During the bearing it was brought out and reported that, during the pilblic~tion '
period, the followinc •inor corrections and revisions were made with full knowledge
of all owners concerned upon notice fro• them of changed ownership, or upon corrected
inforaation fro• County record&, of which revisions the owners involved were notified
by letter. The Citr Clerk waa directed to see that such corrections and revia1ons
are properly included in the certified assessment rolls to be transmitted to the
County Treaaurer of Arapahoe County.

WBBRBAS, there bas been coapliance with all the provisions of law relatin• to tbe
conatruction of paying iaprovements in Paving District No. 6 in the City of Englewood,
Colorado, c~eated purauant to Ordinance No. 16, adopted and approved the 16th day of
July, 1958, aa ... oded by Ordinance Ko. 22, adopted and approved the ~rd day of Sep-

WllBRBAS, at the p~blic bearing held on March 4, 1957, certain minor corrections
were aade in the assess .. nt roll as shown in the minutes of such meeting, and
WBBRBAS, fro• the state .. nt made and filed with the City Council, it appears
that the whole cost of said iaprove .. nts is the sum of $322,936.37, of which aaount
the City of Englewood will pay $58,949.00, leaving $263,987.37 to be assessed aaainat
the real property in said District, •aid amount including costs of inapection, coll-
ection and other incidentals and also including interest as allowed by law; ~d

tioned a share of the said whole cost to each lot or tract of land in said District,
in accordance with the benefits to be derived by said property and in the proportions
and aaounts severally set forth in a Resolution adopted by the City Council on the
4th day of February, 1957, and in a public notice, published in the Englewood Herald
and Enterprise QD February 7, 14 and 21, 1957, which Resolution and notice are by

NOW, THBRD'ORE, BE IT ORDAINBD BY THE CITY COUNCIL OF THE CITY OF ElfGLDOOD,
IN TBB STATE OP COLORADO:
Section 1. That the said whole cost and apportionll8nt of the saae, as set
forth in said Resolution and notice i• hereby approved and confir .. d, and said appor-
tion .. nt is hereby declared to be in accordance with the benefits which the property
in said District will receive by reaaon of the construction of said iaproveaents,
and a share of said coat is hereby aaaeased to and upon each lot or tract of land
within said District in the proportions andfllOunts set forth in said Resolution and
notice.

Section 2. That said assessments shall be due and payab~e at the office of the
City Treasurer, within thirty days after the final publication of this Ordinance, without
de11&nd; provided, that all such assessments may, at the election of the owner, be paid
in installaents, with interest as hereinafter provided. Failure to pay the whole aasess-
.. nt within said period of thirty days shall be conclusively considered and held an election on
tbe part of all persons interested, whether under disability or otherwise, to pay in such
inata11 .. nts. In case of such election to pay in installaents, the assess .. nts shall be
parable at the office of the County Treasurer of Arapahoe County, Colorado,~in ten (10)
eq*&J amn•aJ installaents of principal, the first of which inatallaents of principal
shall be due and payable on or before the first day of August, A. D. 1957, and tbe
reaainder of said inatall .. nts shall be due and payable successively on or before the
s ... day in each year thereafter, until paid in full, with interest in all cases on the
unpaid principal at the rate of six per centum (6%) per annum, payable annually at the
ti .. of payin1 install .. nts of principal. Failure to pay any installment, whether of
principal or interest, when due, shall cause the whole of tbe unpaid principal to beco ..
due and payable i .. ediately, and the whole amount of the unpaid principal and acc-e..d
interest aball thereafter draw interest at the rate of one per centum per month, or
fraction of a 110ntb, until the date of tax sale, as by law provided, but at any tiae prior to the
date of the sale, any owner aay pay the &JM>unt of all unpaid installments with interest at one
per centua per 11e>nth or fraction of a month upon all delinquent instatlments, and all
pen•lties acc,\led, and shall thereupon be restored to the ~ight thereafter to pay in
install .. nts in the same manner as if default bad not been suffered. The owner of any
property not in default as to any installment or payment, may, at any time, pay the whole
of the unpaid principal, with accrued interest to the maturity of the next installaent
of interest or principal. Payments may be made to the City Treasurer at any tiae within
thir~y days after the final pµblication of this Ordinance, and an allowance of five per
centua (51) will be made on all payaents made during such period, but not thereafter.

certified to the CL~nty Treasurer of Arapahoe County, Colorado, for collection, as
provided by law.
Section 3. This ordinance, after its final passage, shall be recorded in tbe city
ordinance book kept for that purpose, shall be authenticated by tbe signature of the
llayor and City Clerk, and shall be published in the Englewood Herald and Enterprise, a
newspaper of general circulation p~blisbed in said City, shall take effect and be in
force upon the expiration of five days after it is ~o published, and shall be and re11ain
irrepealable until the assessments hereby made shall be paid in full.
Section 4. Since it is iaperative that said assessment shall be placed in the
bands of the County Treasurer at the earliest possible tiae, it is hereby declared that
tbis Ordinance is imaediately necessary for the public peace, health and safety, and
tbat it shall take1 effect five days after its final ppblication.
