It i• the further intent that no land within th• boundari•• of the City of Bn9lewood •hall be without a zone Diatrict deaiqnation. If, for any reaaon, any land within the boundariea of th• City of Bn9l.wood ahall be deterained not to be within one of the aforeaaid Diatrict, whether auch determination reaulta from annexation, from judicial declaration, or from any other reaaon or cauae, then, and in that event, no permit• •hall be iaaued for the erection or alteration of any atructure or atructurea in the area found wantin9 in claaaif ication until the area haa been examined by th• co .. iaaion and th• council and a zone claaaification enacted and eatabliahed therefor. He read a Court Order issued by the Diatrict Court of Arapahoe County to the effect that the City Council should review its reasons, for refusing issuance of the license and clarify them fo~ the Courts consideration. He discussed the report with the Council. Diacussion ensued as to means of replacing the revenue lost by the repeal of the ordinance. I The City Manager asked that a decision on the matter be set forth on o~ before the aecond Council meeting in July so that he '#Ould have the benefit .of the Council'• intentions ~n .connection with the presentati~n of the Budget. Dial's verbal re- quest of the reasons for the Board's recotnmendation, in the 1964 Classification and Pay Plan, to advance Patrolmen II to Patrolmen I effec- tive January 1, 1965 tather than January ·~. !96~-as reeommended for the Firemen 2nd Class. Mr. Dial had exp~e~aed ·that he ~felt bc)th Departments should be treated equally in such · a reconanendation.---Mr. Carleno recalled the reason to be that advancement of some of the Patrolmen II '#Ould bring about such an increase in pay that it would be equal or about equal to the encumbents now in the promotional position of Detective tank. This might create a salary inequity which could be avoided if the recommendation were extended to January 1, 1965 allowin3 the present Detectives to attain an additional step and in the meantime bringing about a sufficient spread due to the fact that Patrolmen II could climb no higher than the F step in their qrade. Board members reviewed and discussed the matter further and then instructed the Personnel Director to initiate a ·memorandum to the City Manager advising him that the reason for moving the effective date up to January 1, 1965 for advancement of Patrolmen II to Patrolmen I, was due to the fact that the Detectives would be back at the same level as several of the advanced Patrclmen I and thereby create an inequity in salary versus length of service in Grade: also, the Board felt that Mr. Dial should discuss this situation with the Chief of Police. Board meltlbers indicated that they had no objections to this recommendation being changed ' to January 1, 1964 should the City Manager and the Police Chief feel that it would be in the best of interests." The City Manager discussed the possibility of accelerating the change of status by making the change effective January 1, 1964 and recommended that the Council favorably consider h~s proposal. The City Manager stated that he had discussed securing a consultant for review of the downtown area and its needs but had nothing to report in particular. The City Manager stated that a letter had been received from the State Highway Department indicating desire to consider continuing left turns at South Bannock and Highway 70 but not a definite conunitment. He reviewedthe plan which has been dis- cussed putting in activated left turn signals at the intersection to improve traffic flow. He said that the program would cost approximately $850.00 for the installation. He indicated that 10 days to 2 weeks would be necessary .for the installation and he would proceed immediately, as there were sufficient funds in the Public Improvement Fund to finance the program if the Council desired. The Mayor declared the motion carried. 631-52 RELATING TO CHAMBER PROGRAM FOR ACTION The City Manag~r spoke further on the matter of a consultant and indicated that although he had talked with promising persons who desired to do the work: he recom- mended that the Charnbe~ Committee itself determine the consultant and duties. He estimated that the cost might be as great as $15,000.00 even with as much of the detail as possible done by City forces. The Mayor and Council agreed to the proposal as outlined by the City Manager and suggested that each Councilman consider possible appointments to the Committee for discussion at the next informal meeting of the Council. 631-11 TREASURER'S REPORT FOR MONTH OF MAY,_ 1963 COUNCILMAN PARKER MOVED, COUNCILMAN WOODS SECONDED, THAT THE TREASURER'S RJ5PORT FOR MAY BE ACCEPTED. The Mayor declared the motion carried. 631-73 RELATING TO VACATION SUBSTITUTE FOR MUNICIPAL JUDGE ' The City Attorney reported that Judge Robert Kelley had requested a temporary replacement to be appointed during the time of his vacation, namely July 7th through July 20th. He stated he had no recommendation on the matter but that Judge Kelley would make a suggestion prior to the next regular meeting. Councilman Parker sug- gested Mr. Harry Carleno for the position. The City Attorney stated he did not believe it would be legal as Mr. Carleno is on the Board of Career Service Conunia- sioners and a person may not hold more than one position. RELATING TO DRAINAGE DITCH BETWEEN EAST DARTMOUTH AVENUE AND EAST EASTMAN AVENUE The City Manager announced that Mr. Don Jeltma was present to discuss the pro- posed enclosing of a drainage ditch between East Dartmouth Avenue and East Eastman Avenue. The City Manager expressed his viewpoint that the City has some responsibility for the ditch as it is in a right-of-way as well as the City gaining by such covering. He stated that Mr. Jeltma offered to share the cost equally with the City. Discuaaion enaued. Councilman Parker doubted if the City had one-half liability. The City Manager explained further the reasons for his suggestion of half participation by the City. The Mayor questioned whether if the City entered into the project if it did not assume certain liability by this action. The City Attorney replied that if the drainage facility is not properly engineered Minutes for June 17, 1963 that the City would become liable for any damage which might result as an effect of such covering. Councilman Braun discuased the blocking of the drainage grates by hail during the last stellrm and expressed the view that the City could not prevent such blocking. The Mayor asked if a serious precedent was not being established. Discussion ensued. CITY MANAGER'S CHOICE ' The City Manaqer reported that the Street Department had carted more than 30 truck loads of hail from the streets and public ways of the City and put in long periods of overtime duri~g the period of emergency. He reported that very little damage was caused in Scenic View through settleing of the trenches that there had been considerable settlement. He estimated that the total cost to the City in all areas was approximately $15,000.00 and that was spent in payroll. 622-37 RELATING TO PAVING DISTRICT NO. 13 The City Manager reported that 'two sections of street right-of-way needed to be secured for the canpletion of Paving District No. 13. He gave the areas as right-of-way in south Acoma Street in the 4600 block and West Stanford Avenue between Delaware and Elati Streets. He asked that the City Attorney be authorized to condemn if not able to reach an agreement and secure inunediate access. Brownewell City of Englewood, Colorado Dear Sir: Minutes for June 17, 1963 I am writing in regard to your letter of May 9, 1963, concerning my name which appeared on the petition for intervention in the Beau Monda Co. v. Wallace, et al. First I would like to state that my name appeared on this petition through an error, and was removed immediately after I was apprized of this action. At a meeting of the Englewood Merchants Association which I attended, several subjects were discussed, which required the services of the Merchants attorney. One was the names of taxpayers, who were to appear on petitions concerning inequities existing between shopping centers, and downtown businesses. Another subject was the Merchants Asaociation intervention in the above case in question. My name at no time mentioned to appear on any of the petitions. In your letter, you mention certain statements made by my attorneys. There is only one attorney involved in this matter, and he is employed by the Englewood Merchants Association. I have never questioned the integrity of the City council or any other official of the City, either publicly or privately. This letter is merely a formal conformation of a previous statament which was published by the Englewood Herald, made to the City Attorney, and several members of the Council. He atated that Mr. Hill's letter had not changed his opinion on the matter. COUNCILMAN'S CHOICE Councilman Parker inquired if he could be relieved from membership on the W~ter Board. He stated that at the present time of the meetings conflicted with his business hours and he was unable to attend and disliked being a member of a Board when he could not be active.
