 GRANT STREET, BE REAPPOINTED TO THE PLANNING & ZONING COMMISSION FOR
A FOUR YEAR TERM. Upon the call of the roll, the vote resulted as follows:

Councilman Fullerton stated that he would be attending a Colorado Municipal
League Legislation Cormnittee meeting on January 27, 1967.
Councilman Hanson stated that he had received many favorable comments on the
traffic signal installed at Logan and Lehigh. He stated that he wished to
compliment the City on this installation. Councilman Kreiling mentioned that it
would be nice if these could be put on a flashing basis when school was not in
s-si on.
COUNCILMAN KREILING MOVED, COUNCILMAN HANSON SECONDED, THAT THE MEETING ADJOURN.
Councilman Hanson stated that the Manager's Monthly Report had not yet been
officially received by the Council.
COUNCILMAN KREILING STATED THAT HE WOULD WITHDRAW HIS MOTION FROM THE FLOOR
IN ORDER THAT THE MANAGER'S MONTHLY REPORT COULD BE OFFICIALLY RECEIVED.
COUNCILMAN HANSON STATED THAT HE WOULD WITHDRAW HIS SECOND.
COUNCILMAN HANSON MOVED, COUNCILMAN FULLERTON SECONDED, THAT THE CITY COUNCIL
ACCEPT THE MANAGER'S MONTHLY REPORT FOR DECEMBER, 1966, FOR THE RECORD. Upon the
call of the roll, the vote resulted as follows:
