REGULAR MEETING:

FEBRUARY 18, 1963
The City Council of the City of Englewood, Arapahoe County, Colorado,
met in regular session on Monday, February 18, 1963 in the Council Chambers,
City Hall, Englewood at the hour of 8:00 P.M.
Mayor Brownewell presiding called the meeting to order and the invoca-
tion was given by Reverend Wayne Caldwell of the Weslyan Methodist Church.
The Mayor asked for roll call. Upon the call of the roll, the following
persons were present:
Councilmen: Braun, Love, Miles, Parker, Smukler, Woods, Brownewell.
Also Present: City Manager Dial,
City Attorney Esch,
City Clerk Beausang.
Absent: None •
The Mayor declared a quorum present.

COUNC~ SMUKLER MOVED, COUNCILMAN LOVB SECONDED, THAT THE MINUTES OF
THE COUNCIL MEETING OF FEBRUARY 4, 1963 BE APPROVED AS WRITTEN. Upon the

631-16 PUBLIC HEARING ON PROPOSAL TO RBDUCB AGB FOR PATRONIZATION OF POOL
HALLS
COUNCILMAN LOVE MOVED, COUNCii.HAN MILBS SECONDED, THAT THE PUBLIC HBARING
ON A BILL FOR AN ORDINANCE AMENDING THE MUNICIPAL CODE TO PERMIT THOSE WHO ARE
16 YEARS AND OVER TO PATRONIZE POOL HALLS BB OPENED. Upon the call of the
roll, the vote resulted as follows:
Ayea: Councilmen Woods, Smukler, Parker, Miles, Love, Braun, Brownewell.
Nays: None.
Absent: None.
The Mayor declared the motion carried.
The Mayor asked if there were anyone present to speak in favor of the
proposal.
Mr. Harry Carleno, representing Mr. Clyde Rector, spoke on behalf of the
porposal and presented a petition bearing 66 names of persons desiring the age
be reduced to 16 years. The text of the petition was as follows:
"PETITION FOR CHANGE OP AGE OF PERSONS
PERMITTED TO USE POOLHALLS
We, the undersigned persons, being residents of th-/ity of Englewood, or
employe41 therein, respectfully petition the City Counci~~or the City of
Englewood that the following Ordinances be changed as indicated below:
"Section 19.4-2 Minors cannot freguent poolhalls.
It shall be unlawful for any person who keeps, conducts
or operates any billiard or pool table tor profit, or who keeps,
conducts and opera tea any room or rooms wherein is kept, used . ·
or operated for profit any billiard or pool table of any kind
whatsoever, to permit or allow any minor under the age of 18
years to play thereon or to use such table, or to be, remain in,
or frequent any such room."
Changed to:
"Section 19.4-2 Minors Cannot Frequent Pool halls.
It shall ~e unlawful for any minor under the age of SIXTEEN (16)
years to be found in a pool or billiard room which is open to the
public, except when accompanied by a parent or guardian.

"Section 19.4-3 Minors Not Permitted in Poolhalla.
It shall be unlawful for any person who keeps, conducts or operates
any billiard or pool table for profit, or who keeps, conducts and
operates any room or rooms wherein ia kept, used or operated for
profit any billiard or pool table of any kind whatsoever, to
permit or allow any minor under the age of SIXTEEN (16) years to
play thereon or to use such table, or to be, remain in, or
frequent any such room."
As grounds for the recommended chanr. of the said Ordinances which are
part of the Municipal Code of the City o nglewoocl, adopted by Ordinance#31,
Series of 1962, we respectfully submit t e following:
1. Playing of snooker and of billiard• ia in truth and in fact a
form of recreation, and would have a tendency to keep boys age
16-18 years of age out of trouble when they have some type of
recreation such as the playing of billiards and snooker to occupy
.their time in the evening ••
2. It is to be noted that other Ordinance• in connection with the
children in the City of Englewood ( See Sections 19.4-5 and 19.4-6,
all deal with children under the age of 16 with reference to curfews).
3. The image formerly portrayed by "poolhalla" of the 1930's is not
the same image as today portrayed by billiard and snooker parlors,
that in fact the name of billiard or anooker ia truly becoming a
family type of recreation, the same aa bowling.
4. The Ordinances as presently existing are aimiliar to Ordinances
in surrounding municipalities, and yet none of the same Municipali-
ties are enforcing said Ordinances, and in fact many youngsters
younger than the prohibitive age of the Ordinances are permitted
to play in various billiard halls and billiard parlors in the City
and County of Denver."
Mr. Carleno asked those peesons present in support of the change to stand.
Seven persons stood.
Mr. Carleno then discussed the current operation of a pool hall in com-
parison with that of days gone by. He presented a copy of the November 30,
1962 issue of Life magazine which on page 105 included an article entitled
"Rack'em Up for the Girls" for the members of the City Council to review.
Be stated that the City of Aurora had recently amended its ordinances
to allow a minor of any age to play pool when accompanied by his parent or
guardian. He aaked that the City favorably conaider an amendment of its
ordinances to permit minors of 16 and over to play pool.
Mr. Clyde Rector, Mr. Spencer L. Stoughton, and Art Davis spoke for the
proposal.
Mr. M. M. Sunmers, 3140 South Delaware, spoke against the change in the
age limit. He stated that he had not circulated a petition against the pro-
posal as he did not wish to bother the citizens of Englewood in this matter.
He objected to the proposal stating that it would introduce these young boys
into gambling and the coarser talk of older boy• and men. He emphasized
that a pool hall was different from a bowling alley as far as an acceptable
means of recreation for minors because of the regular and frequent bowling
by girls and women. He stated that in spite of the introduction of a recent
article in Life magazine that women did not play pool.
He stated that he had checked the minimum age limits surrounding Englewood
with the following results: Fort Morgan, 18 years, Loveland 18 years,
Brighton 18 years, Greeley 18 years, Denver 18 years, Littleton, 18 years.
He stated that officials of Denver and Littleton indicated no interest in
lowering the limit from the 18 year age. Councilman Miles inquired if there
were any replies to his inquiry which showed 16 years which he had not sub-
mi tted. Mr. Sununers replied that Golden had the 16 year limit.
Mr. Carleno spoke in rebuttal stating that many new plush pool halls were
being constructed and that on East Colfax Avenue in Aurora that several such
pool halls existed and were being frequented by women who appeared to thoroughly
enjoy the game. He stated that Glendale also has a lower age limit than the 18.
Messrs. Stoughton and Rector stated that their operation of pool halls
had not resulted in a distuzlbance or need for the calling of police for any
disturbance of any kind and that different mothers had specifically authorized
their children to play po4tl even though they were not of 18 years age.
Mr. Rector stated that in many towns which have an 18 year old limit,
this limit is not being enforced. He urged that the age limit be reduced to
16 years.
Mr. M. M. Summers in rebuttal asked for specific cases where the age limit
was not being enforced. He stated that to hi• knowledge there were two separate
cases on the Denver Municipal Court docket dealing with underage pool players.

He reviewed that he had spoken with officials of the cities of Littleton and
Denver who had specifically objected to the reduction of the age limit as
causing enforcemmit problems and leading to delinquency.

ACTION: Recommendation per Chapter 10, Section 10.3 Paragraph (d)
of the Municipal Code to the City Council that the
attached statement of purpose and book selection policies be
adopted."

631-18 RELATING TO ENGINEERING CONTRACT FOR PUMPING STATION
The City Clerk read the following recommendation from the Englewood Water
and Sewer Board in full:
"Tha~ Supplementary Agreement between the City of Englewood and w. w. Wheeler and Associates, consultinq engineers, to cover the
additional engineering to change the location of the pumping
plantn firom the Denver City Ditch to the South Platte River, in
connection with the Englewood No. 1 Dam and Reservoir project, be
approved and executed as presented."

622-70 RELATING TO SUIT BETWEEN ENGLEWOOD, LITTLETON AND COLUMBINE WATER AND
SANITATION DISTRICT
The City Clerk read the following recommendation of the Englewood Water and
Sewer Board:
"That the Stipulation and Agreement By and Between the Cities of
Englewood and Littleton, C6lorado, and the Columbine Water and Sanita-
tion District, for settlement of Civil Action No. 18198, District Court,
County of Arapahoe, without prejudice as presented to the Water and Sewer
Board on Febr uary 12, 1963, to provide for proper maintenance of their

sewage pumping station and proper alarm system shoultd there be
any malfunction of the same, by the Columbine Water and Sanitation
District, be approved and executed by the City Council, subject
to the addition thereto of provisions that the City of Englewood
and City of Littleton be furnished the specified sewage flow
chart weekly: and, in case of any malfunction of the pumping
station, that immediate action will be taken to correct same."
Councilman Braun discussed the circumstances leading to the suit against
the Columbine Water and Sanitation District and expressed his objection and
doubts to the proposed stipulation and agreement. The City Attorney des-
cribed in considerable detail the various considerations of the stipulation.
The Mayor spoke for the agreement stating that it was made in good faith and
recommended its approval by the Council. ·
Councilman Braun spoke further of the consequences of a sewage pump
failure and the ~· ability of maintenance men to secure necessary parts through
no fault of thei own. He emphasized that should such a breakdown occur at a
period of high w ter consumption that the City would have to take water from
the Platte River which would contain raw sewage. He reviewed that there was
another alternative which would permanently solve this problem. The District
could connect into another sewage disposal area where gravity flow may be
used. This would remove approximately 75 to 100 sewer treat .. nt l_ accounts
from the City of Englewood's system. Discussion ensued.

622-27 RELATING TO WESTERN SLOPE TRANS-MOUHTAIN WATER DEVELOPMENT PROJECT
The City Clerk read the following recommendation ef the Englewood Water
and Sewer Board in full:
"It is strongly recommended that immediate action be taken by the
City Council to contract with w. w. Wheeler and Associates, Consulting
Engineers, previously employed on the Western Slope Tirana-Mountain
Water Development project to follow up with preliminary work they
have performed with the completion of plans and specifications as soon
as possible with the view toward commencing construction in the spring
or summer of 1963."

622-28 RELATING TO COSTS OP UCALL BLBCTION
The City Clerk read the following determination of costs relating to
recall elections pursuant to Section 35, City Charters
DETERMINATION OF COSTS RELATING TO RECALL BLBCTIONS PURSUANT TO SECTION 35
CITY CHARTBR
It is in the interest of the public good to provide for recall of irres-
ponsible off icera as determined by 25% of those eligible to vote for the
officer in question.
The opinion of the 25% aeqment who petitioned for the recall is ratified
or denied by all of those entitled to vote at a special election for the pur-
pose of recall.

If the recall action is ratified by the voters, the petitioners have pre-
sumably corrected an undesirable situation and have performed a service to
their city.
If the recall action is not succeaaful, either the officer was not in
error or his conduct was not considered to be sufficient ground for the recall
of the officer in question.
To promote responsible government, without harrassment the Election
commission has determined that the cost of an unsuccessful recall election
should be borne by those who sought the recall. The cost of a successful
effort should be borne by all the citizens as a cost of maintaining good
government.
To accomplish the above determination the Election Commission hereby
rules that the proponents of a recall petition shall file with the City Clerk
an amount of money or bond determined by him sufficient to pay the expenses
of such election if unsuccessful. If the recall action is successful, the
funds wil l be returned.
Further for the purpose of defining the responsibility in this matter,
the first three petitioners whose names appear on the recall petition shall
post bond or deposit the funds required for the conduct of the election until
the out~ome is known.
This determination is hereby transmitted to the City Council for its
consideration and implementation as may be required.
Adopted this 7th day of February, 1963 by order of the Election
Commission.
Chairman-Election Commission
The City Clerk, Ex-Officio Chairman of the Election Commission, explained
that the determination had been made following inquiry as to various procedures
of recall elections and who would bear the cost of the same. He suggested
that the determination be referred to the City Attorney for review and recom-
mendation to the City Council as to the manner of its implementation if legal.
(The Mayor returned and assumed chairmanship at 9:20 P.M.)

WHEREAS, paving improvements in Paving Diatrict No. 12, Englewood,
Colorado, have been satisfactorily completed, and have been accepted by the
City of Englewood: and
WHBREAS, a statement showing the whole coat of said improvements and a
proposed apportionment of the same on the property in said District has been
filed in the office of the City Clerk1 and
WHEREAS, the City Council haa conaidered the benefits accruing to each
lot or tract of land in said Diatrict by reaaon of the making of said paving
improvement•, and has determined that the apportionment of the assessments
for said improvements, as set forth in the following Notice, is in accordance
with such benefits:
NOW, 'nfEREFORE, BE IT RESOLVED That the Clerk of this City be, and he is
hereby authorized and directed to notify the owner• of the property to be
assessed for said improvements by advertiaement in four consecutive weekly
issues of The Englewood Herald and Bnterpri•• and Presa, a newspaper published
and of general circulation in the City of Englewood, that said improvements
have been completed and accepted, that the coat thereof has been apportioned
according to benefits and that a Hearing on the aaaeaaments will be held at
the time and place specified in the Notice:

NOTICE IS HEREBY GIVEN: That the improvements in Paving District No. 12,
Englewood, Colorado, which were authorized by Ordinance No. 10, Series 1962,
finally adopted and approved on the 11th day of April, 1962, have been com-
pleted, that the same have been accepted by the City Engineer and the City
Council of said City of Englewood and that the coat thereon has been apportioned
against the real property in said District according to benefits.
NOTICE IS FURTHER GIVEN:

1. That the whole cost of said improvements has been definitely ascertained ,
and is in the sum of $371,553.00, said amount including costs of inspection,
collection, incidentals and interest as allowed by law.
2. Of the whole cost stated in paragraph 1, the City of Englewood will
pay $94,914.79, leaving the sum of $276,638.21 to be assessed against the
real property in said District for the cost of aaid improvements.
3. That the share apportioned to and upon each lot and tract of land
within said District and assessable for said improvements is as follt.ws:

631-14 RELATIJr& TO REDISTRICTING OF CITY
The City Manager stated that maps of the City showing the tentative
Election Commission efforts at redistricting were available for consideration
by members of the Council.
• The City Clerk, Elt-Off icio Chairman of the Election Conunission, discussed
he proposed boundaries and stated that full information would be made
available for the Council at its next informal meeting.
The City Manager stated that due to the fact the r .. istricting must be
completed at least six months prior to the next regular election that action
must be taken upon the redistricting oa or before March 18th with passage
of the ordinance on second reading on April lat. He urged that the matter··
be considered in advance of that if poaaible, auggeating action at the
March 4th meeting.

STREET LIGHTS IN CENTENNIAL ACRES
The City Manager reported that installation of atreet lights was complet~
in the newly annexed area of Centennial Acre• and that they were turned on on
February 14th.
OBJECTIONS TO PAVING DISTRICT NO. 13
The Mayor reported that many letters had been received objecting to the
over-lay improvement in the 2700 block south Sherman as proposed in connection
with the creation of Paving District No. 13. Be suggested that the City
Manager have the residents of the area contacted and made familiar with the
improvement proposed. Councilman Braun suggeated that a study be prepared
and made available as to the maintenance coat in volved on streets proposed
for over-lay and that what additional coat might be anticipated in the near
future if the over-lay program is not completed.
URBAN MAYORS' ASSOCIATION
The Mayor announced that the next regular meeting of the Urban Mayors'
Association '#Ould be February 21st.
PLANNING OFFICIALS CONPBRBNCE
The City Manager reported that he and two Councilmen and two members of
the Planning Commission as well as Mrs. Romana had attended various sessions
of the recent Planning Institute held in Boulder. Be reviwwed the action
occurring at the conference.
RELATING TO ADDITIONAL SCHOOL AID
The Mayor reported that he had met with a group of mayors, school
officials, and oth~r interested parties at the State Capitol Building to
discuss the school aid with Governor Love. The Mayor expressed the opinion
that the meeting had borne some fruit.
