Pursuaat to tbe action of tbe Council in paasiag tbia Ordinance, wbicli
incidentally covered only tbi• •pecific property, and in reliaace upon
tbe action of tbe Council, llr. Allen made an invest .. at of •oae $7,000.00
in remodellin1 tbe building into a IMidical clinic. Dr. Davia alao aade
sizeable iaveataenta therein.

Tbe cbaa1e was not noticed in tbe general publication by either tbe property
owner or bis tenant, Dr. Davia. Barly in 1958, tbe tenant desired to ia-
creaae tbe •ize of tbe buildln1, and in applying for a perait, waa adivaed
specifically for tbe first tlae tbat·tbe use was non-conforming.
Thereafter, application was made to the Planning Colllliaslon to place
tbi• property back into a conf oraing use by extending tbe C-2 co ... rcial
Di•trlct wblcb it adjoins and abuts. In effect, tbls was not a requeat
for a change of an area to a new type of zoning; rather, tbe requeat
aiaply was to replace it in its proper cate1ory, tbe building beiag a aew
building and having been zoned for tbe specific purpose for wbicb it waa
u•ed. In support of the request, there was attached a petition circulated
in tbe neighborhood containing tbe signatures of in excess of SOI of tbe
property owners in tbe neigbborhood,consentin1 to any such change aad
joining in tbe request for change for tbeae specific lots.
Tbe property was duly posted as required and a bearing bald. At tbe
bearing, no one appeared to protest the chan1e,. and after taking tbe matter
under adviaeaent, the Planning Commission on Septeaber 18, 1958 denied
the request, based upon a statement that there was no need on the b&8is
of exi•tin1 use or de11&Dd, a~d that it would be a violation of tbe City
Council's zoning policy as to area requirements.
Aa Cou1111el for Mr. Allen, tbe undersigned requested reconsideration
of tbe ... tter by tbe full .. abersbip of tbe Planning Coaaisaion at the
next ... ting. Tbe aatter was reconsidered, although one aeaber of tbe
collllis•ioa did not appear, aad after review, tbe co .. issioa ruled that a
land uae •tudy of tbe area indicated no need for tbe requested zone
cbaa1e oa tbe b&8i• of existing use or de11&Dd and would be in direct
violation of City Council'• rezoning policy as to area requireaeata.
However, tbe co .. i••ion did atate to Counael tbat the matter was worthy
of co1111ideratioa by tbe Council on its merits, if appealed.
Tbe undersigned respectfully sug1ests that tbe rulia1 of tbe Collllis-
aioa .. to no aeed on tbe b&8ia of existing use or deaand is erroneous,
i ... aach as the very requeat for rezoning itself dlaclo•e• a need on tbe
basi• of existin1 use.
Tbe uadersi1aed doea not believe that the action of tbe Plaaain1
Colllaiaaion is either fair, equitable or just. The City, by apecific actioa,
induced tbe owner and tbe occupants of the premises to ll&ke capital iaveat-
-•t• in rezoaia1 the property under Ordinance Ro. 4, Series of 1955, to
a Di•trict wbicb would perait tbe use and operation of tbe buildia1 as a
.. dical clinic. In ad4ition, tbe under•igned, as legal Cou .. el for tbe
owner, b&8 ... de checks with various lending inatitutioaa and finds that
the aoa-canforlling status of the building lowers its value appreciably.

ll•b•d a policy by Re•olution in 1957, the same baa not beea passed as aa
Ordinance and doea not establi•b any basis for refusal of the inataat re-
que•t. It i• not the de•ire to criticize any policy of Council, but it is
felt that this particular situation is unique, and that aa ezceptioa ls
fully ju•tif ied. It i• believed that the action of the Collllia•ioa was
arbitrary, aad tbat the City Council should, within it• power aad autboritr,
o••rrule the Co11111••ion and 1raat a change in zoning of this property froa
R-2-B to c-~, and thereby make its use as a .. dical clinic coaforaiag.
Sbould tbe Couacil, fro• exaaiaation of the zoning aap, dee• a c-2 zoaias
too radical, tbe property owner would not object to an R-3 Re•identlal or
a C-1 co ... rcial zoala1. However, the latter would be spot zoaiag .uader
tbe Council'• policy, wbereaa tbe c-2 would be only an exteaaioa of aa
exi•tias c-2 Di•trict.

llr. Jordan presented a plat of the area showing bow be would like to
subdivide the area •. Thia would give him 2 building sites, leaving one site
having a front footage of 110 feet which he would be willing to aell to the
City for $2,000.00, of which amount the residents of the a.rea have pledKed
$685.00 leaving $1,315.00 to be paid by the City.
It was brought out in discussion that Council would be setting a pre-
cedent if they purchased land in a drain course.
llr. Jordan said be bad spent five weeks trying to work out so .. solu-
tion and would like for the City to do something.

Thi• parcel consists of ten acres of land lying on the east boundary

boundary line of the District and will not constitute any further extension
