Block 5 Hamilton & Killies Broadway Heights, is delinq•ent in the payment ot s p ecial taxes over a period or years, and \niEREAS, the owner thereof American Building & Loan Assn. has ottered to p ay the amount ot the said delinquent installments, together with interest on the same at the r ~te ot six p ercent (~) p er annum~ and the Council believes it to be the beat interests or the City to .accept such otter: NOW THEREFORE BE IT RESOLVED: That the County Treasurer ot Arapahoe County be and he is hereby authorized to acce p t as payment in full the amount ot the s a id delinquent installments, together with interest on the same at the rate ot six percent (Sf.) p er annum; and to issue a receipt in full thereeer. Jenkins, Aye ~eigand, Aye Clerk read proposed ordinance NO , Series ot 1942, entitled "An ORDINANCE AUTHORIZI NG AND E MPOVIERI~G MAURICE E. HILL, HIS HEIRS, SUCCESSORS AND ASSIGNS, .TO ENGAGE IN THE TRA NSPORTATION OF PASSENGERS BY MOTOR VEHICLES ON THE STREETS OF ENGLE WOOD, COLORADO, OR ANY ADDITIONS THERETO, FOR UNIFORM FARES, ON REG- ULAR ROUTES AND ON REGULAR SCHEDULES. BE IT ORDAI NED BY THE CITY COUI JCIL OF THE CITY OF ENGLEWOOD: That taurice E. Hill, his heirs, s u ccessors and assigns, are hereby em powered and duly authorized to enga g e in the transportation ot passengers by motor vehicles on t h e streets or Englewood tor uniform tares on regular routes and on regular schedules. The privilege h ereby g rabted shall be for a period or one (l) year from the passage and a pp r oval hereof, and, in t h e event the said Hill himself carries on said o p eration or operations tor one (1) year then the privilege g ranted shall be, and the same is hereby, automatically extended tor an a dditional term ot nine (9) years. The fare charg ed e a ch passeng er tor a one-way ride over the route chosen or tor any fr a ction or said route shall not exceed ten cents tor an adult or !ive cents tor children between t h e a e es of five (5) years and twelve (12) years. Th e said Uaurice E. Hill, his heirs, successors and assigns, shall season- ably pay to the City ot Englewood all license and other tees required by the ordina nces ot s a id City and f a ilure to ma ke such payment shall terminate the p riYi l e g e and franchise herein g r a nted. No vehicle u sed in the trans portation privilege hereby granted shall be parked or le!t standing on the public street known as South Broadway nor on any other public street where such parking may interfere with, or cause congeation, ot tra!f ic. Within tive (5) days n fter the gr a nting of this privile ge Uaurice E. Hill, shall tile a written and signed route or routes and schedule ot the route or routes to be traversed and said route or routes and schedule shall not be changed without the ex press consent ot the City Council ot the City ot Englewood in writing first had a nd obtained. All motor vehicles used under t h e terms of this franchise shall be kept in a safe and serviceable condition at all times and shall be adequately covered with public liability and pro 4 erty dama g e insurance to protect the ublic and particula rly the citizens of Englewood, a gainst any loss or damage. Any final judg e,ent tor damages against the holder of this franchise which remain unpaid tor a eriod o! core t h an thirty days after such Judgment shall become final. shall be conclusive p roof t ~a t the insurance is inadequate and this fra nchise may be revoked for such cause by the City Council after hearing. The rivilege hereby granted sha ll b ecome null and void at any time the Public Utilities Co mm i s sion, certificate, authorizing excerise of the rights and privilege herein g ranted, is sus )ended or terminated tor cause.
