Be it orda ined by the City Council of the City o f Englewood, Colorado• ARTICLE 1. DIFINITIOI1S. Section 1. The term "Taxicab•, when used in this Ordinance, means any motor vehicle used for the ur ose of trans portating ersons witbin the City of Englewood for hire, proYided t h at "taxicab" as hereinabove defined shall not include vehicles used in what is com oonly known as motor bus o p erations with seating capacity of seYen persona or over. ARTICLE 2. Section 1. (a) No cor poration, .)erson or individua l sh a ll eng ag e in the business ot o erating a taxicab or taxicabs u ,on t h e streets of t he City of Englewood without first com plying with al+ of the rovisions of this Or dinance. (b) A lica tions tor a license shall be addressed to the City Council, shall be in writing and shall state ~he followin g f n cts: The full name and address of the ap p li- cant; _if a artnershi p , the nar.1e and address of each artner; it a corp oration, the names and addresses of the officers and directors thereof; and what, if any, p revious ex p erience he or it has had in such business; the mumber of taxicabs desired; the seating c apa city or each t c xicab, according to the manufactQrer•s rating; the type of moto r car to be used; horse p ower, name of manufacturer; rating; State license number; and the len g th of tlae the said t a xicab has been in use. I I I ,I • (c) The City Council shall mnke or h a ve m ~de by inspectors such examination and ins ection of the vehicle betore issuing a license, as it considers nec- essary. The City Council shall refuse a license to, or it already issued, revoke or s u s )end t 1e license of any wehicle round to be unfit or unsuitable tor public patrona g e. The Licenseing Com11ittee of the City Council is hereby authorized and e m!)Owered to establish reasonable rules and regulations for the inspection and o p eration of public vehicles and their appurtenances, construction, and condition or fitness. (d) The City Council shall evidence ~ts c r a nting or a license only after payment or the license fees herein set forth. ( ARTICLE :3. (a) A license fee of twenty-five ($25.00) doll a rs a year sh a ll be paid to the City of En g lewood for each a nd every t a xicab licensed hereunder. Said license shall be issue d as or J a nuary 1 1 1. ea ch and every year, and shall be valid to and including t~e 31st d a y of December next succeeding, unless sooner eevoked by t h e City Council. 1\RTIClE 4. Drivers License. It shall be unlawful for any person to drive or operate a licensed taxicab upon the streets ot the City of Englewood without first complying with the following requirements: Section 1/ (a) Be of the a g e of twenty-one ( 21) ~rears or OW'er. (b) Be or sound physique, with good eyesight, and not subject to epilepsy, Tertigo, heart trouble or any other infirmity of body or mind which might render him untit tor the safe operation of a taxicab. (c) De able to read and write in the English language. (d) Be clean in dress and p erson and not be addicted to use of intoxicating liquors or drugs. (e) P roduce on forms to be provided by the City Council, affidavits or his goo• character from two ~e p utable citizens of the Cit~r who have known him person- ally during tive years next preceeding t h e date of his application, and a fur- ther testimo n ial, o~ a fona )rovide d for that urpose from his last e~ployer unless, in t h e esti mation of t h e City Council, sufficient reason is given for its o is s ion. . (t) Fill out U 'on a blank f o r m to be )rovided by the City Council ot a sta te ment g iving his full name, residence, )lace of residence for tlwe years p reTious to movi.g to his address, ag e, color, height, color ot eyes and hair, ~lace ot birth, leng t h of time he has resided int. e City, whether a citizen of the United States, places of previous em p loyment, whether married or single, whether he has ever been convicted of a felony or a misdemeanor, whether he has p reviously been licensed as a driver or chauffeur, and, it so, whether his license has ever been revoked and fer what cause, which statement shall be signed and sworn t o by the a p ,licant and filed by the City Council as a permanant record. / (g) A license fee of five ($f.OO) dollars shall be paid tor each drivers license. Drivers licenses shall be issued as o! January l, in each and every year, and shall be valid to and including the 3ls) day of December, next succeeding, unless sooner revoked by the City Council. Section ~. Drivers licenses shall be revoked for conviction ot violation of any criminal statutes: for violation of any City ordinance relative to the sale, possession or delivery of intosicating liquor or drugs; drunk and reckless driving ; and shall be sus p ended u.on t h e first offense ot speeding and revoked u p on t h e second offense. Section 3. Drivers licenses may be sus p ended or revoked at any time by the City Council for g ood cause shown and, upon the conviction of any p erson holding a driver's license before a Justice of the Peaee for a Tiolation ot any law ot the State of Colorado, or before the Judge ot the .Iunic1pal Court ot the City of En g lewood, tor the violation of an Ordinance, said Justice or the eace and or said ll u~ici al Jud g e shall immediately re port said convictions to the City Council and said City Cour.cil may revoke or aus1 end said drivers license. Any such sus p ension or revocation shall be noted on the license, together with a statement of the reason thereof and the driver shall be de p rived or his bad g e by the City Council, said bad g e, in case ot sus p ension to be returned to t h e driver at t h e ex p iration of the p eriod tor which the license was sus p ended. A second sus p ension tor the same reason, or in any case, a third sus.ension of driver's license, shall revoke t h e license. No driYer whose license has been revoked s ha ll a g ain be licensed as a taxicab driver in t h e City, except upon presentation of reasons satisfactory to t he City Council. ARTICLE 5. Section 1. The City Council shall, upon issuing a license, designate taxicab stands, call boxes, etc., at which sta nds cabs so licensed shall be required to stand while waiting tor a tronaB e• Section 2. Th at t wo or r.1ore t ax ic a bs s ha ll not be p ermitted to stand side by side (double pa rked) on any street and such taxicabs and the driver's or such taxicabs or t h e persons in c ha r c e t h ereof shall remain quietly at the taxicab stands when not em ~loyed and shall not move ab out the streets tor the purpose ot soliciting or waiting )n tronag e, nor shall the same be left standing at any point or p l a ce une111 loyed other th a n a t t h e stand designated by the City Council. In t h e opinion or t he City Council, this Ordinance is necessary tor the immediate p rotection and p reservation of t h e public health, safety, convenience, and g eneral welfare, and it is enacted .for that purpose, and shall be in full force and effect i w:i ediately after its passage and final p ublic atio~.
