The Mayor called for roll call. PRESENT: Braun, Brownewell, llcLellan, Parker, Robbins, Scott, and Purcell. Cabb 1311 Bates Parkway All of the above residents living in Bates Parkway requested that the street name remain as Bast Bates Parkway and that changing the name to East Amherst Drive would be confusing as there is already 4 East Amhersts. Councilman llcLellan moved ) Braun seconded ) that the Ordinance be amended to read East Bates Parkway. (same as orininal name) AYES: Braun, Brownewell, McLellan, Parker, Robbins and Purcell. NAYS: None. ABSENT: McCabe, Rapp and Scott. Mrs. Walter A. Meyer of 1340 E. Hahn of 4330 South Fox Street asked the Council to check the names of Kalamath Street and Ithica Avenue. He was of the 9pinion they should be Klamath Street and Ithaca Avenue. FOR AN ORDINANCE CHANGING THE NAMES OF CERTAIN STRBBTS WITHIN TB& CITY OF ENGLEWOOD, COLORADO, AND REPEALING ORDINANCE NO. 30, SERIES OP 1957 AND ALL OTllKR ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HBRDITB. WHEREAS, the City Council of the City of Englewood, Colorado, is of the opinion, and hereby finds, determines and declares that it is for the best interests of the public and in the interest of the public safety and welfare that the various streets, avenues, ways and public hiKhways within the said City be as uniformly named as possible; and WHEREAS, it appears t o the City Council that certain streets, avenues, ways and public highways are not uniformly named and do not conform with the general system of street names within the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: Section 1. That all of Van Meter's additions except the west 100 feet and the east on half of Block 8, Harlem 2nd addition be rezoned to C-2 zone District. That the west 100 feet of Van Meter's addition and the West one half of Block 8, Harlem addition be rezoned to (parking) Zone Distrist. That all monies in the hands of the City Clerk or to come Into bis bands for the fiscal year of 1958, may by applied on the outatanding claims now due or to become due in the said fiscal ear of 1958. Section 3. That all unappropriated monies that may come into the hands of the City Clerk during the year of 1958 may be so distributed among the respective funds herein, as the City Council may deem best under such control as is prescribed by law. Section 4. That during or at the close of the fiscal year of 1958, any surplus money in any of the respective funds, after all claims ~or 1958 against the same have been paid, may be distributed to any other fund or funds in the discretion of the City Council. 543 Section 5. The City Council hereby finds, determines and declares this Ordinance is necessary for the immediate preservation of the public peace, health, safty and convenience. Section 6. A BILL FOR AND ORDINANCE AMENDING ORDINANCE N0.47, SERIES OF 1955, AS AMENDED BY ORDINANCE NO. 31, SERIES OF 1956, ENTITLED, "AN ORDINANCE REORGANI- ZING THE GOVERNMENT OF THE CITY OF ENGLEWOOD, COLORADO PURSUANT 'tO CHAPTER 139, ARTICLE 6, COLORADO REVISED STATUTES 1953, AS AMENDED Alm SUPPLEMENTED: ADOPTING AN ADMINISTRATIVE PLAN PURSUANT TO SECTION · 15 OF SAID ARTICLE 6; SBTTING FORTH THE DEPARTMENTS, EMPLOYEES AND DUTIES PRESCRIVED BY SAID ADMINISTRATIVE PLAN: PRESCRIBING SALARIES AND WAGES FOR BllPLOYEES": AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HBRDITH. Section (d} of Article I of Ordinance No. 47, Series of' 1955, as amended by Ordinance No. 31, Series of 1956, is hereby amended by adding thereto subsection 9, which shall read as follows; "9. City Planning and Traffic Department." Section 2. Section (a) of Article II of Ordinance No. 47, Series of 1955, as amended by Ordinance No. 31, Series of 1956, is hereby amended by substituting therefor a new Section (a), which shall read as follows: "The duly appointed City Manager of the City of Englewood shall possess all of the rights and powers and perform all of the duties set forth in Chapter 139, Article 6, Sections 11, 12, 13, 14, and 15, Colorado Revised Statutes 19 5 3, as amended and supplemented, and shall have such other powers and perform such other duties as may be prescribed in Chapter 139, Article 6, Colorado Revised Statutes 1953, as amended and supplemented, and future amendements and supple- ments thereto. Be shall appoint and designate the personnel necessary for the efficient operation of his office; including a secretary, and a "Service Center" operator. Said City Manager shall have such further powers and per- form such further duties as many be granted or prescribed by the ordinances of the City of Englewood, Colorado, or amendments· thereto, or future ordinances or amendments thereto, and resolutions. Said Ci ty Manager shall further furnish any reports of statements as shall be, from time to time, reasonably requested by the City Council of the City of Englewood," Section 3. Section (c) of Article II of Ordinance No. 47, Series of 1955, as amended by Ordinance No. 31, Series of 1956, is hereby amended by adding therto in the last sentence the words "and personnel records" after the words "insurance records" and by adding thereto an additional sentence, which shall read as follows: "The Deputy Clerk shall perform the dut i es of a Purchasing Agent who, under directive from the City Manager, shall make purchase and I I I I I I I I procurement of supplies, materials, repairs, services and other items of need for all departments, and in such manner as wi ll be for the best interest of t he City." Section 4. Section (d) of Article II of Ordinance No. 47, Series of 1955, as amended by Ordinance No. 31, Series of 1956, is hereby amended by substituting the following sentence as th e first sentence in said section: I "The Police Department shall consist of a Police Chief, Captains, Lieutenants, Sergeants, Patrolmen, Dispatcher-Clerks and Dog Warden, and such other employees as are deemed necessary by the City Manager to perform the duties prescribed by s t atute and the ordinances of the City." Section 5. Section (d) of Article II of Ordinance No. 47, Series of 1955, as amended by Ordinance Ng. 31, Series of 1956, is hereby amended by substituting the following sentence as the first sentence in said section: "The Fire Depar tment shall consisL of a Fire Chief, Deputy Chief, Captains, Lieu t enants- Wngineer, Fireman Mechanics-1st Class, and Firemen-3nd Class, and such other employees as are deemed necessary by the City Mana1er to perform the duties prescribed by statute and the ordinances of the City." Section 6. Section (g) of Article II of Ordinance No. 47, Series of 1955, as amended by Ordinance No. 31, Series of 1956, is hereby amended by substituting therefor a new sec tion (g), which shall read as follows: "The Building Inspection Department shall consist of a Chief Building Inspector, Electrical Inspector, Assistant Inspectors, Clerk, Custodian, Exterminator, ana such other employees as are deemed necessary by the City Manager, to perform the duties in the various phases of Building Inspection as prescribed by statute and the ordiances of the City, to service and maintain the City Hall, t o inspect other City-owned buildings for repair and main- tenance purposes, and to provide an exterminator service against pests and rodents when in the public's interes t . The Chief Inspector is charged with the duty of enforcement of various applicable ordinances, and is particularly charged with the duty of enforcement of the Building Code, the Zoning Code, and the Housing Code, in the manner prescribed in each code, and he shall perform such other duties as are assigned by the C it y Manager, The Chief Building Inspector, as head of the department, and all other department employees shall be appointed by the City Manager. Such Personnel shall be subject to the control of the City manager through the department head." Section 7. Article II of Ordinance No. 47, Series of 1955, as amended by Ordinance no. 31., Series of 1956, is hereby amended by adding thereto a new section (j), which shall read as follows: "Section (j) City Planning and Traffic Department. "The City Planning and Traffic Department shall consist of a departmen Director, a Traffic device maintenance man and such other employees as are deemed necessary by the City Manager to perform the duties precribed by statute and ordinances of the City. The Department Director shall act in the dual capacity of director of the operation traffic department and as City staff Planner and Advisor to the City Planning Commission. The director and all other members of the department shall be appointed by the City Ila.Dager. Such personnel shall be subject to the control of the City Manager through the Department Director." Section 8. Article IV of Ordinance No. 47. Series of 1955, as amended by Ordinance No. 31, Series of 1956, is hereby amended by sub- stituting therefor a new Article IV, which shall read as follows: SALARIES OF EMPLOYEES All employees of all departments of the City of Englewood, eacept the City Manager, Police Magistrate and City Attorney and Assistant City Attorney, shall receive salary compensation effective January l, 1958, as follows, to-wit: (See Budget for 1958) as provided in Chapter 139, Article 6, Section 18, Colorado Revised Statutes 1953, as amended and supplemented; increases and increments in compensation within the limits provided for the Grade may be granted at any time by the City Manager. 546 Section 9. Article V of Ordinance No. 47, Series of 1955, as mended by Ordinance lo. 31, Series of 1956, is hereby ·amended by substituting therefor a new Article V, Which shall read as follows: "The City Manager shall receive annually the sum of $9,100.00, payable in equal monthly installments, plus $300.00 annually for expenses; the Police Magistrate shall receive _ annually the sum of $2,5 50.00, Payable in I equal monthly installments; the Police Court Clerk shall receive a !DODtbly J salary .within grade 8, to be determined by the City Council; The City Attorney shall receive an annual retainer of $2,400.00, payable in equal monthly installments; the Assistant City Attorney shall receive an annual retainer of $2,100.00 payable in equal monthly installments; in each case, wntil cha~ged by Ordinance of tpe City of Englewooa." I I I I R .E S 0 L U T I 0 N WHEREAS, the Tri-City Trust is the owner of 12 cubic feet of water per second of time decreed to the Brown Ditbh Under Priority No. 9, and 2.25 cubic feet of water per second of time decreed to the Epperson Ditch Under priority No. lA, both in Water District No. 8, and WHBREAS, the Cities of Littleton and Englewood desire to use the afore said Brown Ditch Water throughout the 1957 irrigation season and for the sacceeding five years unless sppner terminated, and the City and County of Denver desires to use the aforesaid Epperson Sitch water during said season of 1957, and for the succeeding five years unless sooner terminated, and it is necessary that the lease agreement by formalized in writing, NOW, THEREFORE, BE IT RESOLVED that the Mayor of the City of Englewood, be, and be is hereby, authorized to execute in behalf of the said City A lease agreement between the Cities of Englewoo~ and Littleton, and The Tri-City Trust, Dated June 1,1957, leasing the Brown water dwned by said Tri- Ci ty Trust for the 1157 irrigation season, and for 1958, 1959, 1960 1961 and 1962, unless sooner terminated by either party as provided in said lease. ) Councilman Parker moved, McLellan seconded ) that the Resolution just read b' approved and adopted.
