Mayor Love praaiding, called the meeting to order and the invocation was given by the Reverend Arlan Heyden, Jr. of the Hampden Hill• Baptiat Church. The Mayor asked for roll call. Upon the call of the roll, the following per80na were preaant: Councilman: Fullerton, Hanson, I<railing, Rica, Love. Alao Preaent: City Manager Dial, Adminiatrative Aasistant Malone, Aaaiatant City Attorney Myrick, City Clerk Chase. Abaent: Councilmen Allan, Braun. He explained that ha waa completely cut off for ace••• except for City property. Thi• land waa purchaaed by Mr. Rea for the City of Bnglewood when they were having problema in condemnation for diveraion of Little Dry Creek and the property ha• been greatly chopped up by eaaementa. Mr. Rea expreaaed hi• opinion that the growth in the area would be of benefit on a tax baaia to the City of Englewood and that actually nobody elae could use the land. Some of the improvement• would be •tarted in the fall of 1964, water and •ewer would be available at the time a client want• poaaeaaion. City Manager Dial reported that in checking with City agencie• tha~ they had no use for the land • The Council agreed to go ahead with the aale aa raconaended by the water Board. 'ftle Aaaiatant City Attorney waa inatructed to prepare nacaasary legal document• for aala of the land, by retaining the twenty foot sewer easement and an additional forty feet that could be a total of sixty fe•t for a dedicated street if neceaaary. 642-30 COLORADO PARACHUTE JUMPING TBAM -USE OF MILLER FIBLD Mr. Charla• King appeared before Council to obtain peraiasion for the use of Miller Field on Saturday, Auguat 22, 1964, for an air ahow by the Colorado Parachute Jumping Team. In addition there would be a display of new automo- bile• by Roger, Mauro Rambler on the parking lot. The requeat would be for the uaa of the park public address •Y••em, police and traffic control, with atandby of fire and ambulance equipment. Permi••ion will be obtained from the Federal Aviation Agency, •• well aa the juae•r• would aign a rel•••• of any liability on the part of the City of Bnglewood. Inaurance in the amount of $5,000 any one accident will be provided. The event would take from 12:00 noon to 1:30 P.M. giving time for the area to clear prior to the softball tournament. The Mayor declared the motion carried. 642-31 BOARD OP ADJUS'fMBNT AND APPEALS POLICY ON LATE REGISTRATION ON NON- CONFORMING USB Mr. Ed Cartwright and others appeared before Council in regard to problems arising with late regiatration• for non-conforming uaa. It was explained in that there is no provision in the present Code, and thi• created hardships on property owners. The Council reconmanded ~hat the A••i•tant City Attorney take thi• under advisement aa to modification of the Code. CALL TO ORDER The Mayor called the Council to order at 10:05 P.M. with the fol&owinq persons present: Councilmen Fullerton, Hanson, Kreiling, Rice, Love. The Mayor declared a quorum present. 642-33 PETITION FOR ANNEXATION TO ENGLEWOOD The City Clerk announced that he had received at 4:30 P.M. on Monday, August 10, 1964, from Mr. Ernest De Moulin, a petition for annexation of unincorporated territory in the County of Arapahoe, State of Colorado, to the City of Enqlewood, State of Colorado, to-wit: A tract of land in the NE\SE% of Section 15, Townahip 5 South, Ranqe 68 West, more particularly described as follow•: Parcel 1: COnaencinq at a point 587 feet Weatf ~~mthe Northeast corner of the s~ of said Section 15: thence South parallel with Bast line of said quarter Section 633 feet: thence West parallel with North line of aaid quarter Section 273.2 feet: thence in a &orthweaterly direction to pointon Horth line 373.3 feet West from place of beqinninq: thence Bast 373.3 feet to place of beqinninq. RESOLUTION BE IT RESOLVED that the petition for annexation of certain territory located South of Belleview, East of Broadway, located in Arapahoe County, COlorado, described aa A tract of land in the N~S~ of Section 15, Township 5 South, Range 68 West, more particularly described as follows: Parcel 1: Commencinq at a point 587 feet West from the Northeaat corner of the SE~ of said Section 15: thence South parallel with Bast line of aaid quarter Section 633 feet1 thence West parallel with North line of said Quarter Section 273.2 feet: thence in a Northw•aterly direction to point ,on North line 373.3 feet Weat from place of beqinninq: thence Bast 373.3 feet to place of beginning. Abaent: Councilmen Allen, Braun. 642-34 MBMORAlllXM REcaotBNDIHG 20 FOOT DEDICATIOH ON THE SOUTH SIDE OF EAST KENYON PROM SOUTH CLARKSON TO SOUTH WASHIHGTOH STRBB'l'S The Planning Conunission reconunended approval of the dedication if offered to the City of Englewood by the owners. The Council agreed that nothing has been offered, and they had nothing to act on. 642-35 BRIDGE ACROSS SOUTH PLATTE RIVBR AT WEST DARTMOUTH AVEHUE The Planning and Zpning commission recommended conaideration begiven to place in the 1965 Budget funds to finance conatruction of the bridge across the South Platte River at West Dartmouth Avenue. The estimated conatruction coat i• $60,000. The Council ruled to refer the matter to the City Manager for considera- tion to be included in the 1965 Budget. 642-36 EHCROACHMENT ON CITY PROPERTY 5001 SOUTH BROADWAY ~ The Board of Adjustment and Appeals, at their meeting of August 12, 1964, recommended the approval of an encroachment on City property at 5001 South Broadway for the South Side Chrysler-Plymouth Company. The said encroachment conaiata of paving on City property on West Grand Avenue and a fence to be erected on City property on South Acoma. The Mayor declared the motion carried. 642-27 RESOLUTION RELATING TO AIR POLLUTION RESOLUTION WBBRBAS, the City council of the City of Englewood, COlorado, is interested in the promotion and improvement of air pollution programs within the Denver metropolitan and surrounding area, and the Regional Air Pollution control Agency has been organized as a non-profit organization to pro{IOte and encourage through the cooperation of the cities and counties of this area, air pollution control programs. NOW, THEREFORE, BE IT RESOLVED that the City of Englewood, Colorado join and become a participating member 3of the Regional Air Pollution control Agency, and pay their pro-rata share of any assessments made by said agency. ADOPTED AND APPROVED this 17th day of August, 1964. Councilman Fullerton expreaaed his desire to be a member of the Regional Air Pollution Control Agency. 642-38 HAZARDOUS SIDEWALK EAST EAS'DIAH AVBHUB EAST OP BROADWAY City Manager Dial reported to Council that the sidewalk along Eastman Avenue east of Broadway was in a hazardoua condition. Notices have been sent to the owners to repair or replace, January, 1962, March, 1962 and July, 1964. The Mayor declared the motion carried. 642-39 SALB OP CITY HALL City Manager Dial presented to the Council a propoaed purchase of City Ball and adjacent lands by Jack B. Waggenblaat for $160,000. Also a lease back to the City, if desired, at one per cent of the sale price per month, plua utilities and insurance. Council recommended this matter be referred to the Assistant City Attorney for a legal opinion. 642-40 CITY MANAGER'S MON'l'BLY RBPORT City Manager Dial presented the monthly report for the month of July,1964. 642-41 CLAIM BY HOLSAM CONSTRUCTION COMPANY The City Clerk read a letter from Holaam Construction company's attorney in regard to a claim for payment of $9,068. This repreaents expenses in re- gard to the canal system down to Shadow Mountain. council agreed to refer this mattee. to the Assistant City Attorney for recommendation aa to action to be taken. Mayor Love announced the meeting of the Air Pollution Control Agency to be held on August 19, 1964, also the meeting of the Joint Economic Development Council to be Auquat 21, 1964. A letter was read from the Colorado Chapter of Public Works Officials announcing ~lie Works Week. This matter i• to be coordinated with the Chamber of Commerce by City Manager Dial. Councilman Fullerton inquired about the City-owned building occupied by Boward Plumbing. City Manager Dial informed him that the building has been vacated and the· Civil Defenae Department and Building Department are checking it out aa to use by Civil Defenae. Councilman Fullerton reported complaints aa to drag racing in the Centennial Acres area.
