HomeMy WebLinkAbout1963-02-25 (Recessed) Meeting MinutesRECESSED MEETING: COUNCIL CHAMBERS CITY OF ENGLEWOOD, COLORADO FEBRUARY 25, 1963 The City Council of the City of Englewood, Arapahoe County, Colorado, met in recessed meeting on Monday, February 25, 1963, in the Council Chambers, City Hall, Englewood at the hour of 8:00 P.M. Mayor Brownewell presiding called the meeting to order after recess from 10:10 P.M. on Monday, February 18, 1963. Upon the call of the roll, the following persons were present: Councilmen: Braun, Miles, Parker, Woods, Brownewell. Also Present: City Manager Dial, City Attorney Esch, City Engineer Davies, City Clerk Beausang. Absent: Councilmen Love, Smukler. The Mayor declared a quorum present. 622-37 PUBLIC HEARING ON PAVING DISTRICT NO. 13 COUNCILMAN WOODS MOVED, COUNCIIMAN PARKER SECONDED, THAT THE PUBLIC HEARING ON THE FORMATION OF PAVING DISTRICT NO. 13 BE OPENED. Upon the call of the roll, the vote resulted as follows: Ayes: Councilmen Woods, Parker, Miles, Braun, Brownewell. Nays: None. Absent: Councilmen Love, Smukler. The Mayor declared the motion carried. The City Manager gave a resume of the streets to be included in the proposed District and the procedure through which streets were proposed for inclusion in the District. The City Engineer explained the street improvement program and what the respective costs for curb, gutter, sidewalk and complete street construction as well as over-lay street construction. The Mayor acknowledged the presence of many people to secure informa- tion and to protest the improvement of certain streets. He stated that considerable number of protests had been received with regard to the improve- ment of 2700 South Sherman and 3000 South Acoma. The City Clerk read the names of those who had written letters to protest the over-lay improvement of the 2700 block South Sherman as follows: Mr. Max Hungate, 2778 South Sherman, Dick and Florence Schafer, 2765 South Sherman, Melvin R. Burgess, 2797 South Sherman, Jessie B. Smith, 2701-2709 South Sherman, Mrs. Helen Lois Giffin, 2740 South Sherman, Mr. and Mrs •• Adolpho Olrieda, 2741 South Sherman, Mrs. Maggie L. Lintecum, 2788 South Sherman, Mrs. B. J. Vanderlust, 2762 South Sherman, Mary Lillian Batchler, 2731 South Sherman, Mr. and Mrs. w. L. Prime, 2729 South Sherman, Mr. and Mrs. Loren D. Hilton, 2739 South Sherman. Mrs, Mildred A. Stevens, and Mrs. Beatrice A. Doty, co-owners, 2763 South Sherman, Mrs. Flora Anderson, 2766 South Sherman, Mr. Robert M. Cooper, 2754 South Sherman, Two petitions and a letter protesting the over-lay of the 3000 block South Acoma was also read. "A PETITION OF PROTEST We the undersigned owners and taxpayers on the west side of the 3000 block of South Acoma Street do hereby protest to the overlaying of our street for the following reasons: lst ••• that said street is in good condition. 2nd ••• that said street is not heavily travled by trucka, etc. 3rd ••• an un-necessary expense added to our taxes." I :I I 11 ,, 'I I ·1 Minutes of February 25, 1963 The Mayor asked for those who wished to protest the paving of the 2700 block of South Sherman and the 3000 Block South Acoma Street to apeak on this matter. Mr. John E. A. Rusk, 3000 South Acoma, read in full a copy of his letter referred to by the Clerk. He asked that the over-lay of the 3000 block South Acoma be postponed in favor of the paving of the alley between Acoma and Broadway in the 3000 block. Other owners who had submitted protest letters spoke to the Council in this regard. The City Engineer explained that various streets were scheduled for over- lay with 2 inch black top to retain the pav~ street which exists and in many cases the condition of the present street to ;•· c'asual inspection is good. He stated though that the asphalt was no longer plyable and would rapidly b•eak up if not protected by an over-lay in the very near future. He stated that in certain cases one or two years could pass before the need for a complete recon- struction and renewal of the base uder the old black top would be required. He emphasized that the over-lay program was a program designed to save the taxpayers money and called their attention to the price of $2.45 per front foot mor ~over ~lay with that of $4.65 for complete paving, Discussion ensued. The Mayor asked that the City Clerk read other written protests to the various improvements proposed. The City Clerk read a protest against the improvement of the 2800 block South Lincoln Street by Darrell F., Kenneth E. Cornell and Cleta L. Carr: A protest against the paving of the 2900 block South Grant by Gertrude w. Bynes: A protest against the formation of Paving District No. 13 by Damon L. and Mona M. Huntage: A protest against the assessment of the improvement of West Oxford Avenue against smaller property owners due to the heavy traffic thereon by Ray and Anna Sunderlin: A protest of the paving of East Cornell by Mrs. Beula I. Pinyan: A protest of the paving of the 2800 block South Lincoln Street by Fred c. and Margurite E. Stake: A protest of the paving adjoining 2795 South Cherokee Street and protest- ing more particularly the installation of sidewalk by Harld L. and Dorothy R. North: Further oral statements were made by Mr. Howard H. Dumbald, 2825 South Sherman, Mr. Melvin R. Burgess, 2797 South Sherman, Mr. Monte Pitman, 3347-49 South Lincoln, Mr. Edward Exkstein, 1050 East Dartmouth Avenue, Mr. William Brnst, 3190 South Lincoln, Mr. Fred Adams, 2801 South Grant, Mr. and Mrs. Bd Hill, 3285 South Elati, Mr. Dean Richards, 2840 South Clarkson Circle, Mr. Robert T. Slagel, 2830 South Clarkson Circle, Mr. Homer Todd, 3258 South Elati, Mr. Roy Guanero, 3250 South Elati, Mr. Redmond Weaver, 1050 West Oxford, Mr. Fred Braun, 3100 South Washington, Mr. Warren Brahmsteak, 3065 South Sherman, Mr. Dennis Fetters, 2828 South Grant, Mrs. Elsie M. Questions were answered and methods of assessment dxplained. COUNCIIHAN PARKER MOVED, COUNCii.MAN MILES SECONDED, '111AT THE PUBLIC HEARING BE CLOSED. Upon the call of the roll, the vote resulted as follows: Ayes: Councilmen Woods, Parker, Miles, Braun, Brownewell. Nays: None. Absent: Councilmen Love, Smukler. The Mayor declared the motion carried. RECESS The Mayor called a recess of the Cuncil until 10:45 P.M. CALL TO ORDER The Mayor called the meeting to order at 10:45 P.M. with the following members present: Councilmen Braun, Miles, Parker, Woods, Brownewell. The Mayor declared a quorum present. Minutes of February 25, 1963 Councilman Braun inquired whether the over-lay of the 2700 block South Sherman and the 3000 block South Acoma could be postponed for a year or two without losing the base on those streets requiring a complete repaving. The City Bngineer stated that this postponing would forestall the improvement for a year or two at the most with a very great risk that reconstruction would be necessary. He stated that in the case of South Sherman it was planned to have South Sherman improved from Yale to Eastman in Paving District No. 13. Discussion ensued. COUNCii.HAN BRAUN MOVED, COUNCILMAN PARKBR SECONDED, THAT THE 2700 BLOCK SOUTH SHERMAN AND THE 3000 BLOCK SOUTH ACOMA BB STRICKEN FROM THE OVER-LAY PROGRAM OF PAVING DISTRICT NO. 13 DUB TO BFPORT ON THE PART OF THE COUNCIL TO AVOID DOUBLING OF ASSESSMENTS CAUSBD BY IMPROVBMBNTS OF FRONT AND SIDE STRBBTS IN THOSE ARBAS AS WELL AS A CLEAR .MAJORITY OF THE OWNERS INDICATING THEIR OPPOSITION TO THB PROPOSBD IMPROVEMENT, AND THAT THB ABOVE STRBBTS BE SCHEDULED FOR INCLUSION IN FUTURE PAVING DISTRICT ON FINDINGS AND RBCCMMENDATION BY THE CITY ENGINBBR THAT FURTHER DELAY WILL RBQUIRB RECONSTRWCTION OF THE STRBBT RATHER THAN OVER-LAY IMPROVEMENT, AND THAT THB BALANCB OF THE STRBETS AND ALLBYS SCHEDULED FOR IMPROVEMENT IN PAVING DISTRICT NO. 13 BE APPROVED AND RATIFIED. councilman Miles discussed the advantage of a one or two year postponement and questioned the real value to the property owners. Discussion ensued. councilman Miles inquired of those property owners still present from the areas as to their wishes. Result was that the owners preferred postponement. Upon the call of the roll, the vote resulted as follows: Ayes: councilmen Woods, Parker, Miles, Braun, Brownewell. Nays: None. Absent: Councilmen Love, Smukler. The Mayor declared the motion carried. ADJOURN COUNCii.HAN PARKER MOVED, COUNCILMAN MILES SECONDED, THAT THE MEETING BE ADJOURNED.
