in r99ular ••••ion on Monday, November 6, 1961 in the Council Chamber•,
City Ball, Englewood, at the hour of 8:00 P.M.
Mayor Kreiling preaiding called the meeting to order and the invoca~ion
waa given by Reverend Frederick Hahn of the Innanuel Lutheran Church.
The Mayor aaked for roll call. Upon the call of the roll, the f•llowing
peraona were preaent:

'l'h• City Clerk stated that the police report had been received and a copy
of thi• report waa paaaed to the City Councilmen. Discussion enaued aa to
aervice of food by the ap.licanta .at the Horse Car Bar. Mr. Jamea Malone, one
of th• applicant•, stated that they had contacted several reataurant manager•
and they planned to hire the beat they could secure as an .. ployee with an
incentive for him to operate efficiently through a sharing of the profits.

JOHN K. HOLLAND ON A MATTER OF STREET RIGHT-OP-WAY
Mr. John K. Holland, Attorney at Law, presented a matter of street right-
of-way on Weat Ithica and West Jefferson Avenues and on South Cherokee and
South Delaware Street•. He stated that at one time Mr. c. A. Berry owned the
entire block bordered by these streets and vacated the plat. Thia vacation
reaulted in clearing away of all lot lines including street right-of-way.
Subaequently the deeding of land within the block was by mete• and bound•
deacription but did not include deeding of the street although it appeared to
have been hi• intention. Mr. Skerlj, present owner, of approximately the north
half of thia block cannot claim the street as it was not deeded to hi• and

title remain• in the heirs of Mr. Berry. Mr. Holland suggeated that an

a public atreet. Mr. Holland stated that Mr. Skerlj would deed an alley to the
City and pay the coats of the City in an adverse usage or quiet title euit to
clear ~the title of the vacated streets which were not aubaequently deeded to
Mr. Skerlj. Th••• cost• would be paid not to exceed an amount of $400.00.
Mr. Brownewell diacuaaed the similar situation in the aouth portion of
the block preaently owned by Mrs. Body. He stated that there waa a life
eatate proviaion in a deed whereby the City 'f«>uld receive the neceaaary
right-of-way in Jefferson upon Mrs. Body's death but that additional right-
of-way waa neceaaary to provide adequate street width in the area. Diacua-
aion enaued.
Th• Mayor auggeated that the City Attorney and Mr. Holland act jointly
to clear the title to the Skerlj property right-of-way then attempt to estab-
liah adequate right-of-way with Mrs. Body through Dick Graham, her attorney,
with the City Attorney'• participation.~

of the Sngl.wood Chamber of Commerce dated October 23, 1961, requesting that
the City participate in the Chriatma• program for the City of Englewood in the
a.ount of $2,000.00 and that the City permit the locating of the Santa Clause

•That Mr. Shivers, Water and Sewer Board Consultant, be authorized
to recoaaence negotiations for the purchase of approximately eight
acre• of land located 80uthweat of the High Line Canal, north of
County Line Road and eaat of the Hercules Powder Company road, at
a price not to exceed 5% beyond appraisal or a figure to be subnitted
for approval: and, if negotiations fail, to condemn."

originally thought to be neceaaary but recent plans showed that a good portion
of thi• land would be under water and that rip rap at its perimeter would not
be practical.

PROPERTIES
The City Clerk read a letter from Mr. c. o. Sevier, 2948 South Cherokee
Street, dated November 4, 1961, addressed to the Mayor and City Council
which stated that he objected to the rental provision of the Buaineas and
Occupational Licen•• but that if the Colorado Supreme Court had judged this
licen•• tax to be legal that the ordinance should be completely enforced in
thi• reqard. He offered au99eations for stricter enforcement of the tax through
effor~• of the police force.

budget for the fiacal year 1962 wae duly submitted by the City Manager to the
City Clerk on September 12, 1961, and waa considered by the City Council at
it• regular meeting on September 18, 1961: and

ARTICLE II
DUTIES
Section (a) The duties of the existing and recognized Boards and

Section (b) The duties of the Legal Department and of the Municipal
Court shall be a• prescribed within the Home Rule Charter.
Section (c) The duties of the Operating Departments shall be as pre-
scribed by statutes, Home Rule Charter, ordinances, and/or
directives of the City Manager as each may be applicable to
the respective departments.
Section (d) The dutie• of the Civil Defense Agency shall be as prescribed
by Federal and State legislation. The City Council recognizes
the poaaible functioning of the agency outside of the terri-
torial limits of the City of Englewood. In case of a declared
emergency within the City of Englewood, all operating depart-
ment• of the City government shall cooperate with the Civil
Defenae Director, and •hall coordinate their activities and con-
tribute effort, facilities, materials and equipment for the
duration of the emergency.

612-80 PROPOSED REVISION OF PARKING LIMITS CI'l'Y PARKING LOT
Th• City Clerk read in full a letter written by Mr. Clarence v. COleman
of Ambroae-Willi .. • and Company, dated November 1, 1961, requeatinq that the
limit for parking be decreaaed from three hour• to two hour• .-cept in the
aoutheaat corner where a three hour parking limit would exi•t under certain
reatrictiona.
The City Manager explained further the reaaon for the letter from Mr.
Col..an waa due to all day parking by employee•, but certain cuatomers, par-
ticularly the beauty •hop, need a three hour parking time in order to be
aaaured of adequate time for treatment. He auggeated that the •ix month
trial period be authorized.
Councilman McLellan expr•••ed hi• objection to the eatablishli9nt of two
parking limits within the lot due to the difficulty in providing enforcement.

AS TO SIDEWALK CONSTRUCTION
The City Manager presented a proposal for the installation of sidewalk
aero•• from the Senior High School in connection with the paving being com-
pleted in 1962. He atated that this would provide no cost to the City as
there would be no widening of the street, simply designation of the installa-
tion of sidewalk on the west aide of South Logan as part of the district
improvement with the advantage of providing district financing to the owners
of the property in that area. Discussion ensued. The City Manager requested
that an informal meeting be scheduled soon for the consideration of the streets
to be included in the 1962 paving program.
RELATING TO SCBNIC VIEW ZONING VIOLATIONS
Councilman Braun requested the City Manager to make a report to the
Council on the Aaaistant Building Inspector and his success in clearing up
Scenic View zoning violations.

RELATING TO TIME OF WATER BOARD MEETINGS
The City Manager reported that the newly established Water and Sewer
Board regular meeting date of the first Wednesday did not give adequate time
for reporting of action of that meeting to the Council. Discusaion ensued.
The Mayor aummarized the discusaion by stating that the action would be held
until the next meeting of the Council unless something came up which was urgent.

aing the appreciation of the member• of the City Council and the citiaens

RBLATING TO DOG LEASH LAW
Councilman McLellan reported that an Englewood citizen had urged that
the dog leaah law not be enforced during the winter month•. The thought waa
that f lowera and lawna and other ahrubbery would not be damaged by running
cti.ga in winter and it would promote the dog• health. Discussion ensued.
