The City council of the City of Englewood, Arapahoe County, Colorado, met in
reqular ••••ion on Monday, October 21, 1963, in the Council Chamber•, City Hall,
Bnglewood, at the hour of 8:00 P.M.
Mayor Brownewell presiding called the meeting to order and the invocation was
given by the Reverend o. F. Reeg of the Grace Lutheran Church.
The Mayor asked for roll call. Upon the call of the roll, the following persona
were present:
Councilmen: Braun, Kreilinq, Love, Milea, Parker, Brownewell.
Also Present: Actinq City Manager Malone,
City Attorney Esch.
City Engineer Davies,
City Clerk Beausanq.
Abaent: Councilman Woods.
The Mayor declared a quorum present.

632-15 PROCEEDINGS OF CITIZENS ACTION COMMITTEE MEETINGS OF OCTOBER 9TH AND 16TH
The Mayor asked that the minutes be received and placed on file.
632-71 Relating ,.1:2 Creation of Urban Renewal Authority
The City Attorney reported that it waa recoaaended in the meeting of October
16th that the Citizen's Action Committee circulate a petition to establiah an
Urban Renewal Authority and that the Committee recoaaend to the City Council that
they eatabliah aaid Authority. He, therefore, reported that the procedure for
eatabliahing an Urban Renewal Authority waa to have a petition prepared and signed
by twenty five citizens, which petition when filed with the City Clerk is the
baais for a public hearing on the matter. He informed the Council that the City
Clerk calla and advertises the hearing at which time the City Council reviewes
the request and if favorable to the request, conaidera an ordinance to organize
the Authority. Discussion ensued.
Mr. Jack Eachon, Bachon, Executive Vice-Preaident, First National Bank of
Bngl9WOOd, member of the Citizens Action Conmittee, informed the Council that the
Citizen'• Action Connittee planned to prepare and circulate petitions to organize
the Authority. He diacussed provisions of the law under which Urban Renewal
Authorities are established and the reason for caution by the Committee in posaibly
and properly initiating the Authority. Discuaaion enaued aa to the legal actions
available through the Authority.
632-72 Relating ,.1:2 call for Special Election .'21: Sale .2! City Park Land and Related
Subjects
Councilman Love referred to the recommendation of the Citizen's Action Conmittee
that the City Council draw an ordinance to call an election as soon as possible
to diapose of the Park Land, to establish a commercial uaage in the park area,
and for a bond issue to allow the acquisition of the Norgren Plant for a City
Ball. Diacuasion ensued.

The Acting City Manager reported that the appraiaala requested by the City
Council in connection with other City owned land which might be disposed of in
connection with the development of municipal building plan• had been secured. He
augqeated that perhaps the contract should be extended to include an appraisal of
the City Park land and other City owned land in the vicinity. Discussion ensued.
Councilman Kreiling expressed his concern that the City would become liable for
aubatantial fiscal and legal fees. The City Attorney atated that before any major
coanittmenta of moniea were made he would secure Council approval.

"The Board of Adjustment and Appeals recommends the following requests for
encroachment upon City Property:
c. L. Welborne, 3224 s. Delaware Street, who requested permission to erect
a retaining wall approximately 12 inches high to be sloped back from City
sidewalk: and B. H. Evans 843 E •. oartmouth Avenue, who requested permission
to erect a 30 inch retaining wall approximately 12 inches behind the City
sidewalk along the south property line. Both of the retaining walls would
be located upon City owned property."

SECTION 4. That during or at the close of the fiscal year of 1964, any surplus
money in any of the respective funds, after all claims for 1964 against the same
have been paid, may be distributed to any other fund or funds in the discretion
of the City Council.

COUNCILMAN PARKER MOVED, COUNCILMAN MILBS SBCOHDED, THAT THE PROPOSED BILL

ARD ~ENTERPRISE.
The Mayor recognized Mr. Robert E. Slyter, 4147 South Lincoln Street, who
wished to speak. Mr. Slyter inquired about the budget of $64,000.00 for Parks
and Recreation. He suggested that this expenditure be done away with until the
matter of dissolution of the South Suburban Metropolitan Recreation District
waa determined. The Mayor explained that it waa not poaaible for the City to
abandon its Parks and Recreation facilitiea and that he recognized Mr. Slyter's
concern as he was also concerned about the matter. Councilman Braun commented
that Englewood taxpayers were receiving more than the value of their taxes which
went into recreation in Englewood.

632-20 PROVIDING FOR ENGINEERING STUDY FOR SARITARY SBWER NEEDS
The Acting City Manager referred to a memorandum from the City Manager
aetting out that the City Council had asked that the engineering work on the
relief of the overloaded sanitary sewers in varioua part• of the City be com-
pleted so that a project could be undertaken in the near future. He reported
that the City Engineering Department has project• including Paving District
No. 13, proposed Paving District No. 14 and the Scenic View Sanitary Sewer
District in progreas and cannot feasibly work the engineering required into
a schedule which would provide plans and specification• ao that the contract
could be let thia Spring.
The Acting City Manager reported that City Bngineer Davies was in atten-··
dance to discuss the engineering requirements involved and to recommend an
engineering firm who would be qualifed and suitable to assist in the engineering
of the overloaded sanitary sewers in Englewood. 'ftle City Engineer indicated
the critically overloaded sanitary sewer line• of the City and discussed pos-
sible solutions. He also suggested the posaibility of conatructing sewer lines
from auch size capacity whereby the Cherry Hilla area could be included in the
collection system of the Englewood sewage tr .. tment plant. In this connection
he emphasized to· the City Council that the present plant is operating at only
fifty-five per cent of capacity. Discussion enaued.
The City Engineer reported that he had contacted several engineering firms
and that a local consulting engineer and company of Parker and Underwood, Inc.
was reconmended. The City Council was given copiea of a letter written to the
City Engineer ; setting forth recent job• they have completed as well as their
intereat in working with Englewood. The City Engineer estimated that the cost
for the study would be $2,000.00 to $4,000.00. Diacuaaion enaued. The City
Engineer confirmed that if the plans and field work were completed that speci-
fications, bidding and inspections could be provi•ed by the department.
Discussion ensued. The Acting City Manager recommended that the City Council
authorize an agreement with Parker and Underwood, Inc. for this engineering
study and plans.

The City Clerk reported that he had received a reaolution from the bond
attorneys authorizing the publication of a notice of aewer aaaea ... nt in connec~
tion with the completion of the Scenic View Sanitary Sewer Diatrict. He read the
following resolution:

Bnqlewood, COlorado, have been aatisfactorily completed and have been accepted
by the City of Englewood: and
WHEREAS, a atatement showing the whole coat of aaid improvements and a
propoaed apportionment of the aame on the property in aaid District has been
filed in the office of the City Clerk: and
WBBRBAS, the City council has conaidered the benefit• accruing to each lot
or tract of land in said District by reaaon of the making of said sanitary sewer

NOTICE IS HEREBY GIVEN: That the improvement• in Scenic View Sanitary
Sewer Diatrict, Englewood, Colorado, which were authorized by Ordinance No. 24,
Series 1962, finally adopted and approved on the 4th day of September, 1962,
have been completed, that the same have been accepted by the City Engineer and
the City council of said City of Englewood and that the cost thereon has been
apportioned against the real property in said District according to benefits.
NOTICE IS FURTHER GIVEN:
1. That the whole cost of said improvement• baa been definitely ascertaiaed,
and is in the sum of $295,525.73, said amount including costs of inspection,
collection, incidentals and interest as allowed by law.
2. Of the whole cost stated in paragraph 1, the City of Englewood will
pay $44,950.23, leaving the sum of $250,575.50 to be assessed against the real
property in said District for the cost of said improvements.
3. That the share apportioned to and upon each lot and tract of land

RBLATIRG TO SALB OP PARK LU1D
Mr. M. M. Summer• •poke to the Council •• a non-acheduled citizen aa to who
had the right to diapoae of parka. He expreaaed the view that the parka belong
to the people and the City Council did not have the right to aell or contemplate
aale of the parka without approval. Mr. Summer• went further to indicate that
the City Council do•• not have authority to initiate an ordinance for an election
to provide for the aal• of the park.
He expr•••ed hi• objection to the ••lling of any public property to provide
private commercial advantage•. Be remarked that in the particular caae all
arrang .. enta had been made, option• taken without the conaulting of the peopit,
the true owner•. He remarked upon the meaning of the word •a1um• and•blighted•
uaed in connection with the propoaed organization of the Urban Renewal Authority
and contended that no auch area• exiat.
Be apoke to the Council that he waa not againat buain••• or conaercial
developnent but objected atrongly to the aacrif ice of Bngl.wood City Park in
order to accompli•h commercial development. He ·atrongly adviaed the Council
that proteata againat the uae of the park would not be lightly awept aai•e.
'l'he Mayor replied that the Council does not sell park land that it will aet
an election and if the people deaire to diapoae of tie park then it would act
on their behalf to aecure the aale. He asked Mr. Sumner• if th• preaent park
and it• facilitiea could be doubled elsewhere would he not be in favor. Diacua-
aion enaued. 'l'he Mayor apoke further of the individual member• of the Council
and their paat and preaent aupport and interest in park and recreation.
councilman Kreiling reported that every possible fact will be preaented to the
people ao that they may vote upon the poasible sale of park land with all the
information they need for auch a decision.
RBLATIRG TO SCHOOL TRAPPIC LIGHTS
Mra. John Keifer, 3255 South Cherokee Street, and Mr. Robert Slyter, 4147
South Lincoln Street, aaked if the locations of achool light• to be improved
had bean determined. The Acting City Manager reported that they had not been.
Mr. Slyter then apoke for converaion of the light at the corner of South Logan
Street and Baat Lehigh Avenue near Lowell Elementary School and the Senior
Bighahool. He atated that at this location a child had been hit by a car and
therefore, ahould be placed on the liat of those to be improved. Be apoke also
of the need for pedestrian aiqnala at South Logan Street and Baat Mansfield
Avenue. He reported that the amall child could not aee the traffic aignal
light auapended in the center of the intersection and did not know when it waa ••1'11 to cross the atreet.
Councilman Kreiling apoke of the recent incluaion of a achool aignal light
in the Cherry Billa Village School Diatrict budget. He remarked that Englewood
haa aufficient money without help to inatall four interaectiona thia coming year.
With help of the School Diatrict, Parent Teacher• Aaaociationa and other inter-
eated parties and group• he expresaed the belief that all 20 achool signal• could
be converted next year.
Councilman Braun alao apoke on thi• matter, atating that the people pay for
the inatallation of achool light• whether it be by the School Diatrict, by the
City, by the Parent Teacher• Aaaociation or what other mean• might be available.
The Mayor coaaented on the discuasion stating that at the public hearing
on the annual budget the matter of conversion of achool light• waa first brought
to the Council'• attention. He remarked that the desire• of the people could
not be reflected in a budget unleas they are matte known to the Council in advance
of the conaideration of the budget for adoption.

The Mayor announced to the City Council that a apecial water Board meeting
had been called for Tueaday, October 29th at 5:00 P.M. to diacuaa the bi•• re-
cently re~ived for the construction of the Meadow Creek-Waldon Pipeline.
COUHCIIllAR'S CHOICE
Councilman Parker asked1aboat Mrs. curry. The Acting City Manager atated
tbat the Building Departmen~ had contacted her :and the property was presently
for sale. If not sold the Board of Adjuatment ia prepared to reconsider her
caae upon the condition that the original building be torn down after the
garage ia converted for dwelling.
Councilman Parker inquired about the drainage problem in the 4300 block
South Pennsylvania. The Acting City Manager reported that he would contact the
owners of that property with regard to securing a drainage eaaement.
Councilman Parker also reported that a Mr. Prank o-n, 3396 South Bmeraon,
ahould be contacted with regard to the clarification of hi• requeat for the
inatallation of a bathroom which for some technicality haa been refused. The
ActiCUJ City Manager stated that he would have the Building Inapector investigate.
