The City Council of the City of Englewood, Arapahoe County, Colorado,
aet in regular aeaaion on Monday, Movember 16, 1959, in the Council Chambers,
City Ball, Inglewood, at the hour of 8:00 P.M.
llayor Scott preaiding called the meeting to order and the invocation
was given by the Reverend L. R. Kerby of the Free Methodist Church.
Tbe llayor asked for roll call. Upon the call of the roll, the following
persons were present:
Councilmen: Braun, Brownewell, Hill, Kreiling, McLellan, Woods, Scott.
Also Present: City llanager Rudd,

The City llanager presented a plat of this proposed resubdivision to the
Council. The area concerned is in the vicinity of east Bates and South Downing
and the area southwesterly thereof.

Tbe City Clerk read the following recommendation from the City Planning
and Zoning co .. iasion:
"That the final plan for the subdivision of the one-block
annexation south of West Belleview known as Signal Hill
Subdivision be approved subject to correction of the plat
to show a drainage easement as an extension of the roadway
and notation of future right-of-way needed for West
Belleview Avenue; and subject to all other requirements
of the Subdivision Regulations."
Councilaan Braun stated that the conditions as set forth in the recom-
11endation have been met as shown in the Signal Hill Subdivision plat pre-
sented to the Council.

Consideration of the Resubdivision of Colman Subdivision
The City Clerk read the following recommendation of ·the City Planning
and Zoning co .. isaion:
"That the final plan of the Colman Subdivision be
approved subject to the prior approval by the City
Engineer and the Planning Off ice as to engineering
details, and in accordance with the Subdivision
Regulations."
llr. Rex Garrett, Realtor, stated that the Planning Comaisaton baa approved
the proposed resubdivision. He reported that be bad secured 34 signatures of
owners on the plat. The City Attorney stated that the holders of encuabrances
and mortgages on properties included in the proposed resubdivision should also
sign the plat and that the ownership list originally used in the subdivision
should be revised to show recent changes in ownership. llr. Garrett replied
that be would secure what additional signatures were neceaaary and that be
bad secured .any of the signatures of new owners in the area in the course of
pirculating ~the plat up to this time. He requested special permission to seek
building peraita in the subdivision as proposed as the particular subdivision
baa been in process for nearly four months which bas delayed construction of
several bo11es in the area and the owners of those properties are becoaing
anxious to start construction.
The llayor reviewed the terms of the recommendation and asked llr. Garrett
if those conditions bad been fulfilled. Iii-. Garrett replied that they were in
the process of being fulfilled and would be completed soon. The llayor suggested
that the Council consider recessing until November 23rd to consider the pro-
posed plat after the conditions of the recommendation of the City 'lanning
and Zoning co .. isson bad been met.
Minutes of Noveaber 16, 1959
llr, Qarrett specifically asked permission for one building permit
i ... diately. The City Manager replied that issuance of the permit prior
to tbe approval of the final plat is a very serious and far-reaching pre-
cedent and recoa .. nded that tbe period between this meeting and the sug-
gested recessed meeting of tbe Council on next Monday be used to coaply
with tbe conditions as set forth by the City Planning and Zoning co .. ission.
The Mayor suggested that the Manager review the conditions of the
City Planning and Zoning co .. ission with regard to this subdivision and
instruct the Building Inspector to act accordingly. This proposal was
agreeable to llr. Garrett. The Mayor requested that the Council recess
to llonday, Moveaber 23, 1959 at 8:00 P.M. to consider this matter only.

Revision of Tap Fee Schedule in South Arapahoe Sanitation District
The City Clerk read the following recommendation of tbe ·Water and
Sewer Board:
"That the City renegotiate, by amendmen ·t, the
Connector's Agreement between the City of
Englewood and the South Arapahoe Sanitation
District, on the basis of the proposed amendment
attached hereto, subject to any revision necessary
for proper legal form."
PROPOSED AllBNDlllJIT TO CONNECTOR'S AGRBBllBNT
THIS AllBlfDllBJIT, aade and entered into by and between the CITY OF
BlfGLSWOOD, acting by and through its duly authorized llayor and City
Clerk, hereinafter referred to as City and SOUTH ARAPAHOE SANITATIO!f
DISTRICT, ARAPAHOE COUNTY, COLORADO, hereinafter referred to as District;
WHBIBAS, on the 8th day of November, A.D., 1957, the City entered
into a Connector's Agreement with the District concerning the connection
of the District sewer collection facilities to the City's sewage system,
and:
WHBRBAS, said agreement provided for certain tap fee charges for a
period of two (2) years from date hereof, at which time this fee shall
be renegotiated, and thereafter shall be renegotiated biennially on the
anniversary date of this Agreement, and:
WHBRBAS, the 8th day of November, A.D.,,1959, is the first biennial
date.
MOW, TllB .. PORB, IN CONSIDERATION of the premises and of the mutual
covenants of the partie• hereto, it is agreed as follows:
1. That Paragraph 5 of said Connector's Agreement is hereby
amended to read as follows:
The District specifically agrees that all service
connections which are made to the District's
sewer line at any time are subject to the super-
vision and inspection by the City, and that all
such installations shall conform to the saae
standards as required within the City liaits.
It ia further agreed that there will be a bead
tap or connection fee for future plant expansion
charged by the City to the District or its
assigns, for each tap made within the District,
after Moveaber 8, 1959, based on the following
schedule:

Tbe City Clerk read the following recommendation from the Englewood
Water and Sewer Board:
"Revision in Bate Schedules For Water Service
Tbe ~itagraph APPLICABILITY, under City of En1lewood
RATB SCHBDULBS FOR WATER SBRVICB, effective July 1,
1958, RATB NO. l (Flat Rates), presently reada as
follows:
APPLICABILITY:
Applicable only to residential consumers actually
taking service at the schedule rates as of July 1st,
1958.
Recoa-ndation: Tbat the above paragraph be revised, by resolution, to read
as follows:
APPLICABILITY:
Applicable only to consumers who may take water
service under flat rates, as of July 1, 1958,
where water service, used exclusively for resi-
dential purposes, is supplied to less than four
family units. (For four family units and more,
see Rate No. 2.)"
The City Manager reported that the Water Departaent· for some time
baa deterained that the residential rate shall apply to those residential
unite b&vins leas than four family units ~·and that the proposed amendment
will provide for the legality of this present policy.

Tbe City Clerk read the following recommendation of the Bnglewood
Water and Sewer Board:
"That Tipton and Kalabach, Inc., be authorized to
coaplete tbe plans and apecifications for Meadow
Creek Reservoir, and that llr. Tipton be notified,
by letter, of the action."
Council.an Kreilin1 reported that this is part of the continuing
pro1raa of le1al due diligence in developing the Meadow Creek Water
&i1bta. The City llana1er stated that completion of the dam specifica-
tions repreaenta the final act in the project which bas approximately
$19,500.00 cost.

Tbe City Clerk read the following recommendation from the Englewood Water
and Sewer Board:
"That the City proceed to advertise, as soon as possible,
for bids for construction of the proposed addition to the
Englewood Sewage Treatment Plant."
The City llana1er remarked that this action is in connection with the re-
quired procedure relating to the proposed addition to the Sewer Treatment
Plant and the Federal Grant of monies for that project.

The City Clerk read the following recommendation from,-£he Englewood
Water and Sewer Board:
"That the proposal of Coughlin and Company, also re-
presenting the firms of Peters, Writer and Christensen,
Inc., Bosworth, Sullivan and Company, and Boettcher
and Company, for the preparation and financial services
in connection with the issuance of $750,000 of Water
Bonds, at a rate of $8.63 per $1,000, be accepted."
The City Manager discussed the proposal and the rate of $8.33 per $1,000
bonds issued. Be stated that this amount had been negotiated with llr. Imhoff
prior to the acceptance of this proposal by the Water and Sewer Board.

The City Clerk read the following recommendation from the Englewood Water
and Sewer Board:
"That the City purchase from the Colorado Central Power
Company, one and one -half acres of land, more or less,
located north of West oxford Avenue and west of the
South Platte River, includiDB tbe present pumping station,
to be used as the site for a "summer-time" filter plant,
providing that an adequate easement for access and pipe-
lines can be obtained, for a total price of $2,300."
The City Manager explained that this site will provide facilities for the
clarification and treatment of ditch and well water to be useA to supplement
the Englewood Water System during summer peak usages. He explained that al-
though during the winter usage is approximately three million gallons per day
that during the summer this consumption often rises to thirty million gallons
per day.

on a payment plan to be worked out mutually by the City
Manager and the FOwer Company."
The City Manager reported that the City has bad use of this water for

title ihe party concerned bas sought this action to clear the title of various

to tbe City Attorney for his investigation and recommendation.

The llayor asked the members of the Council if they desired to reconsider
the licensing of the Beefeater Restaurant. Councilmen Kreiling, McLellan and
Braun spoke, stating that a public hearing had been held on this license at
the time it was originally issued and that if there is a legal question involved
that the matter will be reconciled in the courts.
Councilman Braun suggested that the owners and/Gr operators of the various
liquor establishments should appear at the meeting so that the Councilmen may
become acquainted with them. He stated that he would also like to review the
Police Reports on each individual outlet. Discussion ensued. The Mayor sum-
marized the discussion by recommending that the applicants for renewal Liquor
Licenses be informed that the Council desires to have them apply personally
before the Council next year at which time the renewals of the 1961 licenses
are considered. Discussion ensued.

The City llana1er discusaed the revisions to the 1960 Bud1et as originally
filed and considered by the Council whereby the entire Buainess and Occupational
Tax is bein1 included in the Capital Improvements Program. The llayor ~•viewed
that both 119aaurea on the ballot relating to off-street parking and providing
for financing of special project• were defeated. Re reviewed that many persons
were present at the infor .. l .. eting of the City Council held last Friday,
Roveaber 13, 1959 at which ti .. the question of the Business and Occupational
Tax was discussed. The tentative decision of the Council was to place the
fund8 fro• that source of revenue in the Capital Improvements Budget. He dis-
cuaaed the recommendation q' the Capital Improvements Finance co .. ittee that
the Bwllaeas and Occupatio~?rax be abolished upon the paaaage of the Sale•
Tax Ordinance.
The llayor inquired what the Business and Occupational Tax should be
uaed for if retained and/or what would be the effect on the City's operations
if it were repealed? He stated that if the Business and Occupational Tax
were retained that it would be used for paving and street improvement in the
co ... rcial areas.

llr. Cbalmerse Parker, asked if the monies would be used for the 1960
paving program, stating that should it be used fen-this program be was in
favor of the license and felt that it should be continued.

spoke against the continuance of tbe Business and Occupationat.1Tax simply as
a source of revenue. Tbe conaenaua of the opinion was that the Capital Im-

the Council should reconaider. Soae indicated a desire that it be continued
if definitely used in buain••• and coamercial areas for developmen~ of those

The City Council recognize• and adopts as the organizational plan:

Section 6 of Ordinance No. 2, Series of 1953.
(2) The "Public Library Board" established by Ordinance No. 28,
Series of 1958.
(3) The ''Water and Sewer Board" established by Ordinance No. 34,
Series of 1958.
(4) The ''City Planning and Zoning Commiasion: established by
Ordinance No. 36, Series of 1958.
(5) The "Board of Adjuet11ent and Appeals" established by

A Municipal Juda• and Court Clerk as provided for in the Boae Rule
Cbarter. The ter• of the Municipal Judge shall begin the first llonday in
January after hi• election and •ball continue for a term of four (4) years
tberetroa. In the event of a vacancy in the office of Municipal Judge, a
•ucceaaor :•ball be appointed by the City Council, who shall serve until the

Aa provided for by Federal and State statutes, consisting of volunteer
peraonnel and cooperating witb tbe City under a Civil Defense Director appointed
by tbe City Manager, but without City departmental status.
ARTICLE II
DUTIES
Section (a) Tbe dutie• of the existing and recognized Boards and Collllissions
sball be aa preacribed within the ordinances crea&ing tbe respec-
tive bodiea.
Section (b) Tbe dutie• of tbe Legal Department and of the Municipal Court
shall be as prescribed within the Hoae Rule Charter.
Section (c) Tbe dutie• of tbe Operating Departments shall be as prescribed
by statute•, 11o .. Rule Charter, ordinances, and/or directives
of the City Manager as each may be applicable to the respective
departments.
Section (d) Tbe duties of the Civil Defense Agency sball be as prescribed
by Federal and State legislation. Tbe City Council recognizes
tbe poasible functioning of the Agency outside of tbe territorial
liaits of tbe City of Englewood. In case of a declared emergency
within the City of Bnglewood, all operating departments of the
City 1overnaent aball cooperate with the Civil Defense Director,
and •ball coordinate their activities and contribute effort,
facilities, materials and -quipment for the duration of the
eaer1ency.

The City Manager shall receive annually the sum of $10,500.00, pay-
able in equal aonthly installments, plus $300.00 annually for expenses.
Tbe Municipal Judge shall receive annually the sum of $2,600.00, payable in
equal monthly instal·lments. The Municipal Court Clerk shall receive a monthly
salary within Grade 6, to be determined by the City Council. The City
Attorney shall receive an annual retainer of $2,400.00, payable in equal
11e>ntbly inatallaents; and the Assistant City Attorney shall receive an annual
retainer of $2,100.00, payable in equal monthly installments; in each case
until changed by ordinance of the City of Englewood. The City Attorney,
Aaaiatant City Attorney and Special Water Consultant shall receive such other
and further coapensation from time to time for special services as the City
Council may determine and allows.

ARTICLE V
If any section, subsection, sentence, clause or phrase of this
ordinance i• for any reason held to be unconstitutional, void, or invalid,
the validity of the remaining portions of this ordinance shall not be
affected thereby.
ARTICLE VI
Thia Ordinance shall take effect and be in force f10m and after
January l, 1960.
ARTICLE VII
The City Council hereby finds, determines and declares that it is
necessary that the provisions of the above and foregoing ordinance be in
effect to coincide with the beginning of the fiscal year of the City,
January l, 1960; that this ordinance could not be in effect under regular
procedures of paaaage; tbat am e1P9rgency exists, and that this ordinance is
necessary for the preservation of public property, health, peace or safety
and shall take effest upon passage.

July 8, 1958, a budget for the fiscal year 1960 was duly submitted by the
City Manager to the City Council on September 16, 1959, for consideration
by the Council at its regular meeting on September 21, 1959: and,
WHBRBAS, a public bearing on the said budget was held by the
City Council within three weeks after its submission, on October 5, 1959,
at the regular .. eting of the City Council, regular notice of the time and
place of said bearing having been published within seven days after submis-
sion of the budget, in the manner provided in the Charter for the publica-

RKLATING TO DISTRICT COURT DECISION CONCERNING RBGULAR MUNICIPAL
ELICTION
Tbe City Attorney asked what the Council wished bia to do relative
to appealin1 the decision ordering the City Clerk to include &n the liat
of candidates for the November 3rd Regular Election two persons wbo did
not coaply with the requirements for candidacy as set forth by tbe City
of Bn1lewood Charter. He stated tbat_he felt that the appeal to a higher
court fro• tbe District Court would/~ademic as the District Court deci-
aion does not form a precedent on this matter. He recommended that the
aatter be dropped at tbis point.
Tb• llayor witb the approval of the Council instructed tbe City
Attorney not to puraue tbe matter of the unfavorable decision of the
Diatrict Court of the Blection candidacy of two electors in District
One.

Tbe City Attorney reported that be bad received a letter from llr.

•tated that the department is not in a position to accept the responsi-
bility for the maintenance or enforcing the maintenance of the Englewood
Daa. lie •tated that the responsible owner should contact the depart-
aent for information relating to proper maintenance of this structure
which 1• bi• responsibility and that the Engineer's Offic• would cooperate
~· the fullest extent.

Tbe City Manager presented a series of suggestions with regard to
appointll8nt• necessary at the first of the year and other matters of a
•iailar nature to the Council. He also suggested that the matter be re-
ferred to the City Attorney whereby rules and procedure tor the Council
taking office on January 4, 1960. Councilman Braun sugges*ed that every
other roll call be in inverse order. Discussion ensued.
Councilman Kreiling inquired if there were any other sections of tbe
City Charter to be activated. The City Manager replied that the remain-
ing •ectiona of the Charter not previously activated automatically go in
to full force and effect January 1, 1960.
