Tbe CitJ Clerk reported tbat be bad received two telephone .. aaages
relating to tbi• diatrict as follows: from llr. L. A. Siler, 3790 South
Pox, wbo stated tbat be wa• unable to attend this .. eting on account of
illn••• but wa• in favor of the district; and llr. Perry, official of tbe
General Iron Worka Coapany, who stated that the coapany was officially
favorable to tbe iaproveaent of South Fox Street in their vicinity.
llr. Kenneth A. Heron, 2000 South Acoaa Street, Denver, owner of Lots
1 tbrougb 5 inclu•i••, Block 2, llcKinley Subdivision, Second Filing, in
Bn1lewood, pre.ented a petition protestin1 tbe inclusion of tbe above des-
ipaated propertJ in Pavin1 Diatrict No. 11. The protest set forth that
tbe petition waa lnaufflclent, tbat it bad been altered; tbat it bad not
been properlJ •isned, tbat tbe aaaesa .. nt against bis property would be
confiacatorJ, tbat tbe atreet ,was not uaed by tbe public at large and tbat
public funda could not be uaed for private purposes.
Tb• CltJ Attorne1 replied that the protest filed witb tbe City Clerk wa• baaed upon tbe provision• of Chapter 89, Colorado Revised Statutes,
1953, wbll• tbe City of Bnglewood is operating under its own Charter.

tion and •lgnature• thereon. owners of property concerned by petition

were pre•ent and verified their signatures.

procedure. Considerable discussion ensued witb regard to tbis 11atter.
llr•. Nellie F. Bevard, and llr. Jaaes A. Magers, were present and spoke
favorablJ of the petition. llr. Magers advised the Council tbat llr. Heron 1aa• approached each of t~e owners of property in that area with a requ .. t
tbat tb•J a1ree to reaove certain restrictive covenances fro• tbe titl ..
to tbe land in the area so tbat be could erect an apart .. nt bouae on bi•
propertJ. llr. 11&1ers reported that the residents of tbe nei1bborbood were

credit for a•pbalt in place. Be stated there was need for an adequate
baa• in connection witb street iaproveaents.

CitJ •n1ineer'• office and that be bad only the maxiaua per front foot

llr. Pete Jen•en, 4250 South Bannock, Englewood, stated that be bad
requ .. ted an .. ti11&t• of the cost of the iaproveaent to bi• property
tbrougb tbe Sngineer'• office but did nqt receive a satiafac••ry anawer.
llr•. Greg Ritchlin, 2145 South Tejon Street, Englewood, inquired as
to the extent of tbe proposed street iaprovement and asked if sanitary
aewera were not aore iaportant than sidewalk or a paved street. Sbe
di•cuaaed the coat of the iaproveaent as reported by the person wbo cir-
culated the petition. Tbe City Manager reported that there were 25
owners affected by the iaproveaent of Adriadic Place ·and 15 bad signed
aa favoring tbe iaproveaent. Tbe Mayor reported tbat sanitary sewers
could be provided for in a siailar manner as the street iaproveaents upon
the circulation of a petition and bringing that petition to the Council.
llr. Paul &itcblin described in considerable detail tbe need for eani-

street iaprove .. nt• were coapleted. Discuaaion ensued. llr. George B.
Brown, 2170 W88t Warren Avenue, spoke of the atteapt for tbe last 15 years
to bave street• laproved in the Scenic View area. Be expressed the opinion
tbat when tbe •treet• are iaproved tbe properties will likewise be iaproved
and the varioua utilities inatalled.
llr. Carl Moeller, 345' South Clarkson, Englewood, spoke generally of
tbe affect upon tbe appearance of a neighborhood wbicb a newly paved
atr .. t 1ivea. lie stated that tbe tendency is for a general clean-up and
iaproveaent prograa tbrougbout the area.
llra. D. A. Keealin1, 4220 South Bannock Street, Englewood, discussed
the probabilitJ of South Bannock Street being continued as a one-way
street aoutb to Quinc1 or further. Council .. n llartin and Iii.lea spoke,
reporting tbat there wa• no consideration providing for tbe continuance
of South Bannock Str .. t •outb a• a one-way street to their knowledge or
coaaidered bJ the Plannin1 Collllission. llrs. Keeslin1 sta~ed tbat perbape
the City Official• did not know what was going on as she bad beard· tbis
plan discussed several tiaes.

llr. Carl B. Schrock, 3824 South Galapago, spoke favoring the paving
diatrict a• propoaed but objected to bis not receivin1 an allowance for
old oil credit in tbe 600 block West Lebigb Aven•e. lie atated tbat tbis
block bad previoualy been black topped but utility extensions and street
repairs bad deatroyed tbe surface. Discussion ensued. llr. Jaaes R.
llaulis, 3821 Soutb Pox, also spoke about the need for old oil credit in
tbe 600 block Weat Lebi1b Avenue.
llr. Joe A. Sauter, 4265 South Acoaa Street, Bn1lewood, spoke of tbe
deatruction of tbe surface on South Acoaa Street by school buses and in-
atalla tion of utility lines. lie stated that South Aco ... and Quincy
Street• abould be repaired at tbe expense of tbeae coapani... Discuasion
enaued on tbi• problea. Mr. Sauter also spoke tbat since Quincy Avenue
bad been paved be was unable to enter Quincy fro• tbe alley due to tbe
difference in 1rade between tbe street and the alley.
Mr. Jobn Hollberg, owner of Hollberg Greenhouse, 3561 South Buron,
reported tbat tbe installation of sidewalk on tbe west side of Soutb
Buron between Itbica and Kenyon will require the re11e>val of tbe air con-
di tionin1 fan• operated in connection with the greenhouse business but
located on public land, He requested that a period of ti .. be granted
bi• to re11e>ve and relocate these air conditioning units at bis expense.
lie atated tbat tbe present location of the units will not interfer witb
tbe conatruction of the street or the placing of tbe curb and Fitter on
tbe we8t aide. lie atated tbat be would be agreeable to entering into an
asree .. nt wblcb would provide for tbe installation of tbe sidewalk within
2 rear•. Diacuaaion enaued. Tbe City Manager asked for a letter agree-
.. nt to be aubaitted bJ Mr. Hollberg. Tbe City Attorney stated tbat this
letter tJpe a1ree .. nt would be adequate in this case.
llr. llarYin Wahl, 4101 West Qxford, discussed tbe guttering of streets
at interaection• and re ... rked tbat tbe dips were too abrupt, stating tbat
a peraon could not drive over tbea at noraal speed without being severely
jolted. Tb• CitJ llana1er diacussed the aatter of double gutters and
explained tbat the aurface water auat be confined to as s ... 11 an area as
s>09aibl• botb fro• tbe econoaical standpoint of tbe cost for the concrete

llra. Alice WoodJ, 4325 Soatb Cherokee, a•ked for an estiaate of tbe
coat of tbe propoaed pavin1 of her lot. Sbe atated tbat ahe bad not been
able to set an e•tiaate froa tbe City Engineer. Tbe City llanager requested
tbat llra. 9'oodJ diacu•• tbe aatter further witb tbe City Bn1ineer and
brin1 it to bi• attention if abe did not receive tbe infor11ation sbe needed.

wltb Jira. Schaal for securing a drainage way we•t of South Buron in tbe
4400 block and told llrs. Schaal that if tbe transaction took place in
adYance of tbe i11prove .. nt and tbe land was owned by the City tbat the
aa ...... nt would be paid by tbe City.
Mr. Ralph B. Gardner, 4330 South Buron Street, inquired as to the
.final contract price for the 1960 paving. Tbe City llana1er explained tbat
be did not bave tbat inforaation available but that it was tbe cost of tbe
project plua en1iaeeriag and legal fees. Tbe estiaates listed for tbi•

reported that various utility ... ins and ~er•ices had torn up the street and
now tbe increaaed traffic of the duap operation has caused tbe present ·coa
ditioa of a v•l'J buapy dusty road. Be requested that a ... t be laid on
tbe preaent roadway a• over the past years the road bed bad been established
aad be bad peraonally hauled in additional gravel to for• the base.

operatin1. Tbe City Manager stated that Englewood would need to contact

Tbe CitJ llanaser discussed in considerable detail the history of the case
wbich indicated that the ... ny individual haulers have caused considerably
sz-eater traffic on the road than if only co ... rcial haulers were carryin1
traab. Be also discussed a specific case of a sewer tap installed by the
Soutb Kn1lewood Sanitation District without permission nor notification to
... lewoocl. lie objected in principle to the iaprove .. nt of the road by the
laJIDI of a strip of blacktop on top of the existing surface. lie stated
tbat tb1• 11ay cause a serious precedent which could be applied to other
areaa of the City. Discussion ensued. Council ... n Braun stated that this
particular case be felt that the location of the duap bad directly cauaed
tbe beaYJ traffic on tbis street and as such the City of Bnglewood bad a
defia1te reapona1b111ty to provide access to this duap. Be supported tbe
req .... t for prov1d1n1 a teaporary paving for this street. Counc1111&n

The City Clerk read the following reconunendation of the Englewood Water and
Sewer Board:
"That the City Council adopt the proposed Resolutions for the eatabliabllent
or a quarter annual billing on all metered water accounts and or all aewage
treat .. nt accounts subject to legal verification by the City Attorney."

WHERBAS, the City Council on March 10th, 1958 (recessed from regular
.. eting March 3rd, 1958) adopted a Resolution establishing certain water rate

WHEREAS, it has been determined that certain changes are necessary to
provide tor quarter-annual billing for metered water service;
NOV, THBREPORE, BE IT RESOLVED thab Rate No. 2, (metered service) Inside
City and Rate No. 3, (metered service) Outside City, under the City of Engle-
wood, RATE S~LES FOR WATER SERVICE, effective July lat, 1958, be revised
to read as follows:
RATE NO. 2
(METERED SERVICE) INSIDE CITY
Effective July 1, 1961
AVAILABILITY: Available to consumers on meters taking water service inside
the corporate limits of the City of Englewood as of July 1, 1961.
APPLICABILITY: Applicable for residential, conunercial and industrial
service as set forth under the Rules and Regulations adopted by the City
Council and as amended from time to time.

611-53 RELATING TO RELINQUISHING INACCESSIBLE ALLEY
The City Attorney reported on the request for the City's relinquishment of a
portion or an alley now inaccessible near West Nassau Avenue and South Pox Street •.
Re stated that one or the residents on Pox Street had erected a garage and shed at
the rear ot their property and now find that this garage is on an inaccessible
alley due to a vacation or a 150 root portion or the alley at West Nassau and the
location or the City Ditch. The resident discussed bringing an action or a quiet
title suit against the City and requested that the City not reply and thereby the
title would be cleared. The City Attorney atated that he felt $125.00 worth ot time
had been spent by City forces or would be spent in further legal action and should
be paid by the resident who seeks title to the alley. Discussion ensued.
The City Manager suggested vacation or the alley but under those conditions
halt ot the alley would revert to the owners or the property on the other side or
the alley. Discussion ensued. The City Attorney reported that it was informational
at this time and he would report to the Council the action taken by the resident.
CITY MANAGER'S CHOICE
Relating 1,2 Pire Insurance
The City Manager reported that the buildings and contents or the City had been
re.aluedl tor insurance purposes. The insurable value or the buildings was
$317,000.00 and $87.000.00 tor the contents. He stated this did not include library
booka or books and records ot the various City otrices.
Re discussed the present coverage on 8o,C co-insurance clause and stated that a
new institutional policy is available baaed on 9~ or value which would cover books
and records. Re stated that he was reviewing the alternatives prior to renewing
the insurance coverage ot the City.
Court cases .2!l Delinquent Library Users
The City Attorney reported that he had prepared a bill for an ordinance ao
that aoniea resulting and court fines on those who have not returned library books
or pamphlets will be handled by the Municipal Court rather than a Justice ot the
Peace Court. He stated this bill for an ordinance was ready tor consideration at
the next regular meeting or the Council.
Relating to Display ~ Bookmobile
The City Manager reported that the Friends or the Englewood Libr&!'J had requested
that the BookJlobile be placed on display on the southwest corner ot South Broadway
and Weat Girard Avenue for one week from April 15th to 22nd tor Library Week. He
stated that the purpose was to develop more use or and promote information ot the
aervicea ot the Library. Re remarked that he had no objection to the location
suggested as the Santa Claus shop did not appear to cause any hazards at that
location.

Sidewalk Clean-Up
The City Manager reported on the program of clean-up ot the downtown area whereby
a a ... 11 vacuum sweeper machine cleans the sidewalks had been undertaken. Discussion
ensued. He reported that the City street sweeper sweeps the streets and gutters
daily early in the morning.
JIAYOR'S CHOICE
The Mayor reported that Senator Ranger Rogers had asked that House Bill No.
251 be supported by the City of Englewood. He stated that as this bill relates to
the paying or an assessment tor street improvements on behalt ot the National Guard
Armory in the City of Englewood that an indication from the City ot their continued
interest is called tor. The Mayor stated that he would write a letter on this
natter.
False Arrest Insurance
The City Attorney reported that False Arrest Insurance was available through
Lloyds of London at a premium of $20.00 per officer per year. The City Manager
inquired it this could be paid by the City on behalf of the otticers. The City

party to any suit and that it would be for the City's protection in addition to the
protection or the otticer, therefore the City could pay the premium.
The City Manager stated that he would report on this later.
Relating !2, Hawthorne School
The City Manager reported that Hawthorne School had been sold and that the City
aaat vacate by the lat or May. He stated that the move to North School had been
approved and 14 aonth occupancy on the part or the City had been guaranteed.
Council.an Miles 1ntormed the Council that no application tor rezoning had been re-
ceived troa Jira. Leino. He stated that her attorney had indicated she can use the
school aa an ottice building without zoning.
Rel&t1nc 12 Po!'ller Jlaxor Allen
The Mayor asked that the City Attorney draft a Resolution memorializing former
Mayor Allen.
Council--.n McLellan reported that although the Water Filtration Plant had been
named tor tormer Mayor Allen that a name had never been placed on the race or the
building. He asked that this be done.
The Mayor appointed Councilmen McLellan, Martin and Braun as a committee to
c011Plete the project of the dedication or the Filter Plant by provided a suitable
sign or letters to be fastened to the building indicating the Charles R. Allen
Pilter Plant.
Relating 12 City Expense ~ Dinner Meetings
Councillllln Braun stated that all Councilmen should go to the various evening
meetings aponaored by ditrerent groups and governmental organizations •. He stated
that the dinner expense or the Councilmen attending should be .. t as an expense
ot the City rather than a personal expense or the Councilmen. Discussion ensued.
