PRBSEMT: Braun, Brownewell, Martin, Graham, Bill, Kreiling, KcLellan, Woods and Scott. ABSBMT : Mone. Councilman Hill moved ) Graham seconded ) • • • • • • * * that the bearing be opened on the applica- tion of the swiss Society of Denver for a 3-way liquor license at the Soutbeaat cor- ner of the Hampden Downin1 intersection. llr. A. G. Notarianni, Attorney representing the SWiss Society of Denver, spoke regarding the operation by the club if the license was 1ran~ed, stat- ing that it would dispense liquors only to members or to or1anizations leas- ing the hall for special meetings. A petition supporting the request for a liquor license signed by 26 residents of the area was presented. llr. Summers speaking in opposition to the issuance of the liquor license presented petitions signed by 146 residents of the area, and presented the following as bis reasons for opposing same. I hereby protest the -issuance or an approval of a hotel and restaurant liquor license to an organization known as the swiss Society of Denver, I protest for the following valid reasons: First that the applicant is nQt a qualified applicant, that the applicant bas no operatin1 restaurant, no building and owns no real estate within the boundaries of the City. Second that the posting of the public notice was illegally done. That while the applicant made application for a hotel and restaurant liquor license the public notice stated that the place was to be operated as a Club. Following is the wording of the public notice. Pursuant to the liquor lawa of Colorado. The Swiss Society of Denver has requested the licensing officials of Englewood, Colorado, to grant a license at this location to dispense (as a Club) malt, vinous and spitituous liquors. Thus the people were deceived in believing that tbe establishment was to be· operated as a membership club closed to the public and operating under a club liquor license. Signed M. Councilman Woods moved ) KcLellan seconded ) that in view of the oppoaition as evidenced by petitions and failure to abow need, that the request for a liquor license be denied. Hall, Attorney for Automart Stores, Inc., spoke regard- ing tbe operations of the store and introduced the owners of tbe store. Jlr. Ball tben presented exhibits as follows, a picture of tbe store showing 2 notices posted in the window1 , one of tbe notice• wbicb was posted in tbe window, tbe Notice of Publication, a plat showing the areas canvassed by petitioners, and petitions signed by 527 residents approvin1 tbe issuance of tbe license. llr. John P. Roscoe, president of the firm, spoke briefly on tbe opera- tion of the store. Jlr. Su1111ers of 3140 so. Delaware spoke in opposition to tbe i••uance of a 3.2 beer license stating that any commercial ·establishment effects all tbe people in tbe City and tbe issuance of this license opens the way for all stores to sell 3.2 beer, and wbicb would make 3.2 beer a COllllOD co111110dity. llr. Ball stated that 3.2 beer was a legal commodity and that it was up to the Council to decide wbetber it was the wishes of tbe people. Councilman Graham moved ) McLellan seconded ) that the application for a 3.2 beer license for Automart Stores, Inc., at 123 East Belleview Ave. be granted. Clarkson St. in the 3300 • 3400 blocks, fro• R-1-D • C-2 to R-3-A Zone District. AYES: Braun, Brownewell, Martin, Graham, Hill, Kreiling, KcLellan, Woods and Scott. NAYS: None. ABSENT : None. Dr. Clifford Roosa and Dr. Charles Huff of 2465 So. Downing stated that they wished to build a clinic near the Swedish Hospital if the zonin1 could be changed to R-3-A. llr. J. c. Frazier a representative for Kline• Hardesty stated they would like to build a nice rest home or nice apartments in tbe area. Jlr. Raymond Underhill of 3490 So. Clarkson Street stated be was against the change of tbe C-2 District on Hampden, but was not opposed to tbe change of that portion now R-1-D. llr. L. c. Bassett of 3501 So. Clarkson stated be was opposed to tbe cbanae from C-2 district, as it would prevent a change in business on that corner. Dr. Charles Huff stated be was not concerned about the change on Hampden as all be was interested in was that portion in tbe Mortb section now in R-2 District. Councilman Braun moved ) Brownewell seconded ) that the attorney be inatructed to prepare the ordinance which would change the zonin1 of the R-1 Diatrict to R-3-A District,but not chan1in1 the present C-2 zonin1. Houston, State Inspector of Oils, spoke re1ardin1 the proposed ordinance regulating filling stations, and opposed the adoption of the ordinance. • • • • • • • • The following recommendation was received from the Water Advisory Board. That a letter be written to the South-east Englewood Water District advising that district that inasmuch as the provision in the distributor's contract re1arding the high level reservoir requirements have been complied with, the stipulation limiting the number of water taps to 600 will no longer be in effect and that all other provisions shall remain the same. Councilman Bill moved ) Braun seconded ) that the above recommendation be approved and the Mayor be authorized to sign. That the Water and Sewer Board's Legal Counsel be authorized to join with the City of Denver and the City of Littleton in a suit to prevent the use of the Clark Water fi1hts immediately, upon determination by the attor- neys for said cities and the engineers that said suit i• neceaeary. That a contribution of two hundred and fifty dollar• (250.00) be made to the Colorado Water Congress, ICharles c. Fiske, Secretary-Treasurer, P. o. Box 492,Denver l, Colorado. Wheeler to determine whether or not the rights are worth one hundred fifty dollars ($150.00) per inch. Councilman Martin moved ) Rill seconded ) that Mr. Wheeler investigate the Water Rights. Article 108 of ordinance No. 39, Series of 1957, is hereby amended by adding thereto a new Section 108.1.8, which shall read as follows: "Section 108.l.8 PERMITS TO PARK FOR PERICl>S OF TillB IN EXCESS OF THB TlllB LIMITATIONS ON CERTAIN STRBBTS. (a) Permits. The Traffic Engineer, or such person as be may designate, is hereby authorized to issue permits to allow vehicles which are used to transport tools, materials and supplies necessary to construct, recon- struct or repair buildings, structures and the appurte- nances thereto to park for periods of time in excess of tla time limits posted on streets within the City of Englewood, Colorado, while the operator of such vehicle is engaged in effecting such construction, reconstruction or repairs; provided that nothing ia this section shall be construed to allow any vehicle used primarily in cleaning or maintenance operations so to park; and provided further that nothing in this section shall be construed to authorize the stopping, standing or parking of any vehicle in bus stops, loading zones, places where all parking is prohibited, or to evade any other more restrictive parking regula- tions. (b) Mature of Permit and Fee. The permits authorized in subsection (a) above shall be in such form aa sball be determined by tbe Traffic Engineer; shall be issued for one day for a fee of One Dollar ($1.00); and shall be limited to parking within the reasonable vicinity of the address designated thereon only, not to exceed one block from said address. (c) Display of Permit. Every sucb vehicle parked pursuant to the provisions of this section in excess of the posted time limit, at all times while so parked shall have prominent~J displayed on the windshield of such vehicle, in a position to enable easy reading, tbe permit described in subsection (a) above.
