You'll recall, we initiated tbe one per cent Bn1lewood Sales Tax only after
tbe moat careful •tudy. Capital I•prove .. nt• in tbe form of new etr .. ta,
beidse•, parka, recreation facilitiea, traffic control device•, stor• drain-
... provi•ion•, public buildin1• and otbera were bein1 de8&nded by citizen•
and citizen• 1roup•. Tbe new bo .. rule charter directed that we take action
on tbi• queation!
Obvoualy, tbere bad to be •o-.. tbod of pay for tbese tbings. our city
aill l•VJ 1• lower tban 110•t coaparable cities. We bave only a one cent

So, in accordance with tbe provisions of our charter and after makin1 every
effort to infor• our co..unity about the proposal and to obtain reactions
to it, we decided to take tbe initiative. We believed tbat with tbe same
bacJEsround and data we po•••••ed, the citizens we represent would have

formulated and $250,000 bud1eted for that purpose.

validity. lie adviaed ua tbat be tbou1bt it was invalid for several IOOd
and sufficient reaaon• and that we bad no choice but to deny tbe petition.
Tbia waa done.
Subeequently, action waa undertaken at the district court to order tbe
City Council to reco1nize tbe petition. The rulin1 of tbe court, banded
clown on June 25, 1960, waa to uphold tbe validity of tbe petition and to
order the council to call an election or repeal tbe tax witbin 30 day•
after a 60 day atay of execution. Durin1 this period a deciaion could
be ... de aa to wbetber or not ao appeal tbe decision to tbe Colorado
State Supre .. Court.

question aa to bow to act on tbe ruling of the District Court.
The alternative• are three. We ... Y appeal tbe ne1ative decision of tbe
district court to tbe Colorado Supreme Court. We are adviaed that there
are sould lesal eeaaooa for an appeal and tbat tbe declaloo could be
favorable to tbe poaition of tbe city. Or, we may confor• to tbe lower
court• ruliDI eitber by i ... diately calling for an election on tbe ques-
tion, or by repealing tbe initiated ordinance wbicb waa paased last fall.
