Mrs. Bullen spoke as Chairman of a commi t ee in interviewing the Coun-
cil in an effort to sponsor a project to build a park, drive and swimming
oool.
· Estimates were given by ~!ssrs. Kelley and McKinstry relative to costs
of the project, toget 'er 1th the landscaping.

RESOLU'TION

WHE REAS the Colorado Central Power Co. is now serving electricity to the
City of Englewood under authority of Ordinance No. 40, Series of 1904 1 and
under Ordinance No. 5, Series of 1920; and
WHEREAS, said Ordinances provide for purchase or condemnation of the el-
ectric distributi on equipment and property of the said corporation in ingle
ood; and

WHEREAS, under an agr e ement betw een the said corporation and the City of
Englewood, entered into March 21, 1933, known as the "stand-still" agreement,
the City agreed not to condemn before October 11, 1935, and the Colorado Cen-
tral Power Company agreed, among other things, not to resist the purchase or
condemnati vn of said distribution system on October 11, 1935, or at any time
subsequent thereto, and
WHEREAS the City Council believes it to be for the b e st interest of the
City to purchase or condemn said distribution system and p r perty of the Colo
rado Central Power Company,
jOW, THEREFORE BE IT RE SOLV ED: That the Colorado Central Power Company be
notified at oace that t e City of En~le woo d will exercise its right as res-
erved in the said ordinanc e s, and further expressed in the aforesaid "stand-
still" agreement, to purchase or cond e mn the electric distribution system and
property within the City of Englewood, and the Mayor, t he City Clerk, and the
City Attorney are her eby authorized and ord e red to proceed on October 11 1 1935
with the necessary legal steps to purchase or condemn the said property as a-
foresaid, and
BE IT FURTHF.R RESO~V E D: That the lnte11t f the Council is hereby declared
to be to sav e and exercise all the legal rights r e served to the City of Eng-
lewood in the afor e said ordinances and all the additional rights and agree-
ments 6iven to the City of E ngle ~ood in the said "stand-still" a 6 reement by
the Colorado Central Power Company.
