Dear Mayor lreiling:
Purauant to the request ot the City Council at the meeting or February 6,
1961, I have checked the law in regard to police pension coverage and
arrived at the following conclusions.
lftle polic .. en are not eligible for coverage under the Social Security
Act of the United States by virtue of 111-7-9, Colorado Revised Statutes
1953, aa aaended, which •r•cifically excepts policemen and rir .. en froa
auch coverage. The Socia Security Act or the United States doea provide
polic .. en and tiremen may be included under the Social Security System,
but auch incluaion auat be made at the request or the state in which the
depart .. nta are located. Approximately eleven states have applied tor
inclusion or theit fire and police departments under Social Security, but
Colorado is not one of them.
There waa a move in the State Legislature a tew years ago to memorialize
the federal government to authorize such inclusion, but it was opposed by
police departments generally, and particularly by that ot Denver. The
grounds or opposition were that under provisions ot state law a policeman
or fireman may retire at an earlier age and a higher pension than under
Social Security.

department.

reported to the Council aa to the amount in the fund and the amount re-
ceived the previous year.
In the event that the Council should determine it to be to the beat interests
ot the Police Depart .. nt to put the pension tund on a contributory basis,
it .. Y pay into auch tund, troa the General Funds, such awa llDDthly as
shall not exceed s• ot the monthly salaries or the total Police Department,
which ahall be .. tched by contributions or the members or the Police
Department trOll their respective monthly salaries an identical percentage
to match the contribution or the municipality.
It ia ay opinion that it the Council wiahes ·to investigate the contri-
butory tona ot police pension fund, actuarial figures should be obtained
troa a qualified actuary on which to base such fund.
