MR. BRBERT APPEARED RELATIRO TO P.AYMERT FOR GRAVEL
Mr. Robert Erbert, 3955 South Galapago, contractor, stated that about a
year ago he had purchaaed tiTe aite• on South Galapago. He had aaked the
City Engineer to grade and gravel the atreet in 1958 so that be could show
hi• newl7 con1tructed homes. He stated that the City Engineer had promised
to proTide the gravel and grading. When the City Engineer did not proTide tbe
gravel and after repeated request• that thia be done, Mr. Brbert purchased the
graTel hiaaelt and graTeled the atreet and alley both. He asked that he be
i-.1.Jlburaed tor the coat or this graTel.
The Cit7 Manager replied that he had receiYed a letter from Mr. Fosnea,
an attorner on behalf or Mr. Brbert relating to this matter and that on
D9cellber 2lat the Council considered the request and denied it. He stated
that tbia action waa in contol"llance with an existing and continuing policy
ot not graTeling or iJlproTing atreeta outside of auch 1.Jlin-o•e .. nta aa ••Y be

The Ma1or reaffirmed the polic1 as aet forth by the CitJ Manager and
emphaaized the ca11parativel1 aaall amount or mon.1 which would be aTailable
tor any ind1Tidual graTel1ng of atreeta rrom propert1 taxea only.
Mr. El'bel't reaftlr11ed that promise• and conmitment1 had been made to him
for the graTeling of the street and alley. The CitJ Manager atated that be
had inquired ot the CitJ Engineer in thia matter and the Engineer attil'll8d
that be had not •ade such a 1tatement aa it was contrar,. to Council polic1.

Manager to review the need tor paving in that area.
Mr. Erbert aaked about improvement or the alley. The Cit7 Manager stated
that onl7 an 8 toot atrip had been dedicated with an 8 toot eaae .. nt in addition.
Unl••• turtber dedication waa provided the City could not undertake to eatabliah
or maintain that alley in that area. There was no further action on the matter.
MR. RICHARD GRE!ll APPEARED RELATING TO SALE OF BUSSARD BUS LIKE
Mr. Richard D. Greene, Attorney, appeared betore the City Council on behalt
ot the new owner• ot th• Busaard Bua Line. He discussed the circumatancea leading
to th• purchaae or the Bua Line by a new corporation called the Suburban Transit
Compan7. He aaked the Council to indicate its favor or disfavor ot the aale so
that a temporarf' PUC pel'lllit may be secured. A hearing on this application will
be conducted on Pebrum-y 25th.
The City Manager dlacuaaed Ordinance No. 12, Series ot 1952 which provided
a tranchi•• tor the Buaaard Bua Compan7. He also d11cuaaed the tee achedule
under that ordinance and under the Business and Occupational Licenae Ordinance,
both ot which had not been complied with bJ Mr. Buaau-d. ·

Tarioua actions or that Board. He reported that a joint meeting with repre-
aentatiTea or the City or Littleton had been scheduled tor the purpose ot

The City Clerk read the following recommendation or the City Planning
and Zoning Conmiaaion lb tull:
"That the 17-acre · tract bounded by South Logan
Street and South Clarkson Street and Eaat
Jetteraon Avenue (Colorado Highway #70) and
Eaat ~enyon Avenue and Little Dry Creek, be
rezoned troll R-1-D, R-2-A and R-2-B to R-3-A
tor the following reasons:
1. That it would be more compatible with
the exiating reaidential use and would
result in a more orderly redevelopment
ot the entire area.
2. Would help correct the deficiency of thia
category in the City and would also exert
a nominal damage on existing singles and

The City Manager referred to the Minutes of the mee~lng of February 9th
relating to the rezoning of this area.
Mr. Lee Jones, Chairman ot the City Planning and Zoning Commission, stated
that the proposed zoning would provide for the highest and beat uae ot the area.
He diacussed the Bowes report which led to the recommended zoning. Re alao
dlaouased a recOllllendation that operation ot a mortuary be included as a per-
mla s ible use in R-3-A Residential zoning.
Mr. Jones reported that a recent amendmnt to the Zoning Ord.inane• requires
that a public hearing be conducted by the Planning Commission prior to any
sonlng changes and that the Planning Co111111ission would publish notice ot said
bearing and hold this hearing at its next :regular meeting on March 10th.

a regular accounting or funds receiYed and expended tor said project; and,

The Mavor discussed H.R. )610 being considered by the Federal Government
which will would provide tor Pedaral allotment to aid in water pollution con-
trol. Discussion en1ued. The City Manager urged that the President be not1~
tied ot Englewood'• interest in this legislation and that the President urged
to sign the legislation into law. The Mayor agreed to write such a letter.

The Mayor auggeeted that the City or Englewood go on record aa being opposed
to HCR Wo. 9 •. The Mayor agreed to call the local legielatora to expreee
Inglewood'• viewpoint on thia reaolution.
The City Attorney reported that he had not received the docwnenta trom Mr. c. A. Pritzainger which would reaove the off-street parking provisions required
by the City ot Englewood.
The City Attorney reported that a group of landlord• have organized with
the purpoae ot challenging the :rental license provision ot tti. Buaineaa and
Occupational Tax aa being anconatitutional. He stated that he had not received
any legal paper• on this point.
