Clerk read a communication from the Secretary of the library Board, Mrs.
Della H. Walton, notifying the Council of the expiration ot the terms of
rs. Frankie Everett and leo Goorman; as well as the vacancy caused by the
death of Ur. J.C. McCord.
The board recommended the rea pp ointment of Mrs. Everett and Ur. Goorman
tor the terms ot three years; and Mr. Edwyn N. Roberts for the vacancy ot
two years.

WHEREAS the following described property, to-wit:
Lots 17 to IO; Block 15; Englewood;
Lots 20 to 30; Slock 2; Taylor's Addition;
lots 10 to 12; Block 3; Premier Addition;
are each delinquent in the payment of special taxes over a period ot several
yeara, and

WHEREAS the owner• thereof, W.J. Moberly; H.F. Bittner & Aubieteen Bittner;
and E.L. Thompson; respectively, have offered to pay the amount ot the special
delinquent taxes, together with interest thereon at the rate of six pervent (Sfo)
per year; and the Council believes it to be to the best interest ot the City to
accept such ofter;
NOW THEREFORE BE IT RES OlVED: That the County Treasurer be and he ia hereby
authorized to accept as payment in full the amount of the said delinquent install-
ments, together with interest thereon at the rate of six percent; and to issue a
receipt in full therefor.

Alderman Jenkins introduced the following resolution:
RESOLUTION
WHEREAS the Massachusetts Bonding and Insurance Company has notified
the City that they are unwilling longer to be surety on the official bond
of D.M. eat as City Treasurer, and
WHEREAS Chapter 87, Section 99, paragraph 2, of the Colorado Statutes
Annotated 1935, provides that in such case the treasurer shall be notified
of auch action in writing and if he then fails or neglects to furnish an-
other bond satisfactory to the City Council, within ten (10) days, the City
Council shall declare the office vacant and appoint some peraon to fill the
vacancy, and
WHEREAS such written notice has been served on D.M. West as City Treas-
urer on September 13, 1937;
O ~ T'EREF RE BE IT RESOIVED: That if said D.M. W~st as City Treasurer
does not furnish another bond as required by Statute on or before September
23, 1937, t he office of the City Treasurer shall become vacant and said
vacancy shall be filled in the manner provided by law.

Alderman Coombs introduced the following resolution:
RESOIUTION

WHEREAS the contract for the construction of a Municipal Waterworks,
entered into between the City of Englewood, a municipal corporation, and
onroe Electric Company, a corporation, on the eighth day of April, A.O.
1935, has been heretofore cancelled and annulled, and
WHEREAS, Monroe Electric Company furnished a construction bond to
lnaure the said city the faithful performance of said contract, with the
Standard Accident Insurance Company of Detroit, Michigan, as surety in
the sum ot Three Hundred Ten Thousand and No/100 Dollars ($310,000.00)and,
~EREAS It is the desire of all parties, and for the best interest of
all parties that they be released from further liability arising from said
contract,
n~ T ~E~EF RE BE IT RESOlV ~D: That said bond be cancelled and returned
to the .!on roe Electric Company, the surety, Standard Accident Insurance Com-
pany, be released from further liability thereunder, and the parties to the
construction contract released from further liability thereunder and
IT IS BY THIS RESOLUTION SO ORDE RED.

Dr. Weigand explained a proposal for housing dogs at the Dumb Friends
league at a rate of 25¢ a day for a period of four days, pending their
reclamation by their owners, or extermination at the end of that period.

The City lerk was instructed to write .J r. E.T. Paca, 4306 So. Wash-
in ton t., that it was the opinion of the Council that the ordinance
ertainin to the keeping of goats in the city limits should be con-
formed with; and that he would have approxi ma tely 30 days to dispose
of his excess number above the two female goats allowed.

The City Clerk reported that all the returns of the Municipal Ele~tttc
light and Power Plant Election, held on Friday, September 3rd, A.O. 1937,
had been returned and were then and there in his custody and possession.
The Mayor thereupon directed the City Clerk to open the returns of the
said Municipal Electric light and Power Plant Election in the presence ot
the Council. The City Clerk thereupon opened the returns which were then
canvassed by the Council, and the canvass showed the result or the election
to be:

Ele ctric l i ght and Power Plant and Electric Distribution System was duly
held on Fri'day, September 3, A.O. 1937, in accordance with Ordinance No.
2, S er i es of 1937, entitled, "AN ORDI NANCE ADOPTI NG A PIAN FOR THE AC-
UISI TI ON OF A r.m J ICI PA 1 I y OWN ED El ECTRIC 1 IGHT AND POWER PLANT AND
ElE CTRICAl DISTRIB UTI ON SYSTE M, AND PR OVIDING FOR AN ElECTION AT WHICH
THE UESTI ON OF APP ROVI NG THIS ORDINANC E SHAll BE SUBMITTED TO A VOTE
OF THE UA LIFIED PROPE RTY ELEC TORS OF SAID CITY," and in accordance with
notice duly given as provided by law; and
WHER EAS all the returns of the election of September 3, 1937, afore-
said h ave been returned and have been o pe ned by the City Clerk in the
p resence of this Council and duly canvass e d by this Council according
to law; and
WHE REAS it a p p ears . from t he said canvass that the result of the election
