MARCH 21, 1960
REGULAR llUTING:
The City Council of the City of Englewood, County of Arapahoe, Colorado
met in regular session on Monday, March 21, 1960 in the Council Chambers,
City Hall, Englewood, at the hour of 8:00 P.M.
llayor Scott presiding called the meeting to order and the invocation
was given by the Mayor.
The Mayor asked for roll call. Upon the call of the roll, the following
persons were present:
Councilmen:: Braun, Brownewell, Kreiling, McLellan, Woods, Scott.
Also Present: City Manager Rudd,
Assistant City Attorney Myrick
City Clerk Beausang.
Absent: Councilman Martin.
The Mayor declared a quorum present.
601-27 PUBLIC HEARING ON ASSESSMENTS IN PAVING DISTRICT
NO. 9
COUNCILMAN BRAUN MOVED, COUNCILMAN BROWNEWELL SECONDED, THAT THE PUBLIC
l:IBARING ON THE MATTER OF ASSESSMENTS IN PAVING DISTRICT NO. 9 BE OPENED.
Upon the call of the roll, the vote resulted as follows:
Ayes: Councilmen Woods, McLellan, Kreiliog, Browoewell, Braun, Scott.
Nays: Nooe.
Absent: Councilman Martin.
The llayor declared the motion carried.
The llayor inquired of the City Attorney if the public bearing was for
consideration of oral objections as well as those written and filed prior to
March 18th at 5:00 o'clock. The City Attorney opinionea that the method of
complaint is in writing but the Council may exercise the right of asking for
oral replies to specific questions on a complaint.
The City Clerk read written complaints filed before Friday, March 18th,
1960 5:00 P.M. as follows:

(Councilman Martin entered and took bis place at 8:25 P.M.)
The City Manager reported that each and everyone of the above listed
complaints bad been checked by the Engineer's Office and all proper credits
and charges were applied. He summarized how the various assessments were
computed and what costs of City preparation were charged to the Paving project.
llr. Jerome Fossenier, Office Engineer, was present to explain the engineering
details of some of the particular complaints.

The llayor outlined in considerable detail the policy of supporting
Paving District formation by the City through allowance for old paving which
was in place at the time of the formation of a District, by the assuming of
the costs at the intersections both of streets with streets and streets
with alleys, and by accepting the normal proportionate assessment for paving
along City-owned property. He discussed the method of assessing and formation
of Districts in considerable detail.
<..ouuc ilma n Woods asked to bear from any citizens present who bad further
complaints or questions with regard to their assessments. Two persons in-
dicated that they bad such questions.
Mrs. Ostrousky was present and asked for an itemized statement of her
assesament. Mr. Elmer Jungck, 3297 South Delaware inquired about the
aasesaaent on that corner of West Floyd and South Delaware.
The llayor asked if there were any further discussion on the matter of
aaaessments. There were none.
COUNCILMAN WOODS MOVED, COUNCILMAN MCLELLAN SECONDED, THAT THE PUBLIC
H&ARING ON THE PAVING ASSESSMENTS FOR PAVING DISTRICT NO. 9 BE CLOSED.
Upon the call of the roll, the vote resulted as follows:
Ayes: Councilmen Woods, McLellan, Martin, Kreiling, Brownewell, Braun,
Scott.
Nays: None.
Absent: None.
The Mayor declared the motion carried and indicated that a bill for an
ordinance establishing the assessments as listed would be considered later
in the evening.
601-31 RELATING TO PROPOSED CHANGE IN R-3-A ZONE USES
Mr. Leslie Gross, Attorney for Perless Builders, appeared stating that
be was not against mortuaries in an R-3-A zone but wished to discuss the plans
bis company has for development of the area and wished to emphasize how incompa-
tible the erection of a mortuary in that same area would be.
Mr. Ralph Bevins, of 3621 South Pennsylvania Street presented a petition
protesting the proposed rezoning on behalf of Mr. Walter Herzog, who was
unable to attend.
The llayor explained to both of the above parties that they would be
given an opportunity to explain their views and objections at the public
hearing on this matter. This would be discussed later in this meeting.
601-39 RELATING TO REQUEST FOR TRANSFER OF OWNERSHIP OF
BEEFEATER RESTAURANT LICENSE
The City Clerk read an application for transfer of the Beer, Wine and
Spiritous Liquor License by Mrs. Shirlee Griswold dba Holiday Drive-In
at 4155 South Broadway, Englewood.
The llayor asked the Assistant City Attorney if there were any legal
iaplications in this transfer. The Assistant City Attorney reported that it
was bis opinion that the transfer of ownership did not require posting or
rehearing in this matter of transfer but that there were several serious
question& as to Mrs. Griswold's interest in liquor licenses issued to the
Holiday Drive-In Restaurant, Inc. The Assistant City Attorney stated that
he bad talked with the attorney for the applicant who bad stated that this
ownerahip information was not available at this time but would be available
in the very near future. Discussion ensued.

THE LIQUOR LICENSE BB TABLED UNTIL THE NEXT REGULAR MEETING TO HE HBLD ON
APRIL 4, 1960. Upon the call of the roll, the vote resulted as followe:
