Sierota.
llr. Barry Silveraan, counsel for llr. Simon Sierota, presented the
followin1 exhibits:

llr. Silverman then aaked llr. Sierota to testify as to bis qualifica-
tion• .. applicant for this license. llr. Sierota stated that a court pro-

12, 1960. lie re11&rked that tbe only 3.2 beer outlet in Bnglewood is tbe
Big Top Grocery on &&at Belleview. lie •stimated that this was five miles
fro• bi• atore. Diacuaaion enaued.
llr. Boy L. Ja .. a, 1074 West Dartmouth Avenue, stated tbat be lived
witbia two blocka of tbe propoaed 3.2 beer outlet and tbat l8 Jbougbt
grocerie• there and previoualy bad bought bi• beer at this location. lie
atatecl that be would need to 10 eight to ten blocks in order to purchase
beer at another· outlet.
llr. Dick Cle .. nts, 2755 West Hampden Avenue, Sheridan, wa• called
on bebalf of the application. llr. Sumaers objected to tbis man's teati-
mc>DJ aa be waa not an Bnglewood resident. The City Attorney reviewed
tbe queation and stated tbat be did not feel bearing the teati110ny of
tbi• 11&D would be unlawful, as tbia was not a court proceeding.

propoaed outlet but tbat be bou1bt approximately 8()1 of bis groceries
there. lie atated tbat it wa• convenient for bi• to purchase bis 3.2
beer at tbe ti .. wben be •bopped for groceries. Be stated that be bad
not purcbaaed beer after Au1u•t 12 at tbe Snappy Food Bar, and not pur-
cb&aed beer fro• any other location since that time either. llr. Cle .. nta

llr. M. M. su ... ra, 3140 South Delaware Street, Englewood, spoke in
oppoaition to 1rantin1 the application. He asked to see tbe petitions pre-
••nted in aupport of tbe application. Peraission was granted.
llr. su ... r• atated that bis objection to the granting of tbis licenae
waa tbat tbe City Council would grant a full-fledged licenae providing for
tbe aale of 3.2 beer by the package and by tbe drink. lie eapbaaized tbat
tbe Supra .. Court bad ruled tbat tbe nature of tbe license could not be
remtricted. lie atated tbat the notice of application for bearing did not
aak for a licenae. It asked for permission to sell 3.2 beer by tbe packaae.
Tberefore , be bad not applied for a 3.2 beer license. lie referred to tbe

Laat Sunday evenin1 about 10:00 P.M., llr. To• Clark, wbo was in charge
of tbe 3:30 -11:30 P.M. shift tbat date, called me at ho• tbat "there was
a riot at tbe Snappy Bar, tbat tbey bad aucceeded in getting it quieted and
reaoved aeveral participant•, but tbat wbile enroute to tbe station a re-
port waa received that aeveral buadred people bad con1reagted there and tbe
fisbtias bad been r_u .. d. ~· I told llr. Clark to call any off-duty officers
be a .. ded to control tbe aituation, and, under the authority to supresa all
riot•, to atop tbe •ale of beer at the outlet for the reaainder of tbe
evenin1, and diaper•• tbe crowd. I then dreaaed hurriedly and came to tbe
atatioa to aaau .. peraonal co ... nd. Lieut. llattbew• bad alao been called
and be arrived at about tbe ••• ti .. tbat I did.
At llr. Clark'• requeat two cars fro• the Sheriff:• force and one fro•
the City of Sberidaa arrived to aaaiat our officer•. BJ the tiae llr •
.. ttbewa and I bad arrived at the Snappy Bar tbe crowd bad gone and tbe
place waa in tbe proce•• of beia1 closed. Two of our officers, llr. Maaon
aad llr. Rave, were aaaaulted and received ainor brui•e• in tbe .. lee.

m&J bave been a trifle preaature, but there wa• certainly a 1eneral dia-
turb&Dce and aa incipient riot. The officer• report tbat tbe aana1e .. nt
waa ll&kia1 no atte•pt to control the situation, and even contributed to
it bJ continuia1 to aerve patron• wbo appeared to be too drunk, and by
ll&kiDI diapara1in1 remarks to tbe officers and trying to get tbea to "let
the• fi1bt it out." At any rate, it i• certain tbat a very bad situation
would bave resulted witb tbe definite possibility of death or serious
iajuri .. bad llr. Clark not acted with dispatch and used effective means.

witb tbe City Clerk. He thanked the Council for their ti .. in allowia1

aale of 3.2 beer by the packa1e only was taken into Court after tbe Council

llr. Roy Garaide, 3205 South Santa Fe Drive, spoke against tbe issuance
of tbe liceaae. lie atated tbat tbe area bad been quiet since the terllina-
tion of tbe licenae at tbe bar. Tbere bad been no disturbance or trouble
•lace. lie re11&rked that tbe bar equipaent was still in place and available
for i ... dlate uae and euapicioned that it might be used once again in spite
of Court Order or &DJ otber reatraint intended to prevent it• use. Be
atated tbere waa soae indication of intent to purchase 3.2 beer by tbe
pack&a• if tbe licenae be granted, but tbat be doubted there was any need
for tbe outlet in tbe area.
llr. Fred Baverkate, 3150 South Platte River Drive, spoke against
iaauaace of tbe licenae. He stated that be lived in the i ... diate vicinity
and did not ... tbe need for tbe outlet to meet the desire• of tbe inbabi-
taat8. lie expre•••d the opinion that any license granted could not be re-
atricted to aale of beer -.r tbe package only, and that there was no reason
wby after receiving tbe license, llr. Sierota could not sell the beer by
tbe drink at tbe location.

llr. Barry Silveraan spoke of the conditions in connection with tbe
i••uance of thi• llcenae as coapared with those dealing with the issuance
of tbe licenae laat year. Be atated that last year there was a City
Gr•iaaace which waa untried; and that the Brewera Association wanted to
teat tbia Q;dinance and prevailed upon Mr. Sierota to bring suit without
llr. 8ilYer11&n'• knowleds•· Tbe Brewers Associat•on won a victory but
llr. Slerota auffered a defeat because upon applying for renewal of bis
liceaae, it waa not renewed.

ia1 tbe iaauaace of tbe liceaae, signed because they underatood tbat 3.2
beer would be •old only by tbe package and llr. Sierota intends to abide

atate .. nta to tbe contrary aetting forth that llr. Sierota can sell by tbe
drink and by tbe package without penaltiea of the Law are falae.

licenae.

by tbe Dlatrict Court. lie atated that a man cannot go into Court and
directly obtain aa injunction againat bi .. elf. lie apoke further of the
aulaaace wbicb exiated fro• tbe operation of the outlet. lie closed by
re11&rkin1 tbat if a ... n i• not faithful to certain phases of tbe Law,
there i• no reaaon wby be abould be faithful to others. llr. Sierota does
not recosnize the reaponaibility of having a 3.2 beer license.
Tbe llayor then reviewed the circu .. tances under which tbe City agreed
to enter auit againat SillOD Sierota leading to a decree declaring opera-
tion of the Snappy Food Bar a• a nuisance. lie stated that such suit did
not repreaent favorable action in advance by the City Council, nor did it
ori1inate witb tbe Council but witb Mr. Silverman witb le1al review by tbe
City Attorney. Tbia action was done entirely at the expense of llr. Sierota.
lie diacuaaed the right of a person to forego a right as possibly in tbat
peraon's rltbte.
