Barly in 1958, tbe tenant desired to ia- creaae tbe •ize of tbe buildln1, and in applying for a perait, waa adivaed specifically for tbe first tlae tbat·tbe use was non-conforming. Thereafter, application was made to the Planning Colllliaslon to place tbi• property back into a conf oraing use by extending tbe C-2 co ... rcial Di•trlct wblcb it adjoins and abuts. In effect, tbls was not a requeat for a change of an area to a new type of zoning; rather, tbe requeat aiaply was to replace it in its proper cate1ory, tbe building beiag a aew building and having been zoned for tbe specific purpose for wbicb it waa u•ed. In support of the request, there was attached a petition circulated in tbe neighborhood containing tbe signatures of in excess of SOI of tbe property owners in tbe neigbborhood,consentin1 to any such change aad joining in tbe request for change for tbeae specific lots. Tbe property was duly posted as required and a bearing bald. At tbe bearing, no one appeared to protest the chan1e,. and after taking tbe matter under adviaeaent, the Planning Commission on Septeaber 18, 1958 denied the request, based upon a statement that there was no need on the b&8is of exi•tin1 use or de11&Dd, a~d that it would be a violation of tbe City Council's zoning policy as to area requirements. It i• not the de•ire to criticize any policy of Council, but it is felt that this particular situation is unique, and that aa ezceptioa ls fully ju•tif ied. It i• believed that the action of the Collllia•ioa was arbitrary, aad tbat the City Council should, within it• power aad autboritr, o••rrule the Co11111••ion and 1raat a change in zoning of this property froa R-2-B to c-~, and thereby make its use as a .. dical clinic coaforaiag. Sbould tbe Couacil, fro• exaaiaation of the zoning aap, dee• a c-2 zoaias too radical, tbe property owner would not object to an R-3 Re•identlal or a C-1 co ... rcial zoala1.
