HomeMy WebLinkAbout1963-12-09 (Special) Meeting Minutes220 SPECIAL MEETING: COUNCIL CHAMBBRS CITY OF ENGLEWOOD, COLORADO DECEMBER 9, 1963 The City Council of the City of Englewood, Arapahoe County, Colorado, met in Special Se•sion on Monday, December 9, 1963, in the Council Chambers, City Hall, Enqlewood, at the hour of 8:00 P.M. Mayer Brownewell preaiding called the meeting to order and stated the purpose of the meeting was to discuss the proposed legialation regarding the South Suburban Metropolitan Recreation and Parka Diatrict. The City Clerk read the notice of call by the Mayor for a apecial meeting of the City Council to be held on Monday, December 9, 1963 at 8:00 P.M. for the expreaa purpoae of diacuaaing the legislation of the South Suburban Metropolitan Recreation and Park• Diatrict. He stated that the Mayor had signed the notice and five of the Councilmen present had acknowledged receipt of the notice. The Mayor asked for roll call. Upon the call of the roll, the following per.on• were preaent: Councilmen: Braun, Kreiling, Miles, Parker, Wooda, Brownewell. Alao Preaent: Adminiatrative Assistant Malone, City Attorney Each, Aaaiatant City Attorney Myrick, City Clerk Beausang. Abaent: Councilman Love, City Manager Dial. The Mayor declared a quorum present. 632-86 RELATING TO PROPOSED LEGISLATION REGARDING PARKS AND RECREATION DISTRICT The Mayor stated that a copy of the propose41 bill for conaideration by the State Legislature was mailed with each notice of the meeting. He asked the City Attorney for his comments. The City Attorney stated that he was aurp~ised but pleased that Mr. McMartin, Attorney for the South Suburban Metropolitan District, had drafted the propoaed bill. Be atated that Bill Myrick and he had gone over the proposed bill and that, although there were minor point• they diaaqreed with, they thought the bill waa a good one. Be stated that aa Mr. Myrick was present he would like to have him review the features and proviaiona of the bill. The Assistant City Attorney discussed the bill in detail and reviewed the procedure for a Home Rule City to seek exclusion from a diatrict. 'l'hia procedure ia as follows: 1. The City filea ·with the Board a petition praying that the ownerw of all real and peraonal property located within the boundaries of the City that are alao in the boundariea of the District be excluded therefrom: 2. The Board review• the petition, either approved it or denies the same. If approved the Board ahall order that the question of exclusion of the property be aubmitted to all taxpaying electors of the entire Diatrict if a majority of the votes caat at the election are for the excluaion of the property the Board •hall make an order to that effect and file with the County Clerk and thereupon said property shall be excluded. If the petition i• denied this denial ahall be baaed upon the beat interest• of the District. Diacuaaion enaued. Mr. Colbert Cushing, Chairman of the Englewood Recreation Commission, in- quired whether a letter of intent in advance from the Diatrict would help in the paaaage of the le9ialation. (City Manager Dial entered at 8:17 P.M.) Aaaistant City Attorney Myrick replied that as a propoaed legislation was prepared by south Suburban Diatrict that he doubted if any further commitment waa necessary from them. He apoke of other remedies •till open to the City including the dissolution of the Diatrict. He connented that there would be neceasity for arranging for the dissolution or liquidation of the District'• aaaeta in the City. He atated that tentative gift of these lands and improvements to the City ha• been proposed to the District. Councilman Wood• aaked what i• required. The Mayor atated that a simple atatement of the Council not to oppose i• all that ia needed. He polled the mem- ber• of the Council Elect who were present and all indicated their favor. ADJOURN COUNCILMAN BRAUN MOVED, COUNCILMAN MILES SECONDBD, THAT THE MEETING BE ADJOURNED. Upon the call of the roll, the vote resulted as follows: Ayea: councilmen Braun, Kreilinq, Miles, ParJuar, Woods, Brownewell. Haya: None. Abaent: Councilman Love.
