NOVEMBER 21,1960
The City Council of the c .ty of Englewood, Arapahoe County, Colorado,
met in regular session on Monday, November 21, 1960, in the Council Chambers,
City Hall, Englewood, at the hour of 8:00 P.M.
llayor Scott presiding called the meeting to order and the invocation was
given by the Reverend Bert Edwards of the Church of the Nazarene.
The Mayor asked for roll call: Uµon the call of the roll, the following
persons were present:
Councilmen: Braun, Brownewell, Kreiling, Martin, McLellan, Woods, Scott.
Also Present: City Manager Rudd,
City Attorney Esch,
City Clerk Beausang.
Absent: None.
The Mayor declared a quorum present.
PRBSBlfTATION OF CERTIFICATE TO UNITED NATIONS DAY CHAIRMAN
The Mayor presented a certificate to Mrs. Walter B. Wilson, United Nations
Day Chairman for the City of Englewood. The certificate is one prepared by
United Nations Comaittee to recognize the service of the community chairman.

602-63 RENEWAL APPLICATIONS FOR 1961 LIQUOR LICENSES
The Mayor announced that as a newly established policy of the City Council
the applicants for renewal of Liquor Licenses were requested to be present,
rsonally, in addition to submitting Liquor License application at this time.
The City Clerk read the following applications for Liquor License renewal
and representatives from each of the outlets were present:
Frontier Liquors, 3511 S. Broadway,
Silver Saddle Corral 4595 S. Santa Fe Drive,
Englewood Elks Lodge, 65 W. Floyd,
Magnet Ion, 2893 S. Broadway,
John W's Tap Room, 3467 S. Broadway,
Englewood Liquor Store , 3434 S. Broadway,
Dry Creek Liquors, Inc., 325 E. Jefferson Avenue,
Buy-4-Less Drug System, 3421 S. Broadway,
Park-N-Shop Drug, 3370 S. Acoma,
The Glass Bottle, 3439 S. Broadway,
M. D. Pharmacy, 2895 S. Broadway ,
Cberrelyn Drug Store, 4285 S. Broadway,
Hilda's Cafe, 4386 S. Broadway,

The City Clerk read applications for renewal of Liquor Licenses from:
The Plantation, Inc., 5020 S. Broadway,
Bar Harbor, 3484 S .. Broadway.
Representatives of these two businesses were not present at the meeting.
The Mayor gave the Councilmen opportunity to question the Liquor License
operators.
COUllCILllAN BRAUN llOVED, COUNCILMAN MCLELLAN SECONDED, THAT RENEWALS FOR
1961 LIQUOR LICENSES BE APPROVED EXCEPT THOSE RENEWALS OF BAR HARBOR AND
PLAJrrATION OUTLETS. The City Attorney suggested that this restriction on
iasuiDK of the licenses for Bar Harbor and Plantation not be held as the
appearance before the licensing board on renewals is not set forth by state
law. Discussion ensued.

The Mayor asked that the minutes be received and placed on file.
The City Manager remarked that the purchase of an electric typewriter
for that board bad been approved.

The Mayor asked that the minutes be received and placed on file.

Councilman Kreiling inquired about the new office hours for the Library.
Discussion ensued. The Mayor stated that the setting of hours by the Library
Board was within its authority.
The Mayor asked that the minutes be received and placed on file.
602-58 COllllUNICATION FROM CHAMBER OF COMMERCE WITH REGARD TO CHRISTMAS
SEASON
The Mayor read a letter from Mr. Robert Downing, Secretary-Manager of
the Englewood Chamber of Commerce requesting that the City appropriate
$2,000.00 for Christmas street decorations and lighting and that permission
be granted for the Santa Claus worksho p operation at the location of South
Broadway and Girard intersection on the southwest corner of that intersec-
tion.
Discussion ensued.
COUNCILMAN BRAUN MOVED, COUNCILMAN KREILING SECONDED, THAT THE ENGLEWOOD
CHAllBBR OF COllllERCE BE GRANTED PERMISSION TO LOCATE THE SANTA CLAUS WORKSHOP
AT THE CORNER OF BROADWAY AND GIRARD FROM DECEMBER 9TH TO DECEMBER 23RD.
Upon the call of the roll, the vote resulted as follows:
Ayes: Councilmen Braun, Brownewell, K1eiling, Martin, McLellan, Woods,
Scott.
Nays: None.
Absent: None.
The Mayor declared the motion carried.
Councilman Woods inquired as to purchasing of decorations for downtown
rather than renting. Discussion ensued. The question of the ability of the
City to meet the $2,000.00 donation was discussed.

Ordinance," i• hereby amended by adding thereto a new Section 1.9 of Article
l of •aid ordinance, which shall read as follows:
"l.9 It shall be unlawful for any person to loiter, idle,
wander, stroll, er play in, about or on any public, private,
or parochial school, college, or seminary grounds, or build-
insm, either on foot or in or on any vehicle, without having
ao .. lawful business there in or thereabout, or in connection
with such school or the employees thereof; or for any person
to:
Annoy, disturb,. or otherwise prevent the orderly
conduct of classes and activities of any such school;
or
Conduct himself in a lewd, wanton, or lascivious
manner in speech or behavior in or about any such
school building or school grounds."

and salary and wage scale to be practical and realistic, and for the best

GBNBRAL ORGANIZATION
The City Council recognized and adopts as the organizational plan:

Section 6 of Ordinance No. 2, Series of 1953.
(2) The "Public Library Board" established by Ordinance No.
28, Series of 1958.
(3) The "Water and Sewer Board" established by Ordinance No.

(4) The "City Planning and Zoning Commission" established by
Ordinance No. 35, Series of 1958.
(5) The "Board of Adjustment and Appeals" established by
Ordinance No. 22, Series of 1959.
(6) The "Board of Career Service Commissioners" established
by Ordinance No. 13, Series of 1959, as amended.
(7) The "Election Commission" established by Ordinance No.
25, Series of 1959.
(8) The "Parks and Recreation Commission" established by

A City Attorney and Assistants as provided for in the Home Rule Charter.
Section (c) MUNICIPAL COURT
A Municipal Judge and Court Clerk as provided for in the Home Rule
Charter. The ter• of the Municipal Judge shall begin the first Monday in
January after bis election and ahall continue for a term of four (4) years
tberefroa. In the event of a vacancy in the office of Municipal Judge, a
succeasor shall be appointed by the City Council, who shall serve until
tbe first llonday in January after the next election. At the next election
after such vacancy occurs a Municipal Judge shall be elected for a term
of four (4) years beginning the first Monday in January after such election.

Section (e) CIVIL DBFBNSE AGENCY
As provided for by Federal and State statutes, consisting of volunteer
raonnel and cooperating with the City under a Civil Defense Director appo•nted
by the City Manager, but without City departmental status.
ARTICLE II
DUTIES
Section (a) The duties of the existing and recognized Boardsand Commissions
shall be as prescribed within the ordinances creating the
respective bodies.
Section (b) The duties of the Legal Department and of the Municipal Court
shall be as prescribed within the Home Rule Charter.
Section (c) The duties of the Operating Departments shall be as prescribed
by statutes, Home Rule Charter, ordinances, and/or directives
of the City Manager as each may be applicable to the respective
departments.
Section (d) The duties of the Civil Defense Agency shall be as prescribed
by Federal and State legislation. The City Council recognizes
the possible functioning of tbe Agency outside of the
territorial limits of the City of Englewood. In case of a
declared emergency within the City of Englewood, all operating
departments of the City government shall cooperate with the
Civil Defense Director, and shall coordinate ·tbair· activities
and contribute effort, facilities, materials and equipment
for the duration of the emergency.
ARTICLE III

Tbe City llanaser shall receive annually the sum of $10,776.00, payable
in equal aontbly installments, plus $300.00 annually for expenses. Tbe
Municipal Judse sball receive annually the sum of $3,600.00, payable in equal
aontbly installaents. Tbe Municipal Court Clerk shall receive a monthly
salary in Grade 6, to be determined by the City Council. Tbe City Attorney
sball receive an annual retainer of $2,400.00, payable in equal monthly in-
sta11 .. nts; and the Assistant City Attorney shall receive an annual retainer
of $2,100.00, payable in equal aonthly installments; in each case until
cban1•d by ordinance of the City of Englewood. The City Attorney, Assistant
City Attorney or Attorneys, Special Counsel and Special Water Consultant

Tbis ordinance shall take effect and be in force from and after January

Tbe City Council hereby finds, determines and declares tbat it is neces-
sary tbat the provisions of the above and foregoing ordinance be in effect
to coincide with the beginning of the fiscal year of the City, January l,
1961; tbat this ordinance could not be in effect under regular procedures of
passase; that an emergency exists, and that this ordinance is necessary for
tbe preaervation of public property, health, peace or safety and shall take
effect upon passage, specifically as provided in ARTICLE VI above.

The City Manager reported that there was no trunk sewer line easement
in existence for that line located in Block 2, Higgins Englewood Gardens
Addition. Not having such an easement the sewer line runs under private
property upon which the home is to be built. The estimated cost of the
cbange is $750.00 upon which llr. Glen Douthit and Marshall A. Freedman
have agreed to pay one half. Discussion ensued.

Tbe City Attorney reported that llr. Marvin Foote, who bad done consider-
able work toward the recodification of Englewood Ordinance• bad been success-
ful in seeking tbe District Court Chair and be stated that llr. Foote bad
expreaaed tbe inability under the circumstances to continue this project for
tbe City. He urged that the codification be undertaken as soon as possible
by a reputable national company which specalized in this work.
Tbe City Manager stated that this ~as informational at this time.

CITY TREASURER'S REPORT FOR OCTOBER, 1960
The City llana1er reported on forecasts for the year end balances for the
various funda and stated that be would be able to meet the carry over fore-
casts easily at this time. He discussed the need for transfers in the form
of a supple .. ntal appropriation to be authorized at the December 5th meeting.
Tbe City Clerk-Treasurer reported on other details of the financial
state .. nt• and reviewed the information available from these reports and bow
it was Manin1ful to the City llana1er and the citizens.
The llayor co1UD&nted briefly on the rebuttal from Mr. Leslie Whittemore
on letters written in connection with the June 30th audit report by the City
llana1er and City Clerk-Treasurer. He expressed disappointment that news-
paper coverage was given prior to the consideration by the Council of the
matter. Tbe City Clerk-Treasurer issued a short statement on this last
letter issued by the auditor.
The llayor asked that the Financial Report be accepted and placed on file.
APPLICATION FOR RETAIL LIQUOR LICENSE
Mr. L. V. Bonen was present to discuss a proposed application for Liquor
License with the Council. He stated that he was presently in Sheridan but
was being forced to relocate bis liquor licensed drug store due to the High-
way intercban1e at South Santa Fe and West Hampden Avenue. He stated that be
would seek an application for liquor store. Discussion ensued. Tbe City
Attorney discussed the need for a clear ·-cut distinction between the ending
of the one operation and the commencing of the other. He suggested that no
for ... 1 application be filed with the City Clerk at this time.
