Councilman Braun moved )
McLellan seconded) that the bearing be opened.
Reverend O&kes of 4760 So. Kalama.th Street presented a petition requesting
tbat the 4600 • 4700 Block So. Kalamatb be left out of the Pavin1 District because
of several vacant lots in the area which would necessitate cutting of the streets
when construction was started.
The following residents were also beard.

prepare inforaation for this session, but that such would be ready for presenta-
tion at tbe June 2nd session.

Avenue and Irvin1 Street, further described below, be allowed to annex to both the
Valley Water District and tbe Valley Sanitation District, by suppleaental asreeaents,
no sewer taps to be cbar1ed a1ainst the present allotment of the Valley Sanitation
District and with tbe following provisions:
1. That tbe sewer tap fee, payable to the City of Englewood by School District
Ho. 75, is baaed on one tap charge for each twelve (12) occupants of the
school at $50.00 per tap, tbe total of which is to be multiplied by one-half
to correspond with tbe siailar portion of a year which the school is in
session or in use, additional tap charges to be negotiated upon any enlarge-
ment of tbe school usin1 tbe same formula but based upon the tap fee then
in effect.

Ordinance de•cribed and provided to be constructed in said Paving District,
in an a11e>unt not to exceed tbe cost of said improvements, including en1ln~r
ing and all incidental expen•es, as in said law provided.
Section 6. Said bond8 •ball be authorized by an Ordinance later to be
passed in accordance with tbe laws of tbe State of Colorado, and the Charter
of said City,if adopted.
Section 7. Tbe Mayor and City Clerk are hereby authorized to advertise
for bids to construct sucb iaprovements in four (4) consecutive weekly issues
of tbe Englewood Herald and Enterprise, a newspaper of general circulation
published in such City, which advertisement may run concurrently wltb tbe
publication of this Ordinance.
Section 8. By reaaon of tbe fact that tbe completion at tbe earliest
possible date of tbe iaprove .. nt• described in and conteaplated by tbla
Ordinance is necessary to tbe i ... diate preservation of tbe public safety,
it is declared that an emer1ency exists and that this Ordinance shall take
effect five (5) days after its final publication.
Section 9. All ordinance•, or parts thereof in conflict berewitb are
hereby repealed. This Ordinance, after its final passage, shall be reco~~ed
in a book kept for tbat purpoae, shall be authenticated by tbe signature of
tbe llayor and City Clerk, aball be published in said City, and after becoaing
effective, shall be irrepealable until tbe bonds of said District shall be
paid in full.

Kr. Joseph Esch gave a report on the insurance covering Station KGIE and
presented a Certificate of Insurance as carried by Ludwig & Jorgensen.

Kreiling seconded ) that Lessee*s of City propert1 be required
to carry Liability Insurance in an adequate
amount and that the Insurance companies be
required to give the City 10 days Notice of
Cancellation, and a Certificate of Insurance
should be furnished to the City.

The City Attorney stated that the City would make itself liable to a damage
suit if it installed a permanent pump in the 3300 Block, South Ogden Street, tbe
residents in that area bad petitioned the City for a pump and had pledged
$680.00 toward purchase of the pump.

Mayor Scott stated that the committee formed to negotiate with the Clapp
Brothers for the purchase of land for extension of the Sewage Treatment Plant
bad been unable to reach an agreement on the price of the land.

The following Resolution was presented and read in full.
RESOLUTION
WHEREAS, there bas been proposed an amendment to Article XX of the
Cons ti tut ion of the State of Colorado, popularly known as the ,"Simpson Plan,"
which provides for the creation of new cities and counties of Denver, Colorado
Springs and Pueblo, for further annexation by such cities and counties, for
the formation of other and further cities and counties, for future unilateral
annexation of further and additional territories by cities and counties and by
home rule cities, and for other and further powers and purposes in support
thereof as set forth therein; and,
WHEREAS, it appears that suburban areas and adjoining municipalities
of such annexing cities and counties and home rule cities would have no voice
in whether or not they were to be annexed to said cities and counties and home
rule cities in the event of the adoption of said Constitutional amendment; and,
v·HEREAS, it appears that said Constitutional amendment embodies an
undemocratic, arbitrary and dangerous invasion of the rights of the suburbs
and municipalities adjoining said cities and counties and home rule cities and
of the citizens thereof, and is based on highly questionable and controversial
economic, political and social ground•; and,
WHEREAS, it appears that the City of Englewood should in every pos-
sible way cooperate with other municipalities and their citizens in opposing
the said proposed amendment:
KOi THEREFORE, BE IT RESOLVED by the City Council of the City of
Englewood, Colorado, that the said City Council go on record in coaplete and
all-out opposition to the aforesaid proposed amendment to Article XX of the
Constitution of the Stata of Colorado, known as the "Simpson Plan."
BE IT FURTHBR RESOLVBD that the City of Englewood shall become a
member of the trust known as the "Urban Mayors' and City llanagers' Trust"
and contribute a sum equivalent to one-tenth of one mill on its assessed
valuation to the said trust to be used and expended for the uses and pur-
poses thereof in opposition to the proposed amendment to Article XX of the
Constitution of the State of Colorado, known as the ~Simpson Plan."
BE IT FURTHER RBSOLVBD that the proper officers of the City of
Englewood be, and they are hereby authorized, empowered and directed to
sign and execute the Urban Ila.yore' and City Managers' Trust Aaree11ent on
behalf of this city, and to disburse to the trustees of the said trust the
amount hereinabove authorized.
