Tbe City Attorney read tbe following memorandum relating to tbe transfer
of funds:

Pursuant to the requeat of the City Council at the last meeting, I have
conaidered tbe queation aa to whether or not the City may carry over from one
fiacal year to the next budset appropriation• to be set aside for the accu-
aalation of funds for ao .. apecial purpose. In my opinion, this cannot be
done.
Tbe atatute• of tbe State of Colorado (88-1-14, C.R.S. 1953) provide as
follow•:
"88-1-14. llo contract to exceed appropriation. ---During tbe fiscal
year, no officer, depart .. nt, board, coaaiaaion or other •pending
a1ency •ball expend or contract to expend any money, or incur any
liability, or enter into any contract which, by ita ter .. , involves
tbe expenditure of money for any of the purpoaea Cor which provision
i• aade in the appropriation ordinance or reaolution in excess of
tbe amounts appropriated in said ordinance or reaolutioD for such
officer, depaet .. nt, board, commission, or other expendin1 a1ency,
of purpoae, for auch fiscal year. Any contract, verbal or written,
aade in v6olation of this section shall be void aa to the local
1overn .. nt, and no moneys belo9ging thereto shall be paid thereon.
Kotbin1 contained in tbia section shall prevent the makin1 of con-
tract• for 1overn .. ntal services or for capital outlay for a period
exceedin1 one year in firat class school diatricta or if aa .. be

Section 94 of tbe Charter provides as follows:
"Appropriation• to Lapse ---Any annual app~opriation ot any portion
thereof remainin1 unexpended and unencuabered at the close of the
bud1et year aball lapae and revert to the General Fund, or to a
special fund, a• Council 11&y direct."
Section 96 of the Charter provides for a special fund for public improve-
.. nta, to be kept by the City Treasurer in a special account until invested
aa authorized by the Council, and provides further that &DJ .project shall be
c1ee .. d to have been abandoned if 5 fiscal years elapse without any expendi-
ture fro• tbe appropriation therefor.
In view of the proviaiona of the statute and tbe fact tbat the Charter,
under Section 94, makes no provision for special funds, while it does so in
Section 96, leada .. to tbe opinion that it was not the intent of tbe Charter
to provide for tbe accumulation of special funds from year to year for a
specific purpose under any other part of tbe budget than tbe capital budget.
This view, in my mind, is further sustained by the fact tbat Section 82
refers to "an annual or current expense budget, hereafter referred to as the
'Budset' wbicb aball be a complete financial plan for tbe ensuin1 fiscal year,
conaiatin1 of tbe bud1et proper and the budget message," and "a capital budget."

It appeara to .. that Section 94 of the Charter relative to ~apsation of
appropriation• refer• back to the annual or current expense budget, while
Section 96 refer• back to the capital budget.
In view of the fact that Section 96 makes specific reference to and pro-
vide• for a carry-over fund for a special purpose, and Section 94 does not
contain any proviaion, it see .. to me obvious that tbe intent of tbe Cbar~er,
coupled with the atate statute leads to tbe conclusion that a special fund
of &DJ kind for any purpoae other tban a public improvement levy cannot be
aet up by budget and added to from year to year.

The City Manager reported that a water leak bad occurred in a 24"
steel 11&in just north of Bast Hampden in South Clarkson Street. lie discus-
sed the proble .. involved in fixing the leak and restoring water service.

and •utual cooperation in this emergency.
Tbe llayor Pro Te• suggeated that the Water Departaant be co ... nded for
its patience and determination and asked that tbe llanager notify the depart-

The City llanager announced that be was going to take a vacation from
October 12tb eo October 27th. lie stated tbat be would appoint llr. Harold
Babcock aa Acting Manager in bis absence.
