Mayor Scott presiding called the meeting to order and the invocation was given by llonsi1nor Bernard J. Cullen of the Saint Louis Catholic Church. The llayor a•ked for roll call. The llayor declared the motion carried. 601-82 INFORMAL HBARING ON PROPOSED STREET lllPROVEllENT OF EAST YALE AVENUE Tbe City llana1er read a notice to all property owners in Inglewood along the south aide of Bast Yale Avenue from South Clarkson Street to South Downing Street. lie informed those present that the Porter Sanitarium and Hospital adlliniatration proposed street improvements along East Yale Avenue which in- volved the changin1 of grade lines on Yale Avenue both north and south sides fro• South Downin1 Street to South Clarkson Street so that drainage may be provided. lie •tated that Porter Sanitarium would assume the total cost for that iaprove .. nt including placing cu~·bs and gutters. He stated that several tree• •tand on the curb or street line as proposed to be reconstructed. Di•cu••ion ensued. llr. Bob Frantz, 1100 Eaat Yale Avenue, llr. Elmo Hall, 1130 Bast Yale Avenue, llr. Raymond DeRuiter, 1150 Bast Yale Avenue all spoke on this matter. The llayor •u .... rized the discussion as follows: both the City of Englewood and City of Denver have da8ignated East Yale Avenue as an arterial street of 44 foot width; the trees along the south side of the street in tbe street fight- of-way would have to be re11e>ved under these conditions; that settin1 the street to tbe north bad been considered but rejected by the City of Denver; that the property owner• did not want the street off-set to the north and questioned the need for the 44 foot width; and property owners questioned why the proposal bJ Porter Sanitariu• would be entertained by the Council. The llayor suggested that perhaps additional rillbt-of- way could be •ou1ht on the north which would allow the street to be constructed full width without disturbing the trees on the south side of the ri1ht-of-way. Olot lloline, Administrator Porter Sanitarium and Hospital, spoke of Porter'• deaire to construct a sidewalk along the north side of Bast Yale but learned that they could not iaprove only one side of the street. Councilman Braun suggested that representatives of the owner• and Porter Sanitarium meet with the Denver City Engineer to deteraine what -Y be done. The question was called for. Councilman llcLellan stated that at this ti .. the Porter Sanitariu• would pay for the full improvement while at a later date if the iaprovement is made the property owners will have to pay their abarea. llr. lloline offered to sell land for right-of-way or place sidewalk on Sanitariua property if agreeable with the City of Denver. Tbe Mayor thanked tboee preaent and asked that they investigate further and look tor a coapromise which would provide a solution. 601-84 COUNCILMAN BRAUN RBLATING TO THB POLICE DBPARTllBlfT Councilman Braun read ~ prepared statement to the Council aa follows: "Englewood, Colorado June 6, 1960 llr. Mayor and Gentlemen of the Council: Pursuant to the last informal discussion with you in regard to a proposed audit of the Police Department records, I wish to state the following: No banner is bein1 carried for anyone, not even myself, but this request is bein1 made as •Y duty as a councilman with the best interests of tbe City of Englewood foremost in my mind. One cannot expect a machine, let alone a City of this size, to operate efficiently and properly without a periodic oiling and checking of the gears. It will probably be aaid by some that I am fanning at breezes and ghosts, maybe I am. However, anonymous information given to me that tbe time records kept at the Police Departaent have been altered so that those records vary fro• the records turned into City Hall, is a point to be con•idered in my opinion. As for the anonymous part, I believe that a good bit of sound information in all fields is passed on in the anonymous category. I do know that tbe Pire Department would go to a fire even though the person reporting tbe fire and location didn't leave bis name. As such, I aove: "An independent auditor be engaged to audit the time records kept at tbe Police Department, and the time records turned into City Hall for the past 18 months. One point tbe audit should show is a comparison of duty hours and compensatory hours.~· /s/ H. R. The City Manager commented that he bad studied tbe questions leading to tbe tiae put in on the job by the various officers and bad no reason to doubt the truth of the records turned in to the City Clerk. Diacuaaion ensued re- lative to tbe fact that the Police Department is often a focal point for dis- gruntled persona who have bad what they feel to be unfair dealings with the departaent. He reaffirmed bis confidence in the officers. Councilman llcLellan stated that be objected to the matter being brou1ht up at a public meeting but doe• not object to the proposal for an audit. Discusaion ensued. (b) The assessments for said improvements may be paid in 10 equal install- .. nts. (c) Said assessments will be due and payable without demand within thirty days fro• and after the final publication of an ordinance assessing the whole coat of said iaprovements against the real property in said District; provided, bowever, that any owner who shall pay his full assessment within said period of tbirty days, shall be entitled to an allowance of five per cent (5,). The first of such installments of said prin- cipal shall' be due and payable at such time as may be determined in and by the aaeeseing ordinance, and the remainder of said installments shall be due and payable •uccessively on the same day in each year thereafter until allare paid in full. (d) The rate of interest to be paid on unpaid and deferred installments aball be aix per cent (6') per annum, payable semi-annually. (e) Tbe extent of the District to be improved shall be all of the real property frontins or abutting on the streets, avenues and alleys between the teraini hereinbefore described, including the real property within one-half <i> block of such streets, avenues and alleys. Adjustments will be made for irregu- lar and odd shaped lots and parcels of property. (f) As shown by the eatim ates of the engineer, the probable total cost of said iaprovemente in said District is $425,000. of which amount the City w~ll pay approxiaately $140,000. Probable costs per front foot on each side of the atreets, avenues and alleys in said District are: Asphalt paving 36' wide $4.58 per front foot Asphalt paving 44' wide $5.81 per front foot Concrete alley paving 14' wide $4.73 per front foot Paving of other widths in proportion to above estimates Curb, 1utter and sidewalk (Hollywood type) $2.90 per front foot 103 Minutes of June 6, 1960 Vertical type curb and gutter $2.56 per front foot Sidewalk 4' wide $2.23 per front foot 6 " concrete slab $0.68 per square foot All estimates exclude the six per cent (61) for inspection collection and incidentals and interest as provided by law. (3) Obviou•~y, cou~ia~ring tbe 13 owners only, there are more than 201 signing a written proteet, so tbat a favorable vote of three-fea~tbs of all of tbe .. aber• of tbe City Council is required to pass the rezoning ordinance. Three-fourths of the Council of 7 members comes to a fraction over 5, so that in •Y opinion, a vote of three-fourths means that at leaat 6 .. abers aust vote for tbe measure. It is, therefore, my opinion that tbe bill for an ordinance lost by virtue of not having a vote of three-fourth• of the meabers of the Council therefor. In view of the above conclusion•, it is my recommendation that the llayor declare that the bill for an ordinance was lost due to the failure to car17 by tbe required 11&jority of three-fourths of the Council, and tbat it would be out of order to read the ordinance and vote on it on fi*al reading. Ford, or bis predecessors in interest, bave decreased tbe flow of water in tbe natural drain course across bis property by inatallins iaproveaents thereon and by installing an artificial dike along tbe east line of tbe property, wbicb retards tbe flow of tbe water. (4) Tbat by tbe action of llr. Ford or bis pred•cessors in interest relative to cultivation of bis property and tbe installation of tbe iaproveaeots and the dike, there bas resulted a situation wbicb causes con•iderable ponding in the 4300 block on South Pennaylvania Street after any sizable precipitation; that as a r .. ult of tbis ponding tbere is created in tbe street what a11e>unts to a lake on tbe west extending from across tbe sidewalk on tbe west aide of the block approximately tw•-thirds across the street and something like a maximum of a balf a block on tbe west aide of tbe street; that this pond further covers the sidewalk on tbe west side of tbe street approximately a distance of 100 feet; tbat there is no outlet for the pond and that as a result, it auat await natural evaporation to be dissipated. (5) Tbat tbe artificial ponding in the street is dangerous to traffic and will at ao .. indeterainable time in the future result in ac- celeration of tbe deterioration of the street.
