REGULAR MEETING:
COUNCIL CHAMBERS
CITY OF ENGLEWOOD, COLORADO
FEBRUARY 20, 1967
The City Council of the City of Englewood, Arapahoe County, Colorado, met in
regular session on Monday, February 20, 1967, in the Council Chambers, City Hall,
Englewood, at the hour of 8:00 P.M.
Mayor Allen presiding called the meeting to order and the invocation was
given by the Reverend Leichty, First United Presbyterian Church of Englewood.
The Mayor asked for roll call. Upon the call of the roll, the following
persons were present:
Councilmen Rice, Parkinson, Ludwig, Kreiling, Hanson, Fullerton, Allen.
Also Present: City Manager Dial,
Assistant City Manager Malone,
Assistant City Attorney Murphy,
City Clerk Lyon.
Absent: None
The Mayor declared a quorum present.
The Mayor recognized the following "Special Citizen Invitees" and welcomed them
to the Council meeting:
Mr. Robert G. Menger, 3963 South Delaware Street
Mr. and Mrs. Blanford Duckett, 2727 West Union Avenue .
Mr. Ernest Herbertson of the Englewood-Littleton-Fort Logan Bus Line appeared
before City Council in regard to an agreement between Englewood, Littleton and Mr.
Herbertson regarding bus service to the Littleton-Englewood area.
City Clerk Lyon read the Agreement. Discussion ensued.
COUNCILMAN FULLERTON MOVED, COUNCILMAN RICE SECONDED, THAT THE MAYOR AND CITY
CLERK BE AUTHORIZED TO SIGN THE AGREEMBNT WITH MR. ERNEST HERBERTSON AND THE CITY
OF LITTLETON CONCERNING BUS SERVICE TO THE AREA. Upon the call of the roll, the
vote resulted as follows:
Ayes: Councilmen Rice, Parkinson, Ludwig, Kreiling, Hanson, Fullerton, Allen.
Nays: None.
Absent: None
The Mayor declared the motion carried.
COUNCILMAN FULLERTON MOVED, COUNCILMAN HANSON SECONDED, THAT THE CITY COUNCIL
ACCEPT AND RECEIVE THE MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING OF
JANUARY 18, 1967 , THE MINUTES OF THE BOARD OF CAREER SERVICE COMMISSIONERS MEETING
OF JANUARY 19, 1967, THE MINUTES OF THE PARKS AND RECREATION COMMISSION MEETING OF
FEBRUARY 4, 1967. Upon the call of the roll, the vote resulted as follows:
Ayes: Councilmen Rice, Parkinson, Ludwig, Kreiling, Hanson, Fullerton, Allen.
Nays: None.
Absent: None.
The Mayor declared the motion carried.
Assistant City Attorney Murphy reviewed a Bill for an Ordinance amending Chapter
17 of theMunicipal Code of the City of Englewood to provide for the licensing and
regulation of public dance halls, public dances and balls, roller skating rinks and
motion picture theaters. Discussion ensued.
Assistant City Attorney Murphy discussed a Bill for an Ordinance amending
Section 19.38 of the Municipal Code of the City of Englewood to provide that it
shall be unlawful to expose the breasts or lower torso in any public place.
Discussion ensued.

Minutes of February 20, 1967
Mayor Allen appointed Councilmen Parkinson and Hanson to serve on a committee
to work with the City Attorney to study the three Bills for Ordinances with the
possibility of redrafting said Bills.

A BILL
FOR AN ORDINANCE AMENDING SECTION 6.7-15 (b) OF THE MUNICIPAL CODE OF THE CITY OF
ENGLEWOOD, COLORADO, TO PROVIDE VETERANS PREFERENCE FOR THOSE VETERANS WHO HAVE
SERVED ON ACTIVE DUTY IN THE ARMED FORCES OF THE UNITED STATES DURING THE VIETNAM
CONFLICT.
Councilman Kreiling stated that he did not feel that veterans should be granted
a continuing preference after thay had received the initial preference in getting
a job.
Councilman Ludw~g stated that he felt that veterans preferences sometimes
hamstrung governmental agencies and forced them to hire less qualified men.
City Manager Dial stated that the Veterans Preference Ordinance could be
limited to entrance exams only.
Assistant City Attorney Murphy said that he would explore this matter and
report back to Council.

ates were seeking a letter signed by the Mayor which stated that elimination of the
Floyd Avenue diagonal road (shown on the map attached to the Floyd Avenue Agree-
ment) is in keeping with the Floyd Avenue Agreement.

COUNCILMAN KREILING MOVED, COUNCILMAN PARKINSON SECONDED, THAT THE MAYOR AND
CITY CLERK BE AUTHORIZED TO SIGN THE LICENSE AGREEMENT WITH THE DENVER BOARD OF
WATER COMMISSIONERS FOR WATER MAIN CROSSING AT EAST CORNELL AVENUE AND DENVER
CITY DITCH. Upon the call of the roll, the vote resulted as follows:

Assistant City Attorney Murphy reported that a hearing had been set on the
Reffel condemnation for Paving District No. 16. He also reported that there were
two other parcels in connection with Paving District No. 16 which had not been
acquired and that a c0111nission had been appointed for the acquisition of said parcels.
RESOLUTION
NO. 4, SERIES OF 1967
WHEREAS, street improvements in Paving District No. 16, Englewood, Colorado,
ha ~e been satisfactorily completed and have been accepted by the City of Englewood:

WHEREAS, a statement showing the whole cost of said improvements and a pro-
posed apportionment of the same on the property in said District has been filed
in the office of the City Clerk: and
WHEREAS, the City Council has considered the benefits acruing to each lot
or tract of land in said District by reason of the making of said street
improvements and has determined that the apportionment of the assessments for
said improvements, as set forth in the following Notice, is in accordance with
such benefits:
NOW, THEREFORE, BE IT RESOLVED that the Clerk of this City be, and he is
hereby authorized and directed to notify the owners of the property to be assessed
for said improvements by advertisement in three consecutive weekly issues of the
Englewood Herald and Enterprise, a newspaper published and of general circulation
in the City of Englewood, that said improvements have been completed and accepted,
that the cost thereof has been apportioned according to benefits and that a Hearing
on the assessments will be held at the time and place specified in the Notice, the
date of such Hearing being not less than fifteen days after the publication of
such Notice.
In addition, a sununary of said Notice shall be mailed to all owners of
property to be assessed with the costs of said improvements. The City Clerk shall
send such Notices of prepaid mail to the last known address of each such owner
of property.
BE IT FUTHER RESOLVED that the published Notice and mailed Notice shall be
substantially as follows:
PUBLIC NOTICE OF THE CDMPLETION OF STREET IMPROVEMENTS
IN PAVING DISTRICT NO. 16, IN THE CITY OF ENGLEWOOD,
STATE OF COLORADO, OF THE APPORTIONMENT OF THE COST
THEREOF AND HEARING THEREON.
TO ALL PERSONS INTERERESTED GENERALLY and to the owners of the real estate which
is hereinafter described, said real estate comprising the District known as
Pa~ing District No. 16, in the City of Englewood, Colorado
NOTICE IS HEREBY GIVEN: That the street improvements in Paving District No.
16 , Englewood, Colorado, which were authorized by Ordinance No. 3, Series of 1966,
finally adopted and approved on tie 21st day of March, 1966, have been completed,
that the same have been accepted by the City Engineer and the City council of
the City of Englewood and that the cost thereof has been apportioned against the
real property in said District according to benefits.
NOTICE IS HEREBY GIVEN:
1. That the whole cost of said improvements has been definitely ascertained
and is in the amount of $249,545.70, said amount including costs of inspection,
collection, incidentals and interest as allowed by law.

2, Of the whole cost stated in paragraph 1, the City of Englewood will pay
$89,246.21, leaving the amount of $160,299.49 to be assessed against the real
property in said District for the cost of said improvements.
3. That the share apportioned to and upon each lot and tract of land
within said District and assessable for said improvements is as follows:

ordinance assessing the cost of said improvements.
5. Complaints or objections to the proposed assessments wi-11 ·be hea·rd by
the Council on Monday, the 27th day of March, 1967, at the hour of 7:30 o''c'Iock
P.M., at the City Hall in said City.

NOTICE OF FILING ASSESSMENT ROLL OF CITY OF
ENGLEWOOD, COLORADO, PAVING DISTRICT NO. 16
AND OF HEARING THEREON.
NOTICE IS HEREBY GIVEN that the assessment roll for the City of Englewood,
Colorado, Paving District No. 16 has been filed in the office of the City Clerk.
The owner or owners of any property which is assessed in said assessment roll,
whether named or not in said roll, may, on or before the 23rd day of March, 1967,
file with the undersigned, his, her or their complaints or objections in writing
to the proposed assessments.
The City council will meet to hear and consider complaints or objections to
the assessments by any party or parties agrieved thereby on Monday, the 27th day
of March, 1967, at 7:30 o'clock P.M., at the City Hall in said City.
Any complaint or objection to the validity of the assessments or the pro-
ceedings taken therefor shall be deemed waived unless presented in writing at
the time and in the manner herein specified.

COUNCILMAN PARKINSON MOVED, COUNCILMAN FULLERTON SECONDED, THAT RESOLUTION
NO. 4, SERIES OF 1967, BE ADOPTED AND APPROVED. Upon the call of the roll, the
vote resulted as follows:
• Ayes: Councilmen Rice, Parkinson, Ludwig, Kreiling, Hanson, Fullerton, Allen.
Nays: None.

The Mayor declared the motion carried.
Mrs. D. A. Romans, Planming and Traffic Director, reported the City Council
that the 3400 Block of South Acoma was now open to two-way traffic. Discussion
ensued.
It was the concensus of the City Council to hold an informal meeting with
the Planning and Zoning Commission on the 27th day of February, 1967.
The Annual Report of the Englewood Police Department for the Year 1966, and
the Manager's Report for the month of January, 1967, were discussed by City
Council.
Councilman Hanson stated that he wished to commend the Chief of Police for
the fine report on behalf of the City Council.

APPRECIATION THE REPORT OF THE ENGLEWOOD POLICE DEPARTMENT FOR THE YEAR OF 1966.
Upon the call of the roll, the vote resulted as follows:
Ayes: Councilmen Rice, Ludwig, Kreiling, Hanson, Parkinson, Fullerton, Allen.

CClJNCILMAN HANSON MOVED, COUNCILMAN RICE SECONDED, THAT THE MANAGER'S MONTHLY
REPORT FOR THE MONTH OF JANUARY, 1967, BE ACCEPTED.
Members of the City Council discussed the relative merits of placing the
Manager's report on a quarterly basis instead of a monthly basis.
Upon the call of the roll upon Councilman Hanson's motion, the vote resulted
as follows:
Ayes: Councilmen Rice, Parkinson, Ludwig, Kreiling, Hanson, Fullerton, Allen.

City Manager Dial stated that he wished to remind the members of the City
Council that there was a Colorado Municipal League breakfast with State Legis-
lators at the Brown Palace Hotel on Friday, February 24, 1967.
Stephen A. Lyon, Director of Finance, reported on House 1 Bill 1141 which gave
statutory cities and counties sales tax authority, and House Bill 1198 con-
cerning the Specific Ownership Tax. Mr. Lyon stated that although House Bill 1141
reportedly did not deal with home rule cities, its present wording would cause it
to be legally construed to apply to all Colorado municipalities. He further re-
ported that House Bill 1198 dealing with specific ownership had a provision within
it which required that proof of payment of local vehicle ·use tax before register-
ing with the County Clerk. Such a procedure would cause a great deal of incon-
venience to citizens of the City of Englewood.
It was the general consensus of the Council that steps should be taken to
inform the Colorado Municipal League of the City's views on these two Bills.
Mayor Allen reported to the City Council on a meeting he had attended at noon
on Monday, February 20, 1967, with Mr. Arthur Schippett, Mayor of Columbine Valley
and Consulting Engineer: Mr. Kinghorn, Mayor of Littleton: Mr. R. F. Frantz of the
Englewood Water and Sewer Board: and Mr. Dial, City Manager. Mayor Allen stated
that the general purpose of the meeting was. to discuss joining the Metropolitan
Sewer District. He said that Mr. Sehippett had expressed the opinion that if said
cities did not join the Metropolitan Sewer District they would probably be in-
eligible for future federal funds.
Mayor Allen inquired of the City Council whether a stand on the Metropolitan
Stadium proposal should be taken. It was the consensus of the City Council that
no stand would be taken.
The City ~ouncil discussed the feasibility of belonging to various municipal
organizations.

councilman Fullerton inquired of the City Council whether it was in favor
of the one cent increase in gasoline tax which would go in Highway Users Fund
and then be split fifty-fifty between counties and cities. It was the consensus
of the City Council that they were in favor of this legislation.
Councilman Fullerton discussed with Council the House Bill, sponsored by
Representative Gebhardt, for a cigarette tax to be administered by the State
and the .proceeds returned to the cities, as well as other legislation pending
before the State Legislature.
