Mayor Brownewell presiding called the meeting to order and the invocation waa given by the Reverend Allen B. Strong of the Pirat United Presbyterian Church. The Mayor aaked for roll call. Upon the call of the roll, the following peraons were preaent: Councilmen: Braun, Kreiling, Love, Miles, Parker,Woods, Brownewell. Aleo Preaent: City Manager Dial, Administrative Aasiatant Malone, City Attorney Bach, City Clerk Beausang. Absent: None. The Mayor declared a quorum preaent. 632-2 CONSIDERATION OF MINUTES OF PREVIOUS MEETINGS COUNCILMAN MILES MOVED, COUNCILMAN WOODS SECONDED, THAT THE MINUTES OF THE DBCDtBER 2ND MEETING BB APPROVZD' AS CORRECTED. Upon the call of the roll, the vote resulted as follows: Ayea: Councilmen Braun, Kreiling, Love, Milea, Parker, Woode, Brownewell. Naya: None. Absent: None • The Mayor declared the motion carried. ORDINANCE NO. 33, SERIES OF 1963 AN ORDINANCE APPROVING THE WHOLE COST OF THE IMPROVBMDTS MADE IN AND FOR SCENIC VIEW SANITARY SEWER DISTRICT, IN THE CITY OF DfGLEWOOD, COLORADO: APPROVING AND CONFIRMING THE APPORTIOHMEN'l' OF SAID COST TO EACH LOT OR TRACT OF LAND IN SAID DISTRICT: ASSESSING A SHARE OF SAID COST AGAINST EACH LOT OR TRACT OF LAND IN THE DISTRICT: PRESCRIBING THE MANNER FOR THE COLLECTION AND PAYMENT OF SAID ASSESSMENTS: AND DECLARING AN EMERGENCY. (Ol1dinance copied in full in minutes of December 2nd) waa read for the aecond time. Councilman Kreiling indicated that it waa nia opinion that Mr. A. G. Meyers, et al had been given too great an adjustment on their assessment and that tap feea should be charged for taps into the 15 inch line on the eaat of that pro- perty if and when made. Discussion enaued. The City Manager reviewed with the Council that ahortly after the completion of the conatruction of the sewer main in the district the Water and Sewer Board favorably conaidered a recom- mendation that no tap fees be charged those properties included in the district and assessed a cost of the construction of the sewer line. Absent: None • The Mayor declared the motion carried. 632-6 PROCEEDINGS OF PLANNING AND ZONING COMMISSION MEETING OF DECEMBER STH The Mayor aaked that the minutes be received and placed on · file. 632-5 PROCEEDINGS OF BOARD OF CAREER SERVICE CQ4MISSIONERS MEETING OF DECEMBER llTH The Mayor asked that the minutes be received and placed on file. 632-8 PROCEEDINGS OF PUBLIC LIBRARY BOARD MEETING OF DECEMBER lOTH The Mayeer asked that the minutes be received and placed on file. 632-3 PROCEEDINGS OF PARKS AND RECREATION COMMISSION MEETING OF DECEMBER lOTH The Mayor asked that the minutes be received and placed on file. 632-89 RELATING TO VACATION OF ALLEY BETWEEN LINCOLN AND SHERMAN FROM FLOYD TO GIRARD The City Manager stated that he had received a letter from Mr. Richard D. Casey of Casey and Klene representing St. Louis Catholic Church, requesting the vacation of the alley so that the Denver City Ditch could be relocated. The City Clerk read theletter in full. The City Manager presented a map of the area indicating the proposed relo- cation of the ditch. Discussion ensued as to the appropriate action on this matter. The City Attorney atated that he could prepare an ordinance for the vacation of the alley and have it available for consideration by the new council after its installation. The Mayor ordered the City Attorney to proceed in draft- ing of an ordinance to vacate the alley under discussion. 632-55 AMENDING MUNICIPAL CODE RELATING TO THE WORKING CONDITIONS OF CITY EMPLOYEES Introduced as a Bill by Councilman Woods BY AUTHORITY ORDINANCE NO. 34, SERIES OF 1963 AN ORDINANCE AMENDING SECTIONS 6.7-18, 6.7-20, 1.7-21 AND 6.7-22 OF THE MUNICIPAL CODE OF THE CITY OF ENGLEWOOD, COLORADO, RELATING TO l«>RKING CONDITIONS OF EMPLOYEES OF SAID CITY AND DECLARING AN EMERGENCY. (Bill for ordinance copied in full in official minutes of December 2nd) was read by title only. 224 Minutes of December 16, 1964 COUNCILMAN WOODS MOVED, COUNCILMAN LOVE SEC<BDED, THAT ORDINANCE NO. 34, SERIES OF 1963 BE PASSED ON SECOND AND FINAL READING AND ORDERED PUBLISHED IN FULL IN THE ENGLEWOOD HERALD AND ENTERPRISE. councilman Kreiling discussed overtime payments and requested that a report be prepared showing the amounts of overtime paid in the last several years. Discussion ensued. Upon the call of the roll, the vote resulted as follows: Ayes: Councilmen Braun, Love, Miles, Parker, Woods, Brownewell. Nays: Councilman Kreiling. AMent: None. The Mayor declared the motion carried. 621-42 RELATING TO SCENIC VIEW SEWER RIGHT-OF-WAY The City Attorney reported that he had been negotiating with Mr. Joe Berenbaum with regard to acquiring the last piece of right-of-way necessary for the construction of the Scenic View Sanitary Sewer District lines. He said the court issued an order for the construction of the sewer lines through the right-of-way desired but that the settlement for the right-of-way had not been accomplished. The City Attorney said that he believed Mr. Berenbaum would settle for the parcel of land appraised at $950.00. A• the difference is greater than the usual ten per cent which the City council allowed the City Attorney to neqotiate within,'he requested the City council to authorized his acquisition of the right-of-way at the $1,200. price. He commented that at the moment the money paid for acquisition of right-of-way including the Berenbaum property was less than the gross appraisal• for said rights of way. Absent: None • The Mayor declared the motion carried. 632-90 BUDGET ADJUSTMENTS AND TRANSFERS FOR 1963 The City Manager reported that in the case of the General Fund of the City it will be generally under the total appropriations for the year but a few departments will need a •upplemental appropriation. He pointed out that the under expenditures in other depar61ilents far exceed the additional required in the Municipal Court, Finance and General Government departments. He estimated that the total General Fund will be underexpended by nearly $25,000. Transfer from Improvement Preliminary Fund 'l'he City Manager reported that the City Treasurer had certified that there was an unencumbered and unappropriated surplus in the Improvements Preliminary Fund of $21,2ot.ll which is available for appropriation or transfer. The City Manager reviewed that the purpose of the Improvements Preliminary Fund was to meet the initial expenses of the organization of a district prior to the issuance of bonds l>r the improvement. Be stated that after the bonds were issued the Improvements Preliminary Funds were reimbursed for its initial coat. Where a district is not organized after the initial work has been done the coat of the initial phases are chargeable to the General Fund. Be recolllft8nded that $6,209.11 be transferred from the Improvements Preliminary l'und to the General Fund so that in turn the General Fund might repay the $30,000 transferred from Sewage Disposal Plant Fund to the General Fund to establish the Improvements Preliminary Fund capable to hancling three districts. Be stated that with the transfer, as requested, the Improvement• Preliminary Fund could meet the initial coat of the formation of two districts a* the same time. 'l'he City Clerk read the following resolution in full: RESOLUTION WBERBAS, it has been heretofore necessary to provide certain funds to the Improvement• Preliminary Fund for the purpose of making preliminary expenditures reqarding certain Improvement Districts: and WBBRBAS, various Improvement Districts have been completed and otherwise closed out: and WBBRBAS, the City Clerk-Treasurer has certified that there now remains an Unappropriated Surplus of $21,209.11 of which $6,209.11 ia no longer required for Preliminary Improvements coats: &OW, TBBREFORE, BE IT RESOLVED that $6,209.11 be transferred from the Improvements Pie~iminary Fund to the General Fund. Transferring Monies to Sewage Diapoaal Plant Fund The City Manaqer stated that a certificate had been provided by the City Treaaurer that over collection of revenues and under expenditure appropriation in the General Fund will reault in an unappropriated •urplua at year end in exceaa of $85,000.00. The City Manager stated that he had a resolution pre- pared to transfer from this unappropriated surplus $30,000.00 to the Sewage Diapoaal Plant Fund to repay that fund for a like amount tranaferred from that fund to the General Fund earlier this year. He stated that the original transfer vaa of a temporary nature and with the large unappropriated surplus anticipated he would reconnend its repayment. The City Clerk read the following resolution in full: RESOLUTION WHBRBAS, during the fiscal year of 1963 the City Council tranferrred $30,000. Unappropriated Surplus from the Sewer Operating Fund to the General Fund as a part of the financial transactions necessary to meet the obligations of the Improvements Preliminary Fundr and WHEREAS, it was the intent of the City Council to subsequently replenish the Sever Operating Fund by transferring to it from the General Fund the said $30,000 heretofore referred to: and WHEREAS, the City Clerk-Treasurer has certified that there is an unappropriated caah balance at this time sufficient to cover the required supplemental appropria- tion: HOW, 'nlEREFORE, BE IT RESOLVED THAT $30,000.00 Unappropriated Surplus be trans- ferred from the General Fund to the Sewer Operating Fund. Additional Appropriation for Water ~ Sawer Funds The City Manager reported that due to extremely dry summer which required the expenditure of Water Fund monies for development of wells and unusually high pumpinq and cheaieal coats that the water Fund needed additional appropriation of $15,250.00. The Sawer Fund due to additional coats in the construction of Scenic View Sanitary Sever District which were to ·be borne by the City of Englewood that an amount of $14,225.00 was required to be appropriated. MAYOR'S CHOICE The Mayor asked the City Manager to distribute a liat of councilmatic appointllents which were pending after the organization of the new Council. The Mayor reported that he had received a letter from Mr. Sam Hill indicating that he did not wish to be reappointed to the Planning Commiaaion for another term. Discussion ensued. COUNCILMAN'S CHOICE Councilman Love inquired as to the procedure for updating the Municipal Code after certain periods of time. The City Manager stated that shortly after 1964 replacement pages would be furnished those holders of the Municipal Code. Discus- sion ensued as to the method to be used. Minutes of December 16. 1963 After diacuaaion the llayor stated that an informal meeting for December 30th would not be held. Councilman Love suggested the Council consider and perhaps diacuaa the various councilmatic appointments between the Councilmen elect and those carry-over Councilmen.
