I hereby subait my resignation from the Englewood City Council.

This action is necessitated because I have moved my residence outside the
City limits of Englewood, Colorado, and could no longer represent the property
tax payers in Ward 2. This is in accordance with state statutes governing a
situation of this type.
It is with deepest regret that I can no longer have the honor of serving
with you. I have gained much through my associations with you and members of
the o.fficial City family.
Thank you, gentlemen, for a very educational and inspiring year.

bas changed bis residence and has moved outside the City of Englewood; and,

by the residents of a Ward in Cities of the Second Class must reside within such
Ward boundaries; therefore,

llr. Cbarlea M. Lubeck of 2791 Sout~ Grant Street appeared before the Council asking
for an indefinite extension of time for compliance with zoning regulations as to single
faaily occupancy. Be indicated a feeling that he has been discriminated against.
Tbe adjoining properties at 2775 and 2785 South Grant Street ~e still being allowed
to rent living spaces.

to consider reducing the Liquor Occupational tax for clubs, which by ordinance is $400.00

puapin1 station to the upper reservoir, so as to have an early priority established.

available Nevada Ditch Water Righta from the Valley Development Company as follows:

City of Englewood and the South East Englewood Water District be supplemented to allow
several tracts in Greenwood Village to be added to the South Ba.at Water District.

llr. Worling of 2995 So. Downina asked if they were being taxed $4.00 for Garbage
re11e>val and was told that they were not under the 1957 budget and levy.
Mr. Bolland, 3524 So. Bannock, spoke against the ordinance.
Mrs. J. W. Wick of 2780 So. Lincoln was against the ordinance but thinks people
should be 11&de to clean up their trash.
llr. Erwin of 3865 So. Bannock and Mr. B. B. Wright of 2900 So. Bannock were asainst
the ordinance.
Mr. Gene Toole of 4396 So. Grant said an ordinance in some form requiring Trash and
Garbage pick-up should be enacted.
Mr. Scott, 2737 So. Bannock, says it should be financed by the aill levy.
Mr. Jaaes o .. AlleJ of 2975 So. Fox Street says be cannot get a grader on .bi• street
or alley.
Mrs •. Saenger of 1090 W. Oxford thinks the people should bury their garbage.
Mr. Donald Barth of 4958 So. Sher11&n thinks it should be handled by a mill levy.

McLellan seconded) that the bill be again tabled, and with the sug-
gestion that those who are in favor of a Garbage
and Trash Ordinance have the proposal .placed on the
ballot at the next regular election.
Councilman Rapp moved and Parker seconded to amend the ordinance to include_ a
specific low rate for service.
The 11e>ve for an amendment to the Ordinance was withdrawn by Rapp and Parker ~

'lllEREAS, application heretofore nas been made for the rezoning of certain property
hereinafter described, within the City of Englewood, Colorado, from R-2B (Two-family
Residential) to 11-1 (Industrial) classification, and the City Planning Commission has
recomaended approval of such change in zoning; and
WllBREAS, public notice has been given of such proposed rezoning by one publication
in the Englewood Herald and Enterprise, a newspaper of general circulation within the
City, and the official newspaper of tbe City, at least fifteen (15) days before the
~blic hearing on such rezoning, and notice of such proposed rezoning has been posted
on the property for fifteen (15) consecutive days pripr to such bearing, as required
by ordinance; and
WHEREAS, public hearing was held pursuant to the aforesaid notice by the City Council
of the City of Englewood in the Council Chambers at the City Hall, 3345 South Bannock Street,
Englewood, Colorado, on the 17th day of December, A. D. 1956, at 'tbe hour of 8 o'clock P.11.,
at which hearing no person appeared to protest or oppose the proposed change in zoning;

WHEREAS, the public necessity, convenience, general welfare and good zoning prac-
tices justifies the change in zoning of the hereinafter described property from R-2B

FOR AN ORDINANCE AMENDING ORDINANCE NO. 17, SERIES OF 1956, ESTABLISHING A BUSINESS AND
·-
OCCUPATIONAL TAX, BY RE-DEFINING CERTAIN PROVISIONS THEREOF RELATING TO THE RATES AND
PAYllBNT OF SAID TAX.
BE IT ORDAINED BY THB CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO:
Section l. Ordinance No. 17, Series of 1956, entitled ~·An Ordinance Establishing
a Business and Occupational License Tax for the purpose of raising Municipal Revenue
and Licensing and Regulating the Carrying on of all Business, Trade•, Occupations and
Professions Within the City of Englewood, Colorado", is hereby amended as follows:
(a) Table I of Section 3 is hereby amended to read:
"$30.00 for the first owner, partner, manager or employee, plus $10.00
for each additional owner, partner, manager or employee, up to a maximum number of
taxable employees of 36. No tax on employees over the number of 36.
(b) Table II of Section 3 is amended to read:
"$15.00 for the first owner, partner, manager or employee, plus $5.00
for each additional owner, partner, manager or employee, up to a maximum number of
taxable employees of 36. No tax on employees over the number of 36."
(c) "Section 4 is hereby amended by deleting from Group A the words "motels
and hotel•", and from Group B the words "Sheet metal works."
(d) Group I of Section 4 is hereby amended to read:
"Sub-group 1: Residential rental units.
"(a) Any person wbo rents, leases of otherwise provides one or
more residential .units for hire shall be subject to a tax
of $3.00 per unit per year.
"(b) A residential unit shall be construed, by way of illustration,
to mean a house, duplex, apartment, hotel room, motel room,
or other like unit, in which a person or family resides,
either transiently or permanently."
Sub-group 2: Commercial rental units.
"(a) Any person who rents, leases, or otherwise provides any
number of commercial rental units for hire shall be subject
to a tax of $4.00 per unit per year".
"(b) Commercial rental units shall be construed to be any type
of premises or .units rented for business purposes, not in-
cluding units in which persons or families reside, as de-
fined in sub-group 1 (b) above.
"(c) This tax shall not be construed to be a tax on persons who
rent or occupy rental units owned or leased for rental
purposes by other parties.
(e) Section 9 is hereby amended by adding thereto the following sentence:
The license tax provided for in this Ordinance shall be paid not later
than January 31 of each calendar year, and any person or firm failing
to pay said tax by January 31 of the calendar year, shall there~fter
be deemed delinquent and subject to the .penalty provisions of this
Ordinance.
Section 2. The City Council hereby finds, determines and declares this Ordinance
is necessary for the immediate preservation of the public peace, health, safety and
convenience.
Section 3. In the opinion of the City Council an emergency exists; therefore, this
Ordinance shall take effect and be in force from and after its final passage and publi-
cation.

llr. Tilghaan Paca, who says he is an optimist, was recognized and he gave a brief
talk on garbage, trash, streets and other problem items now facing the city.

A RBSOLtrrION AUTHORIZING THE TRANSFER OF FUNDS APPROPRIATED FOR CERTAIN DEPAllTllBKTS OF
TRB GENERAL FUND IN EXCESS OF THE AMOUIITS NEEDED DURING THE CURRENT FISCAL YEAR, TO
OTllBR DBPARTllBNTS OF THE GENERAL FUND LACKING SUFFICIENT FUNDS TO COMPLETE THE FISCAL

WRBREAS, an excess of appropriated funds remains in certain departments of the
General Fund, and
WBBRBAS, other departments lack sufficient funds to properly function during the
reaainder of the fiscal year, 1956.
NOW, TllBRBFORE, BE IT RESOLVED that the sum of $25,000.00 be transferred from the
Water Production Fund to the Water Distribution Fund.
BE IT FURTHER RESOLVED that the following sums be transferred from the General
Governaental Fund to the said named funds in the amounts set forth after each:
City Hall Maintenance Fund --------$ 275.00
Library Fund ---------------1,275.00
City Attorney's Office ----------4,450.00
Trash and Garbage Account --------2,800.00
Total -$ 8,800.00
The foregoing transfer does not create any expenditQre in excess of the total
appropriated for the fiscal year, and is made pursuant to resolution passed and 84<>pted
by the City Council of the City of Englewood, Colorado, on the first day of october,
A. D. 1956.

The City Manager stated that there is a possibility of a Sewer Disposal Plant being
built in the Southeast Englewood Water District, on Big Dry Creek near University Boule-
vard, and be would like to have the Water Board have jurisdictional .powers to protect the
purity of the Englewood Water Supply.
The City Manager was asked to recommend an amendment to the Water Advisory Board's
duties as prescribed by Ordinance.

The City Manager was asked to make a study on a future pplicy with regard to ans-
wering fire department calls from outside the City limits. The possibility of setting
up a charge for outside calls was suggested.

City Manager suggested that Council policy on street paving as adopted on June 4,
1956 , be re-confirmed but modified to conform to Manager's office letter and report of
December 3rd, 1956, relative to partially surfaced streets. (Copy in file.)
